MINUTES OF A PLANNING COMMISSION MEETING
The Fayetteville Planning Commission met at 4:00 P.M., Tuesday, March 16,
1971, in the Directors Room, City Administration Building, Fayetteville,
Arkansas.
Members Present: Helen Edmiston, Roy Clinton, Dr. Walter Brown, L,,, M.
McGoodwin, Albert Witte, "A1" Donaubauer, Ernest
Jacks, Dr. James Mashburn.

Mike McDowell, and other unidentified persons.
Chairman Roy Clinton called the meeting to order.
The first item on the agenda was the proposed replat of a portion of
Meadowlark Addition. As a form of explanation, Mr. Clinton stated REPLAT PORTION OF
that the public hearing on the preliminary plat had been closed at MEADOWLARK ADDITION
the last meeting and the Commission did not expect to hear any
opponents or proponents. However, a number of people opposing the
replat were present and were represented by Paul Jameson, Attorney
and requested to be heard.
Mr. McGoodwin said the Commission has demonstrated a great deal of
concern for the neighbors by withholding action prior to this time and
he saw no choice but to approve the plat as it meets all requirements.
L•. M. McGoodwin moved that the Commission approve the preliminary plat
to replat Lots 1, 2, 3, Block 7, and Part of Lot 2, Block 6, Meadowlark
Addition. Dr. Walter Brown seconded the motion.
Paul Jameson said one of his clients had received a letter advising them
a hearing was to be held on this matter today. Mr. Lieberenz said no
letter was mailed, but an agenda was mailed to one of the opponents.
Laverne Heflin said he had understood at the last meeting this was put
off until this meeting so the opponents could come back better prepared.
Ernest Jacks arrived at 4:15 P.M.
Mr. Jameson said he was retained after the last meeting and had made
about 4 trips to the Planning Office and obtained certain documents
and papers and was led to believe there would be an opportunity to
present a case today. Mr. Lieberenz said this was not the case, the
Planning Office is obliged to give any information requested to attorneys.
Mr. McGoodwin withdrew his motion and Dr. Brown withdrew his second.
Mr. Witte said it has been said the Commission has no basis to approve
the plat and therefore, he moved that the Commission re -open the case
to discuss one question. Does this comply with our regulations or not:

Helen Edmiston seconded the motion and it was approved unanimously.

Mr. Lieberenz explained the reason for sending Mr. Heflin the agenda
was because he had approached the Planning Office at various times
before and after the public hearing, and it was felt he should receive
an agenda showing this matter would be brought up today.
Paul Jameson speaking on behalf of the opponents said he thought the
Commission had the authority to act with judgment on these matters rather
than to just administer the minimum standards. He gave as reasons why
he did not feel the plat met standards: (1) Cato Springs Road was 50 ft.
wide, the General Plan calls for urban collectors to be 60 ft. wide with
curb and gutter and rural collectors to be 80 ft. wide with drainage.
(2) Subdivision regulations require blocks to be two tiers of lots
except when fronting on a major street or when impossible due to topography;
Block 6 1s only one tier of lots. (3) In Block 7, Lots 1, 22 3, and 4,
and Lots 12, 132 14, and 15 are arranged with their backs abutting the
sides of the adjoining lots. He labeled this poor planning.
Lewis Jones, Attorney for Meadowlark, told Mr. Jameson that Block 6 was
already platted as only one tier of lots, this is only a replat.
Larry Wood said there has been no determination as to what is defined as
an urban street and what is defined as a rural street. It has been
assumed anything inside the City was an urban street. Cato Springs Road
is shown on the Major Street Plan as a collector street.
Dr. Mashburn arrived at 4:45 P.M•
Chairman Clinton declared the public hearing on Meadowlark replat closed.
L. M. McGoodwin moved that the preliminary plat to replat part of Meadowlark
be approved. Ernest Jacks seconded. The votecwas taken. Voting for
approval of the plat were Jacks, Mashburn, and McGoodwin. Voting against
approval of the plat were Donaubauer, Witte, and Brown. Chairman Clinton
said he must vote to break the tie and voted for approval of the plat,
whereupon Mrs. Edmiston said she must vote against approval of the plat.
There remained a tie vote. No action was taken further.
Lewis Jones remarked that failure of the Planning Commission to either
approve or disapprove the plat in his opinion would actually be deemed
approval of the plat.
The next item on the agenda was the rezoning petition of A. W. Realty
for property located on the East side of Highway 71 North in the vicinity
of Stearns Road and Joyce Street and extending South of Mud Creek from A.W. REALTY
A-1, Agricultural District, and R-1, Low Density Residential District, East side of
to I-1, Heavy Commercial & Light Industrial District, C-2, Thoroughfare Highway 71 N
Commercial District, C-3, Central Commercial District, and R-3, High
40 Density Residential District, continued from March 2, 1971.

Wesley Howe presented a memo to the Commission upholding the staff
recommendations made by Larry Wood at the March 2, 1971 meeting. He
gave as the basis for his conclusions the statement of Community Land
Use Goals and development objectives which the Planning Commission
forwarded to the Board of Directors when the General Plan was adopted.
He felt the real need at this time was for residential development.
His memo was prepared because the Commission had requested a revised
Staff Report to be prepared for this meeting.
Lynn Wade, John Carson, and Charles Scharlau were present to represent
the rezoning request. They offered to compromise on part of the zoning
request by making the following changes: (1) Change the zoning requested
on 40 acres in the Northeast portion from C-2 to R-2 and propose a planned
unit development with a density of 450 units on the 40 acres. This is a
part of Tract 3. (2) Reduced the request for Tract 5 from R-3 to R-2.
Mr. Carson stated the reason for requesting C-3 on Tract 2 rather than
C-2 was that a greater density is permissible in C-3 and a few uses,
among them apartments, are permissible in C-3 not permissible in C-2.
He said the change in request for a portion of Tract 3 as R-2 changed
the ratio of residential to commercial.
Mr. Howe said
he felt the proposed road between Stearns Street and Joyce
Street would
be a logical buffer between the commercial areas and the
residential area to the North. Mr. Donaubauer asked Larry Wood if the
compromises offered followed his thinking. Mr. Wood said in part, yes,
in part, no.
His recommendations would be: (1) R-2 on 40 acre tract
is reasonable
on a planned unit development. If you take it out of the
planned unit,
he had reservations. (2) C-3 for Tract 2 is still too
strong. (3)
R-2 is reasonable on Tract 5. (4) Reluctant to go commercial
on the North
side of the street; he would tend to go R-2. (5) He felt
the location
of the industrial request was unfortunate, but was willing
to "live with
it." (6) He felt Tract 2 would'be better with R-0 South
of the creek
and C-2 North of the creek. He said the long range plan does
not recognize
anything but residential on this property nor any commercial
North of the
existing commercial on Millsap Road,
Ernest Jacks suggested R-0 on that portion of Tract 3 between the 40 acre
tract and the intersection of the two roads and C-2 West of the intersection.
Mr. Wood said the uncontrolled use of R-0 bothered him because of the
possible density. He cautioned the Commission to be careful of any
precedent it might set on zoning. In answer to questions from Mr. Witte
and Dr. Brown, Mr. Wood said he thought C-1 would take care of what is
planned on Tract 4, rather than C-2. He would personally like to see
that located elsewhere.
John Carson again agreed to the 40 acre R-2 with a planned unit development
in Tract 3, but said they had to have some flexibility. Since they foresee
this as a major growth area for Northwest Arkansas, he feels they need all
the commercial.requested and need the C-3 in Tract 2. They hope to enhance
and use the creek in their development. Mr. Scharlau said the lease on
Arkansas Western Gas's present downtown facility expires October, 1972.
There is a sense of urgency. Also, Mr. Carson said I.D.C. was ready
to proceed with development,:but must have zoning first. He conceded
Tract 2, North of the Creek as C-2 as the Commission had requested.

Mr. Clinton summarized the original request and changes that have been
made. He said one problem the Commission has is that there is a lot
of land zoned commercial and not being used.
Mr. Carson offered to accept R-O,East of the intersection in Tract 3.
Mr. McGoodwin said he would like to see Tract 4 reduced to C-1. They
said the type of development they envision would require C-2. The
Commission asked Mr. Wood his opinion of the changes thus far agreed
upon. 'He said he felt they could be acceptable.
Dr. Mashburn said the Commission has wanted a large scale plan like this
for some time, this is the first one presented. They are going to build
an East-West street and develop Mud Creek. He moved that the amended
rezoning request be approved. Al Donaubauer seconded. It was approved
unanimously as amended through mutual agreement.

The next item on the agenda was the request for permission to change
from one non -conforming use to another non -conforming use property ASKEW ENTERPRISE
located at 245 North Church Avenue. The request was filed by Askew Change of non -
Enterprises. Paul Engskov represented the request. He said the conforming use
building was originally designed for preparation of food, has recently
been used for warehousing and storage, and they propose to use it as
a food processing plant, probably employing 4 persons initially.
Dr. Mashburn moved that the request be approved; Mr. Donaubauer seconded.
It was approved unanimously.
Mr. Witte left the meeting.
The next item on the agenda was a large scale development plan submitted
by C. T. Pearson, Jr. for property located on the Southeast corner of the
intersection of Sixth Street and South School Avenue. C.T.PEARSON, JR.
Large -Scale
There was a discussion on the recommendations of the Subdivision Committee, Development
Plat Review Committee, and variances granted by the Board of Adjustment.
The Subdivision Committee reported the Arkansas Highway Department had
requested that 30 ft, additional ROW on School Avenue be dedicated.
Mr. Pearson said he had consulted Junior Parker and he had felt that
20 ft. would be enough. He was told the Planning Office had contacted
Curtis Pangle, District Engineer for A.H.D., and they had requested
30 ft. Mx. Pearson said he understood at the last meeting that if the
sewer had to be replaced, it would have to be at his expense in cutting
the paving. He said he had consulted Junior Parker in constructing the
drainage structure. Mr. Howe asked if all parking shouldn't be back of
any future street widening.
10 Mr. Jacks said the entrances and exits would need to be redesigned and
worked out with the Highway Department. He also felt there should be no

opening onto Locust Avenue since it is a residential street. Someone
said the Methodist Church has purchased all that property between Sixth
and Seventh Streets except one house.
Mr. McGoodwin moved that the Commission approve the plan subject to
Mr. Pearson dedicating the property required by Arkansas Highway
Department for widening of Highway 71 and Sixth Street and meeting
highway construction requirements. Al Donaubauer seconded. It was
approved unanimously with a request that a letter be obtained from
the Arkansas Highway Department stating these conditions have been
met.
The next item on the agenda was a resolution finding that the Urban
Renewal Plan conforms with the Comprehensive City Plan and Zoning RESOLUTION ON
Ordinance of Fayetteville. Mike McDowell of the Housing Authority URBAN RENEWAL
was present. Larry Wood had reviewed the plans with him and stated
some changes in zoning will need to be made, but the changes will
be less intensive than existing. Mr. McDowell said the Board of
Directors will be required to hold a public hearing on the Urban
Renewal Plan later and if it is approved, the zoning in the Urban
Renewal will become the zoning.
Dr. Brown moved that the resolution be approved. Al Donaubauer seconded.
It was approved unanimously.

placed first
on the agenda for April 6.
Mr. Howe said the Commission could consider his 'memo regarding
subdivision regulations and the Major Street Plan'at the April 6 meeting.
He asked that a designation between urban and rural streets be added to
the discussion.
The minutes of March 2, 1971, were approved as mailed.
The meeting was adjourned at 6:45 P.M.

WHEREAS, at a meeting on March 16, 1971, the public hearing was
continued and after reviewing additional staff recommendations the
Planning Commission voted to make a recommendation to the Board of
Directors on amending the petition of A W Realty Company for rezoning.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO
THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS.
SECTION 1. That an ordinance be adopted for the purpose of rezoning
the following hereinafter described property known as Tract 1, Tract 1-A,

A RESOLUTION BY THE FAYETTEVILLE CITY PLANNING COMMISSION FINDING THAT THE
URBAN RENEWAL PLAN AIM PROPOSED ZONING PLAN FOR THE CENTER SQUARE URBAN
RENEWAL PLAN CONFORMS WITH THE COMPREHENSIVE CITY PLAN AND ZONING ORDI-
NANCE OF THE CITY OF FAYETTEVILLE,
WHEREAS: The Urban Renewal Plan and proposed Zoning Plan for the
Center Square Urban Renewal Project in Fayetteville, Arkansas
was reviewed by the Fayetteville City Planning Commission at
their regular monthly meeting held on the 16th day of
March, 1971; and
WHEREAS: A majority of the members of the Fayetteville City Planning
Commission were present at the meeting; and
WHEREAS: The Urban Renewal Plan shows the general location of streets,
residential areas, office and commercial areas, public areas,
and renewal actions; and .
WHEREAS: The Zoning Plan shows boundaries for proposed zoning districts
within the Center Square Urban Renewal Project.
NOW THEREFORE BE IT RESOLVED BY THE FAYETTEVILLE CITY PLANNING COMMISSION
FINDS:
1. That the Urban Renewal Plan for the Center Square Urban Renewal
Project in Fayetteville, Arkansas conforms with the Comprehensive
Plan for the City of Fayetteville.
2. That the proposed Zoning Plan and timing of changes conforms
with the Fayetteville Zoning Ordinance and Zoning District Map
as amended.
