HomeMy WebLinkAbout1971-01-05 MinutesMINUTES OF A PLANNING COMMISSION MEETING The Fayetteville Planning Commission met at 4:00 P.M., Tuesday, January 5, 1971, in the Directors Room, City Administration Building, Fayetteville, Arkansas, Members Present: Dr. James Mashburn, Albert Witte, Byron Boyd, Roy Clinton, Al Donaubauer, Ernest Jacks, Helen Edmiston, Members Absent: Clark McClinton, Dr. Walter Brown. Others Present: Vol Sharp, Carl Ferguson, Vernon Pittman, Larry Wood, Loris Stanton, Don Phillips, Charles Bickford, Coy Kaylor,.Don E. Oliver, Ed Papizan, Bruce Chambers, Gene Jordan, William Cook, Allen Dunn, Walter Reif, W. N. Murphey, Mrs,, Easterling, Don Spann, Harold Lieberenz, Wesley Howe, Gene Reece, Carl Arens, Benny Winborn, J. D. Neill, N. F. Totty, Norvel Whiteley. Al Donaubauer presided in the absence of Clark McClinton. The minutes of December 1, 1970, were approved as mailed. The next item before the Planning Commission was the rezoning petition of Vol W. Sharp and Hannah Ferguson Lee for property located East of Gregg Avenue and South of Elm Street from Rrl, Law Density Residential District, to R-2, Medium Density Residential District. Mr. Sharp and Mr. Carl Ferguson were present to represent the petition. VOL W. SHARP & They stated they hoped to build some rental units in the medium HANNAH FERGUSON IEE priced range, preferably triplex or fourplex, one-story, brick. Gregg Avenue They understood R4 would permit 24 units per acre, but they do not plan that many. There was no one else interested in the petition, so the public hearing was closed. The next item on the agenda was the rezoning petition of Vernon E. Pittman and Catherine Pittman for property located East and South VERNON E. PITTMAN of Old Wire Road and West of Colette Avenue from R-1, Low Density & CATHERINE PITTMAN Residential District, to R-2, Medium Density Residential District. Old Wire Road Vernon Pittman and Loris Stanton were present and said they plan to initially construct 48 units on 3 acres of the ten acre tract with a swimming pool, club room, and a variety of designs, Mr, Stanton said he has had requests for apartments in this area, Don Phillips, an adjoining property owner questioned whether the 48 units were all that was planned or would this be only one stage of development, also, questioned about utilities. Mr. Stanton said plans for sewer are being worked on. Some unidentified persons in the audience voiced their objections. is Other objectors present were: Charles Bickford, who feared a lowering of property values. Coy Kaylor, Don E. Oliver, Ed Papizan, 1-5-71 -2- Bruce Chambers, Gene Jordan, William Cook, Allen Dunn all voiced objections. Mr. Stanton explained that the developer would have to pay for the extension of the sewer lines to this area. He invited the area residents to participate in this and also in getting water service extended to the area. One gentleman had a few remarks to make about renteibs and land On request, harry Wood explained the basis for his recommendations as being he did not feel the R-2 would hurt the plan and that the streets can handle the traffic. He assumed the utilities would be there. The question was raised of adding to the school system 240 families in that area. Walter ReiVrobjected to the atmosphere of rental property. Ed Papizan asked why Mr. Stanton wanted apartments. He said studies predict that 90% of units constructed in the next 10 years will be either trailer parks or apartments. There is not enough housing financing money available to afford single family dwellings. Roy Clinton said he was reluctant to take 10 acre tracts and put in R-2. He feels if this goes through, it would be the duty of the Commission to see that it is kept to 16 units per acre rather than 24 units. Mr. Howe said other property owners probably would benefit from the extension of sewer to the area more than from extension of water in answer to a question from Dr. Mashburn. The next item on the agenda was the rezoning petition of W. N. Murphey and Mildred S. Murphey for property located West of U. S. Highway 71 North and on the South side of Appleby Road from A-1, Agricultural District, to R-2, Medium Density Residential District, Mr. Murphey was present and said he owns 28 acres with a mobile home park on one end. He wishes zoning that would permit him to expand it from time to time. Mrs. Easterling asked where the trailers would be extended to. She objected to any being near her house and being on septic tanks. He said they would all be put on the sewer as soon as the sewer is extended there. Dr. Mashburn and Ernest Jacks said they felt there was a need for a street or something for access somewhere in there. Mr. Murphey said he now has trailers on 5 acres on the West side. 17M�M11183W13,411 The next item before the Commission was a Large-scale development CHURCH OF JESUS plan for Fayetteville Branch, Oklahoma Mission, The Church of CHRIST OF LATTER DAY Jesus Christ of Latter Day Saints located East of U. S. SAINTS - Large Scale Highway 71 North and on the South side of Zion Road. Development 1-5-71 -3- Don Spann, Architect, represented the Church. He explained this was the first phase of a four phase project, This phase has 3,600 sq. ft. of floor space, Harold Lieberenz explained zoning regulations require screening along the East side of the parking, but there is a possibility they might move the parking 20 ft, to the West to eliminate need for screening, The electric company required a 10 ft. easement to protect their power lines. He also explained that the Major Street Plan calls for Zion Road to be widened to 60 ft, in the future or 30 ft, from the centerline. The Street Superintendent suggested 20 ft, radius on driveway entrances. None of these seemed to be a problem with the architect. The next item on the agenda was a letter from Mabel C. January, Ozark Floor Company, A Mr. Jack Curtsinger had requested permission to locate a janitorial service in their building at Cleburn and MABEL C. JANUARY College. This is not a permitted use in C-2. Mrs. January had .s Letter questioned the ordinance as she felt this would be a light operation with no visible outside evidence of the operation. Mr. Lieberenz explained the Planning Commission can do nothing on this at this meeting unless they choose to set a public hearing to amend the ordinance, The next item on the agenda was the Final Plat of proposed CUMMINGS=GOFF SUBD. Cummings -Goff Subdivision located on the North We of Highway 45 East. Mr. Lieberens explained that Mr. Mattke did not wish to sign the plat until some-minor=engineering":-pr_.oblems were solved. He suggested the plat be pulled from this meeting until this is satisfied. Helen Edmiston moved that action on this plat be delayed until the City Engineer is satisfied. Dr. Mashburn seconded. It was passed unanimously, No action was taken on the plat, The next item on the agenda was the large scale development plan for Jim Witt located on the East side of South School Avenue and JIM WITT South of unopened 11th Street. The developer has requested that Large Scale De this matter be tabled due to his health. Dr. Mashburn moved the plan be tabled as requested. Byron Boyd seconded; it was approved unanimously. The next item on the agenda was a proposed ordinance regulating curb• cuts or construction of sidewalks, drives, curbs, or guttering. Ernest Jacks reported he was the Chairman of a committee assigned CURB CUT ORDINANCE to study this. He gave a brief report and explained that there was a provision to allow a variance by order of the Planning Commission in cases of hardship. His committee recommends approval. Regarding the study of R-0, Residential -Office District, on the official zoning map adopted June 29, 1970, the Commission asked Larry Wood to have some recommendations available for the next meeting. Dr. Mashburn moved that the Planning Commission recommend to the Board of Directors that the rezoning petition of Vol W. Sharp VOL W. SHARP & and Hannah Ferguson Lee be approved as recommended by the Staff HANNAH FERGUSON LEE Report as being in keeping with the Comprehensive Plan and its Gregg Avenue intent. Ernest Jacks seconded. It was approved unanimously. 1-5-71 The rezoning petition of Vernon E. Pittman and Catherine Pittman was discussed again. A room count was taken of opponents and VERNON E. PITTMAN proponents. Gene Reece and Carl Owens voiced their objections. & CATHERINE PITTMAN Roy Clinton had some comments. No motion was proposed at this Old Wire Road meeting and no action taken. The Commission discussed again the rezoning petition of W. N. Murphey and Mildred S. Murphey. Roy Clinton moved that the petition be approved along the lines of developing this area into mobile home usage. Dr. Mashburn said he thought the Planning Commission would be negligent if they did not secure street at this point. He would have to vote against the petition if they did not. It was discussed further. Roy Clinton withdrew his first motion and moved that no action be taken at this meeting and called for a study by Larry Wood as to the location and feasibility of North-South and East-West streets in this area between Johnson Road and Highway 71, between the By-pass and Township Road, Dr. Mashburn seconded. It was approved unanimously. The Commission returned to the large scale development plan for Fayetteville Branch, Oklahoma Mission, The Church of Jesus Christ of Latter -Day Saints.. This is also a use permissible on appeal to the Planning Commission in this zoning district. Ernest Jacks moved that the development plan and use be approved subject to working out problems that still exist. Dr. Mashburn seconded. It was approved unanimously. Roy Clinton moved that a public hearing be set up to consider putting janitorial services in C-2. Dr. Mashburn seconded. It was approved unanimo$sly. RESOLUTION PC 2-71 CHURCH OF JESUS CHRIST OF LATTER- DAY SAINTS. Zion Rd. JANITORIAL SERVICES IN C-2 ? Ernest Jacks moved that the Planning Commission recommend to the Board of Directors that the proposed llcurb-cut ordinance" under CURB -CUT ORDINANCE study be approved and adopted. Dr. Mashburn seconded. It was approved unanimously. RESOLUTION PC 3-71 Benny Winborn, J. D. Neil, N. F. Totty, and Norvel Whiteley asked the Planning Commission to consider under "Other Business" a^ solution to the Township Road problem. The Commission asked Larry Wood to prepare staff recommendations to assist them for the January 19, 1971 meeting. The Commission asked that henceforth rezoning petitions be scheduled for the first meetings in the month only. The meeting was adjourned at 6:00 P.M. B.
