The Fayetteville Planning Commission met at 4:00 P.M., Tuesday, May 14 1971,
in the Directors Room, City Administration Building, Fayetteville, Arkansas.
Members Present: Roy Clinton, Ernest Jacks, Albert Witte, Byron Boyd,
Al Donaubauer, Dr. James Mashburn.
Members Absent: Helen Edmiston, Dr. Walter Brown, L. M. McGoodwin.
Others Present: Harold Lieberena, Larry Wood, Wesley Howe, Joe Fred
Starr, Wayne Hulse, Dudley Shollmier, Howell Trumbo,
Russell Purdy, Marion Orton, Mrs. Robbin Anderson.
Chairman Roy Clinton called the meeting to order.
He announced that Item One on the agenda had been withdrawn and read
a letter from Richard Hipp, Attorney, requesting the withdrawal of BOB J. MAYES
the appeal by Bob J. Mayes for permission to use property on East Appeal for Mobile
side of Garland Avenue and South of University Farm to develop Mobile Home Park Withdrawn
Home Park.
The second item on the agenda was an appeal by Wayne Hulse to change
a non -conforming use located on the Northeast corner of West Avenue WAYNE HULSE
and Lafayette Street from shoe repair to order -to -go food. Mr. Hulse Change non-confo

Mr. Clinton reviewed the concern expressed at the previous meeting
10 about traffic. Mr. Hulse said he expected the most of his business
to be people walking. The beat traffic solution he could come up
with was to permit a right turn off Lafayette and only right turns
back onto West Avenue. He promised to erect signs to regulate the
traffic accordingly. He promisedLto have no entry from West Avenue,
only an exit.
Item Three on the agenda was a Large Scale Development Plan submitted
by Hoyet Greenwood for property located on the West side of North HOYET GREENWOOD
College Avenue between Chevrolet used car lot and Sight and Sound L.S.Development
Building, North College Ave.
Mr. Lieberens reviewed the processing through the Plat Review Committee.
The utility companies need a 25 ft. easement on the West side of the
property. The buildings are pulled 40 ft. away from the West property
line. Larry Wood had recommended only two driveway entrances be permitted.
Paul Mattke was not sure they could get on City sewer. There is an
existing underground culvert that spills out to the West which drains
this area.
Mr. Howe said he had heard they did not intend to do anything except
build a 7-11 grocery now. Mr. Lieberena said he understood they planned
to complete it all, they have applied for a variance on a canopy over
gasoline pumps.
Mr. Jacks said all the information called for by ordinance for a large
scale development plan is not included in this. Mr. Clinton asked if

any proof had been submitted that they had checked with the Highway
Department. He proposed that the Planning Office require written
approval from the Arkansas Highway Department on developments fronting
state and federal highways before presenting them to the Planning
Commission,
Joe Fred Starr said he had knowledge that this man only wanted a permit
for one building. He felt the man had felt an obligation to draw a
larger plan due to the Large Scale Development requirements. He asked
whether as a practical matter, it made sense to take up the Commission's
time with something like this. Mr. Clinton said it did.
Mrs. Robbin Anderson said she kept thinking appearance is the reason
for large scale developments, to keep from being a hodge-podge and
to try to make it more attractive. She voiced approval of the regulations.
Item 4 on the agenda was a request by H. Dudley Shollmier to construct DUDLEY SHOLLMIER
two dwellings on unsubdivided property located on the Northeast corner
of Sequoyah Drive and Rex Drive.
Mr. Shollmier said he was just trying to get building permits as fast
as possible without waiting for an informal plat to be processed.
Mr. Lieberenz reviewed action to date. He still has to check with
the City Attorney to determine whether the Commission can waive all
the requirements for an informal plat.
Item 5 on the agenda was a Large Scale Development Plan submitted
by Fallingwall. Inc, and Joe Fred Starr for property located between FALLIHGWALL, INC.
Maple and Lafayette Streets and East of Frisco Railroad. Mr. Starr Maple & Lafayette
was present.
Mr. Lieberenz reviewed the processing to date. A permit was issued
for Building "A". Due to the width of the frontage, no permit could
be issued for other buildings until more property was acquired to
total at least an acre in area. Additional property was then acquired
facing Lafayette Street. When the Plat Review Committee reviewed the
plan, Mr. Wood brought to the attention of the Planning Office the
"expressway" supposed to come down the railroad right-of-way. The
Planning Office has interpreted the expressway as being 50 ft. on
either side of the railroad right-of-way. The problem is, if one
lane of the expressway goes to the East of the railroad, these buildings
could not be built, The construction on Building "A" is probably
advanced as far as the roof now.
Mr. Howe said there is a problem with the expressway in regard to
Urban Renewal and a number of things. He bested a review of the
feasibility of the expressway South of Maple (or through the built-
up area). If it is not coming to pass, take it off the Major Street Plan.
Roy Clinton observed that the zoning ordinance has made non -conforming
structures of..all commercial buildings in town with the requirement
for a 50 ft, setback from right-of-way. He also said he had understood
that Mr. Vizzier had intended to eventually use the railroad right-of-
ej way for the expressway.

Mr. Lieberenz said that the utility companies also requested a 10 ft@
useable easement on the West side of the buildings. Mr. Starr said
there is 25 ft. of railroad right-of-way on level land.

Mr. Lieberenz reviewed the processing through the Plat Review Committee.
He said some people want to buy part of the Wooloo property to develop
with a large store, They don't want to go to a subdivision plat.
The people who own the property now do not want to go to the expense
of platting and subdividing, either. Paul Mattke said the building
cannot be sprinklered because the water lines are not large enough.
Also, the amll culvert under the highway doesn't appeal to be
large enough to drain a paved area. Mr. Wood was concerned about making
all entrances to property common accesses, Mr. Lieberenz said the
main problem is the requirement of the subdivision ordinance for a
subdivision plat; secondly the requirements for a large scale
development, The City Engineer is not satisfied there is ample facility
to take care of run off,
Mr. Howe said he agreed with the City Engineer but that the City Attorney
says that unless they are diverting some water somewhere else,, they
have a right to let the water go where it has always gone.
Mr. Wood said he Met there should be an understanding on all of this
property as to the amount of exits and egresses onto College Avenue,

Department felt the exit was fine, Mr. Clinton said he thought they
should got the signature of the resident engineer on hi-hway openings,

Item Seven on the agenda was a discussion of the I-1, Heavy Commercial
and Light Industrial'i District, around Kelley Brothers Lumber & Supply
Comparq rezoning request on Johnson Road, North of the By -Pass.
The Board of Directors is holding up Kelley Brothers rezoning petition
for a study of surrounding property by the Commission. Mr. Wood said
his initial recommendation had been that if they considered rezoning
any of the property back to residential, it should all be rezoned and

not have residential sandwiched between two industrial districts.
One reason he had suggested dezoning was to avoid having industrial
traffic crossing Johnson Road to get to the railroad tracks. He
felt nothing should be done with that I-1 until such time as they
can show that it is free of flooding. He said he could now see the
validity of reserving what little flat land we have near railroads
for industrial use; therefore, it does appear to be desirable industrial
property. He could see the advantages of I-1 for both this property
and the property on Highway 112. This was discussed further. Mr. Wood
recommended that the Commission consider initiating action to dezone
the I-1 surrounding Kelley Brothers rezoning petition.
