MINUTES OF A PIANNING COMMISSION MEETING
The Fayetteville Planning Commission met in special session Tuesday,
June 8, 1971, at 4:00 P.M., in the Directors Room, City Administration
Building, Fayetteville, Arkansas.
Members Present: Roy Clinton, Helen Edmiston, Ernest Jacks, Dr. Walter
Brown, Byron Boyd, Dr. James Mashburn, Al Donaubauer.
Members Absent: Albert Witte, L. M. McGoodwin.
Others Present: Wesley Howe, Harold Lieberenz.'
The special meeting had been called to discuss proposed revisions to the
zoning ordinance to alleviate some problems in administering the zoning
regulations.
Chairman Roy Clinton asked Harold Lieberenz to explain the matters for
discussion.
Article 4, Section 1, paragraph 3, has been interpreted by the Planning
Office to prohibit the change or replacement of accessory structures
such as signs, gasoline pumps, gasoline tanks, etc. for non -conforming
uses. Mr. Lieberenz proposed to delete a portion of this paragraph to
permit changing of signs, pumps, tanks; etc, of a secondary importance,
The Commission and Mr. Howe felt that the wording would allow a change
in these secondary structures provided, (1) the size of the new structure
did not exceed the size of the original structure, (2) the new structure
was not an additional structure, but was a replacement.
NON -CONFORMING USE
Article 4, Section 5, proposed adding a paragraph to permit the replacement
of accessory structures for a non -conforming use when necessary because of
change of business or deterioration. The Commission approved of this
amendment. The Commission felt strongly that no additional signs should
be permitted on non -conforming uses except when use changes and that should
be approved by Planning Commission.
Roy Clinton said he was concerned about the fact that there is no source of
appeal to permit reconstruction of a non -conforming use destroyed by more
than 50%. He wished to study this matter at a later meeting.
No action was taken on the proposal to amend the bulk and area requirements BULK & AREA
for A-1, Agricultural District. for A-1
There was some discussion about
removing the

in the large scale development
regulations.
No action was taken.
DEVELOPMENT
The height regulations for R-2, Medium Density Residential and R-3, High
Density Residential Districts was discussed next. It was felt an error HEIGHT RESTRICTIO
had been made in the drafting of the ordinance. The setback should be in R-2 and R-3
increased 1 ft. for each ft, over 20 ft. in height, not for each ft. over
10 ft.
The present ordinance permits gasoline pump islands to be located 25 ft.
from street right-of-way, but does not permit location of buildings closer

than 50 ft. in C-1 and C-2, etc. The proposed amendment would correct
this. The Commission was favorable to amending only the regulations SERVICE STA,
pertaining to service stations (Article 7, Section 9) to permit service CANOPIES
station canopies to be located 15 ft. from ROW in all districts where
service stations are permitted.
The possibility of permitting single family and duplex family dwellings
in the commercial districts was discussed. This was not to be amended
this way because;,(1) The property owner could always request to have
the property rezoned. (2) One change previously discussed would permit
an appeal to take care of damaged existing residences.
SINGLE & DUPLEX
FAMILY DWELLINGS
The desirability of permitting warehouses in C-2, Thoroughfare Commercial, WAREHOUSES
was discussed and three alternatives suggested to be considered: (1)Allow IN C-2
Use Unit 21 on appeal to Planning Commission (some members were not'_,wholely
in favor of this. (2) Add warehouses to a use unit now permitted by right
in C-2. (3) Allow the warehousing use only (not all of Use Unit 21) as
a conditional use in C4.
Amending the ordinance to give more flexibility in determining uses INTERPRETATION
permitted in use units was discussed. Dr. Mashburn suggested the last OF USE UNITS
sentence in Article 6, paragraph 3 be deleted.
Amend Article 6, Use Unit 4 by adding"Private dancing, music and dramatic PRIVATE DANCE,
schools." MUSIC, ETC.
SCHOOLS
Amend Article 6, Use Unit 8 to permit "Home Occupational' in R-1. HOME OCCUPATION IN R-1
Amend Article 6, Use Unit 17 to permit "Janitorial Services."

The Commission favored amending Article 6, Use Unit 22 to permit Ready mix CONCRETE
concrete plants and concrete block manufacturers, but did not favor amending PAINTS
Use Unit 21 the same way.
Article 7, Section delete standards for curb cut widths and widths between CURB CUT
curb cuts and intersections as this is duplicated in the Subdivision REGULATIONS
Regulations and the curb cut ordinance.
Amend Article 7, Section 14 to clarify setbacks for churches and amend to
25 ft. side and rear setback if fully air-conditioned; 50 ft. side and
rear setback if not fully air-conditioned.
SETBACKS FOR
CHURCHES
Amend Article 8, Section 1 to clarify what is meant by int of intersection. CLARIFY
It was suggested to use the intersection of lines of (lrcurb, (2) pavement, POINT OF
or (3) roadway. INTERSECTI
No action was taken on the proposal to amend to allow mobile homes on
private individual residential lots.
Ernest Jacks proposed amending Article 6, Use Unit 16 by adding
Liquor Stores and allow Use Unit 16 in C-1 on appeal to the Planning
Commission,
• The Commission wished to study the regulations under Ord. 1239 for
additions to non -conforming uses at its next study meeting.

Mr. Clinton felt the parking regulations under Ord. 1239 for commercial PARKING
uses were better than in Ord. 1747. REQUIREMENTS
• The Commission felt the application for Appeal to Board of Adjustment APPEAL TO BOARD
should be simplified so the applicant could submit one statement as to OF ADJUSTMENT
why the appeal was made.
