HomeMy WebLinkAbout1971-04-20 MinutesMINUTES OF A PLANNING COMMISSION MEETING The Fayetteville, Arkansas, Planning Commission met at 4:00 P.M., Tuesday, April 20, 1971, in the Directors Room, City Administration Building, Fayetteville, Arkansas, Members Present: Byron Boyd, Dr. James Mashburn, Dr. Walter Brown, Roy Clinton, Ernest Jacks, Helen Edmiston, Members Absent: Al Donaubauer, Albert Witte, L. M. McGoodwin. Others Present: Gene Thrasher, Ervan Winberly, Gene Garrett, Larry Wood, Harold Lieberenz, Joe Cogdell, David Faught, Lois Slaughter, Wesley Howe, Chairman Roy Clinton called the meeting to order. The first matter considered by the Planning Commission was the Final Plat Phase II Development and a Replat of Final Plat of Phase I Country Club Estates. Mr. Lieberenz explained that Phase I had already been filed, but it was found that Phase II made some changes in the dimensions of some lots shown on Phase I, The plat has been held up for months to satisfy Paul Mattke, City Engineer. Everything has now been cleared to his satisfaction and he has signed the plat. Ernest Jacks said the Subdivision Committee has also reviewed the plat and are satisfied. COUNTRY CLUB ESTATES, Final Plat Phase II and Replat of Phase I The second matter considered by the Planning Commission was the petition to close that portion of Elm Street between Leverett Avenue and Chestnut Avenue filed by Gene Thrasher and John B. May. Harold PETITION TO CLOSE Lieberenz explained that everything is in order except written con- PORTION OF ELM ST, firmation from the telephone company has not been received. The local Gene Thrasher representative feels there is no problem. Mr. Lieberenz suggested that t the Planning Commission might approve the closing of the street with the recommendation that the Board of Directors not act until the telephone company approves. Roy Clinton questioned whether the University might have fenced the 20 ft, dedicated for a street just South of the University Farm. Mr. Lieberenz did not feel they had because it was not reflected on Mr. Thrashers survey. The third item considered by the Planning Commission was the Preliminary Plat of Thrasher -May Subdivision, a Replat of Block 2 and part of Block 3, Parkers Plat of Valley View Acres. Mr. Lieberenz explained that this plat divides the property into two main areas. It has gone before the Plat Review Committee. Everything seems in order. Preliminary Plat Ernest Jacks asked what the difference between a dedication of easement for street purposes and a dedication for street right of way was and why the plat showed an easement for utilities and street on the North side. Mr. Lieberenz said he had recommended this because Mr. Thrasher does not need the street for his development and does not wish to build the street. Roy Clinton asked if he planned to improve Leverett and Mr. Thrasher said he did. Mr. \Clinton said a performance bond or contract would be required to insure the improvement of the portion of Leverett Street North of Poplar. 4-20-71 -2- Wesley Howe explained that from an administrative standpoint there is some advantage to the easement rather than a ROW dedication. With a ROW dedication, the City has the responsibility of cutting weeds, etc. If it is an easement, it stays in ownership of the developer and he has the responsibility of maintaining it until it is developed as a street. He was of the opinion the easement was what the City wants. The next matter discussed was the revised Large Scale Development Plan for Leverett Garden Apartments submitted by Gene Thrasher. LEVERETT GARDEN APTS, Mr. Thrasher explained it was necessary to come b`ck for approval L. S. Development again, because the FHA changed the apartment layout. Mr. Lieberenz said the only problem encountered on plat review was a setback problem on some of the buildings. However, the Subdivision Committee did not think we were following exactly the requirements of the ordinance as the plan did not show utilities, proposed and existing, nor did it show drainage and proposed grading changes. The Developer has since presented a plan correcting setbacks to meet the zoning requirements, showing water mains, sewer mains and proposed drainage. Mr. Jacks said he was concerned about topo changes and where the storm Crater would go. Mr. Lieberenz asked Mr. Thrasher to clarify what he intends to do with the North 186 ft. Mr. Thrasher said he would like to have this deleted from the plan. He will still build the street to the ROW for the North street. The width of Poplar Street was discussed. Ervan Wimberly said it is already 30 ft. off the centerline on the North side. The next matter discussed by the Commission was the proposed Preliminary Plat of Garrett -Richardson Subdivision for property located on the South side of Mt. Comfort Road, Harold Lieberenz explained this has been through the Plat Review Committee and Subdivision Committee. Larry Wood asked for a stub street to either the East or West and one is shown to the East. There is no sewer service in this area yet. One lot is 7 ft. narrower than requirement for lots with septic tanks. Planning Commission can vary this. Easements are adequate for sewer service at a later date. One property owner has not been contacted, this person is incompetent and they are unable to determine who to contact in her behalf. Mr. Garrett plans to develop part at a time and would like a building permit for.the lot adjoining Mt. Comfort Road. The Plat Review Committee did not object so long as the house faces the proposed street and has access off the proposed street. Ernest Jacks asked why Larry Wood had not felt a street should be stubbed both East and West. Mr. Wood explained that the creek to the South made it unlikely that a network of streets would develop here. He foresees rather a loop pattern off and back onto Mt. Comfort Road. The next matter discussed was the resubmittal on the preliminary plat of East Gate Addition No. 2. Harold Lieberenz gave a history of the original submittal on East Gate No. 2. The plat had been disapproved because of the street lay out. One property 'owner with one lot is blocking his adhereing to the recommendations of the Planning Commission. This proposal covers only 4 lots. The Plat Review Committee recommended denial unless he will off set the street 25 ft. on the South. The Subdivision Committee agrees with this. Mr. Barrett was contacted by phone by the engineer and agreed to offset the street. GARRETT-, RICHARDSON SUB. EAST GATE ADD. #2 I Preliminary Plat 4-20-71 -3- The next item before the Commission was the development plan for property abutting Highway 71 By -Pass, a controlled access highway, at 16th Street and West Custer Lane submitted by Joe B. Cogdell. Harold Lieberenz referred to a map showing the location of the 71 By -Pass right-of-way. There is an ordinance calling for an access road to be constructed alongside the By -Pass. There are some other problems here dealing with setbacks for which Mr. Cogdell is going before the Board of Adjustment. Another problem the Commission will have to decide on deals with the curb cuts. Entrances shown on the plot plan do not comply with the ordinance regulating curb cuts. The Commission may vary the curb cut regulations. Mr. Cogdell told Mr. Clinton that all the other lots to the South are residential. The difficulty of getting an access road at this point was discussed at length. The platted lots back up to the right-of-way for the By -Pass. It was noted that it would not be possible to use West Custer Lane as an access road because it curves back to the East and houses are already built on it. JOE B. COGDELL The discussion of I-1, Heavy Commercial & Light Industrial, around the rezoning request of Kelley Brothers Lumber & Supply Company was DISCUSSION ON I-1 deferred until the next meeting. Larry Wood had not had time to ON JOHNSON ROAD study this and compare it with the trucking uses on Highway 112. The Board of Directors had deferred final action on the Kelley Brothers rezoning request until the Planning Commission decides what to recommend on the balance of the I-1. Under "Other Business", Mr. Lieberenz told the Commission that the Plat Review Committee had reviewed the Bob J. Mayes request for permission to develop a mobile home park East of Garland and South of the University Farm as requested by the Commission April 6. Although the Major Street Plan does not show a street through here, it has been recommended by Mr. Wood and other people that this be an BO ft. street. David Malone, City Attorney, Wesley Howe, City Manager, Larry Wood, Paul Mattke, Water and Sewer Superintendent, and Junior Parker, Street Superintendent, had met to determine a policy on this problem. They recommend that this trailer park request be denied as the property is only 104 ft. wide. Also, the City Engineer was not sure they could get into sewer mains, and if not, they would need 40 acres for a septic tank system. It has been recommended that the Commission deny this application. The Commission returned to action on the matters previously discussed. BOB J. MAYES Appeal for Mobile Home Park Ernest Jacks moved that the Commission approve the Final Plat of Phase II Final Plat of Development and a Replat of Final Plat of Phase I. Country Club Estates. COUNTRY CLUB Byron Boyd seconded. It was approved unanimously. ESTATES RESOLUTION PC -20-71 xxxxxxKXXXXXxxxxxxxxx Dr. James Mashburn moved that the Commission recommend approval of the CLOSING ELM ST* closing of Elm Street between Chestnut and Leverett if the telephone company consents. Ernest Jacks seconded. It was approved unanimously. 4-20-71 -4- Ernest Jacks recommended approval of the preliminary plat of Thrasher - May Subdivision if this matter of dedication of right-of-way versus THRASHER -MAY SUED. easement for street is worked out. Dr. Mashburn seconded. It was approved unanimously. Regarding the Leverett Garden Apartments plan, Mr. Lieberenz pointed out that the day care center shown on the plans is a conditional use LEVERETT GARDEN APT and must be approved by the Commission. Ernest Jacks moved that the development plan be apprvoed with amendments shown and with the day care center and further with the suggestion that they set the line on the North where they want it to be. He noted he did not intend this for approval of mobile homes on the North 186 ft. Dr. Mashburn seconded. It was approved unanimously. Ernest Jacks moved that the preliminary plat of Garrett -Richardson GARRETT-RICHARDSON Subdivision be approved and that Mr. Lieberenz be authorized to issue Preliminary Plat one building permit on Lot 1, Block 1, and that the Commission waive the 100 ft. frontage requirement for one lot. Dr. Mashburn seconded. It was approved unanimously. Dr. Mashburn recommended approval of the resubmittal on the Preliminary Plat of East Gate Addition No. 2 with the 25 ft, offset in street EAST GATE ADD. #2 design requested by the Plat Review Committee, Byron Boyd seconded. Preliminary Plat It was approved unanimously. The Commission discussed the Joe B. Cogdell development plan again. Mr. Jacks was concerned because there is a lot of property between JOE B. COGDELL this intersection and Cato Springs Road. The map giving access points Controlled Access granted by the Arkansas Highway Department was checked and also the engineering plans for this intersection. Dr. Brown left the meeting at 5:15 P.M. Mr. Howe, Mr. Lieberenz, and the Commission discussed the curb cuts shown in relation to the ordinance regulating curb cuts. Ernest Jacks recommended that the development plan be approved as to curb cuts and access road (none shown). Byron Boyd seconded. It was approved unanimously. Ernest Jacks moved that the appeal for a mobile home park on the property South of the University Farm and East of Garland by Bob J. Mayes be denied because the City needs property here for a future street and BOB J. MAYES because of the sewer problem, etc. Helen Edmiston seconded. It was Mobile Home Park approved unanimously. Ernest Jacks also recommended the initiation of a public hearing on designation of street immediately South of University Farm rather than MAJOR STREET PLAN Elm Street as a major street. Dr. Mashburn seconded. It was approved unanimously. 0 4-20-71 -5- Larry Wood presented some recommendations to the Commission that had evolved from a study he and Harold Lieberenz had made of the various STUDY OF R-0 DIST. R-0, Residential -Office Districts. On a map showing the existing R-0 he had prepared an overlay with his recommendations for changes. 1. GREEN ACRES ROAD: Properties South of Poplar on the West side of Green Acres Road have the zoning split between R-0 and C-2. He recommended they be split with the R-0 on the North and the C-2 on the South to Sycamore. He wanted to check and be sure no single piece of property was split by zoning. David Faught, who took Mike McDowell's place as Assistant Executive Director of the Housing Authority, was introduced. 2. AROUND TRENTON STREET AND HIGHWAY •7,1: Mr. Wood recommended the section bordering on College remain R-0, with R-2 to the West as far as Park Avenue. The R-2 would serve as a buffer between the R-0 and R-1. Lois Slaughter who owns the motel on Trenton objected to her property being in the R-0. She said it was commercial when they purchase; it. Dir. Wood explained he had left it R-0 because of the bad grade on College and that property_hdre is beginning to corner into the residential area. 3. AROUND DOWNTOWN AREA: Mr. Wood recommended that the C-2 and C-3 along College be connected together and that the R-0 be taken off College. On the East side of College, he recommended that • the Tebbets House, Library, and medical offices be R-0. He felt R-0 for the Tebbets House would provide a retaining buffer between commercial and R-1. He proposed reducing some of the C-3 to R-0. He recommended following the railroad tracks from Meadow to South with R-0, as this is all residential now. He said his proposals and the needs of the Housing Authority correspond. James Mashburn moved that a public hearing be called for the purpose of amending the R-0 and other zoning districts as proposed. Helen Edmiston seconded. It was approved unanimously. XXXXXXXXY=J0O(XXXXXX= RESOLUTION PC 22-71 XXxXxXXXxXXXxxXXxxXX Mr. Faught assured Mr. Clinton this would not create any problems for the Urban Renewal Program. He said this would effect all zoning changes within the project area. The minutes of April 6, 1971, Planning Commission meeting were approved as mailed. Mr. Clinton asked the Commission to keep in mind the letter from Mr. Eason concerning duplexes in R-1.
