The Fayetteville Planning Commission met at 4:00 P.M., Tuesday,
January 19, 1971, in the Directors Room, City Administration
Building, Fayetteville, Arkansas,
Members Present: Roy Clinton, Dr. James Mashburn, Dr. Walter Brovm,
Ernest Jacks, Helen Edmiston, Al Donaubauer,
Members Absent: Byron Boyd, Albert Witte, Clark McClinton.
Others Present: Wesley Howe, Harold Lieberenz, Larry Wood, Loris
Stanton, Dr. Gene Lynch, Bryce Davis, Dr. Phillip
Taylor, Jack Cole, Dottie Colling, James H. White,
Mrs. Robbin Anderson, W. M. Hutchison, Kathryn
Fiser, Marilyn Schoppmeyer, Mrs. A. C. Moldenhauer,
George Cook, Robert Hursh, W. N. Murphey, N. F. Totty,
and many other persons not identified.
Chairman Clark McClinton was not present. Ernest Jacks called the
meeting to order and presided until the arrival of Vice -Chairman
Al Donaubauer at 4:20.
The first item on the agenda was the proposed Final Plat of
Cummings -Goff Subdivision. Roy Clinton gave a Subdivision CUMMGS-COFF SUED.
Committee Report. He said everything has been worked out except:
1. A question as to whether the gas company will need to
use some easements designed for drainage only.
2. Question of whether 10 ft. called for by Major Street
Plan should be dedication or setback.
He proposed the City Attorney be consulted on the latter question
before any action was taken.
The next item on the agenda was the Preliminary Plat for Bois
d'arc Hill, a proposed subdivision located West of Highway 71
By-pass and South of Highway 62, Roy Clinton gave a Subdivision Preliminary Plat of
Committee report. Some design changes have already been made as BOIS d1arc HILL
requested by the Plat Review Committee. They also suggest that
the cul-de-sac on the East be extended straight ahead to get to
the property to the East. Some additional easements are to be
added and some engineering problems worked out. There was a discussion
of whether De Soto would be paved or not and on the rezoning and
highway access road. The Subdivision Committee recommends approval
subject to working out engineering problems.
The next item on the agenda was the proposed Final Plat of Phase II
Development and a Replat of Final Plat of Phase I, Country Club COUNTRY CLUB ESTATES
Estates, Roy Clinton recommended that this matter be deferred
as Paul Mattke indicates an easement or two might have been omitted.
He also recommended consulting the City Attorney on another matter.

The next item on the agenda was a letter written by Mr. E. M. Adamson
concerning location of mobile homes on lots outside mobile home parks.
Mr. Lieberenz gave a history. He said mobile homes are not permitted
outside mobile home parks. Yr. Adamson owns a cafe on Fifteenth E. M. ADAMSON
Street and had already parked a mobile home behind the cafe. The Letter
Planning Commission cannot resolve this problem today, but Mr. Adamson
had desired to bring the problem to the attention of the Commission.
The next item on the agenda was a petition filed opposing the
rezoning petition of Vernon E. Pittman and Catherine Pittman for VERNON E. PITTMAN
property located East and South of Old Wire Road and West of Colette Rezoning Petition
Avenue from R-1, Icor Density Residential District, to R-2, Medium
Density Residential District,
Mr. Donaubauer explained that no action had been taken on the Pittman
petition at the last meeting. Under the zoning ordinance, the Commission
has 45 days in which to act. He acknowledged the petition opposing
the rezoning. Dr. Gene Lynch said he thought the people would like
to know how they should best register their opposition.
Loris Stanton read a prepared statement to the Commission and audience.
He was then asked to summarize what is planned. He said he has an
option to purchase the property and plans to build the apartments.
He chose this area because manly people who want apartments do not
wish to live in an area with students.
Bryce Davis said the rendering of the project is too vague as yet.
People are concerned about this.
Phillip Taylor, 1409 Oak Manor Drive, said an expert planner had
laid out this area as R-1. He said he could see Butterfield School
doubling in capacity. Also traffic would increase on Old Wire Road,
Gene Lynch, 2766 Elizabeth, said the petitioner had requested a
change in zoning so he could get a higher price for his land.
Mr. Stanton said the price for the land was set before the zoning
request was made. Mr. Lynch said in effect then Mr. Stanton is
requesting the zoning.
Jack Cole, corner of Oakcliff and Loxley, said that Rolling Hills
Drive is already a race tract and children have to walk down it to
get to school. The nearest access to the proposed rezoning is down
Rolling Hills Drive and Old Missouri Road. This would greatly
increase traffic. He had moved from Tulsa to get away from this
type of developing. He did not think they should ruin an area
where children can play.
Dotty Colling, 2800 Loxley, said that with the Fair Housing Law
how could they keep students out of these apartments. They are
already paying $140 to $150 for other apartments. People living
in apartments do not feel it is their responsibility to keep it up.
James H. White, 2770 Elizabeth, said they had hoped the Commission
would protect their investment in the R-1 District. He thought the
whole question would start spot zoning.

Mrs. Robbin Anderson said she was an interested third party. She
• asked how many units could be built on that property in R-1 and why
Mr. Stanton did not build under R-1 density. He said it is much
more costly to build duplex units.
W. M. Hutchison, Old Wire Road North, said he thought it would lower
property values.
Kathryn Fiser, 3.155 Rolling Hills Drive, said they had bought in
this area and wanted it kept as it is.
Mr. Stanton was the only person present to support the petition
for rezoning. There was a large show of hands opposing it.
Gene Lynch said he teaches real estate and what Mr. Staton has said
concerning trends is true. Half of the people today are priced out
of the single family housing market.
Dotty Colling, 2800 Loxley, said someone had told her there is to
be an apartment house on Old Missouri Road across from Butterfield
School. Mr. Lieberenz explained that Mr. Fitzgerald owns some
property on Old Missouri�Road, South of Rolling Hills Drive, which
was zoned for duplexes on the old map. It is now R-1 which will
permit duplexes.
Marilyn Schoppmeyer, 2950 Sheryl, asked if there are other R-2
areas running into areas like Rolling Hills.
Ernest Jacks explained to the audience that when the Planning
Commission adopted the zoning map, they felt there would have to
be some areas for multi -family housing. They made it a matter of
record that although these were zoned R-1, we would see the possibility
of multi -family housing in some areas and instances. It must depend
on schools, streets, etc.
Dr. Brown explained that rezoning petitions come to the Commission
for study, the Commission makes a recommendation, and the Board of
Directors makes the final decision.
Bryce Davis, Oak Manor, asked if a set of plans showing exactly what
is planned had to be filed with a rezoning request. No.
Mrs. A. C. Moldenhauer, 2700 Loxley, asked to whom the Board of
Directors is responsible.
Mr. Donaubauer invited the public back to see the presentation of
plans and pictures Mr. Stanton is preparing for a later meeting.
George Cook suggested that meeting be held in a larger room.
At the request of Robert Hursh, 1544 Oakcliff, the Commission members
were introduced.
The next matter before the Commission was an oral report from Larry
Wood of studies requested by the Commission.

He explained the general principles used in planning. Major streets
are located at mile intervals with schools at the center. Collectors LARRY WOOD
are at half section lines. The function of major streets is to take Special Report
traffic across town. Collector streets take traffic from minor
streets to major streets. This principle is difficult to apply in
Fayetteville.
He recommended Highway 45, Highway 265 as major streets. Old Wire
Road from Highway 45 to Township he recommended as a collector.
Township Road is not in as good a location for a major street, he
recommended Township Road as a collector at least. The best design
is to have no driveways backing out onto collector streets. He
recommended coming in East of Cummings -Goff Subdivision as close
as possible with another collector.
Roy Clinton said he felt Old Missouri Road would become a major street
due to the gas company's development.
Mr. Wood said this community is growing toward the center. He felt
the major streets with a combination of collectors can serve areas
if too many zoning changes are not made. He suggested coming in
South of the SWEPCO property and County property on an extension of
Township Road and go East with it. He had talked to SWEPCO and the
County Judge about it.
Regarding the study requested on the W. N. Murphey rezoning petition,
he suggested bringing Drake through as a collector and cutting South
of the commercial operation (Honda). He felt the Commission should
encourage some type of street there, even if it is not a dedicated
one.
Mr. Murphey said to put a public street through the center of a
mobile home park was the worst thing that could happen. It had
been tried before,
Mr. Wood said it might become necessary to start platting mobile
home parks like subdivisions to take case of this,
Mr. Murphey said he would dedicate a 40 ft. or 50 ft. East lest street
if they wished. Mr. Wood recommended Rolling Hills Drive revert back
to a collector street.
On the R-0 District studies, Mr. Wood recommended tying the C-2 down
to the C-3 along College Avenue. He recommended maintaining part of
the R-0 District, and converting a portion of the C-3 to R-0.
Al Donaubauer suggested a special orientation session for the Commission.
Action on the Cummings -Goff Subdivision plat was deferred.
Dr. Mashburnmoved that the Preliminaryof Bois . approved

Dr. Brown moved that the rezoning petition of W. N. Murphey and Mildred
S. Murphey be approved. Dr. Mashburn seconded. It was approved W. N. & MILDRED

The Commission returned to the Vernon Pittman rezoning, Dr. Brown
moved that action .. the petitionas requested by Mr. Stanton
seconded,provided he submit a statement in writing asking for a delay until VERNON Be PITTMAN
