The Fayetteville Planning Commission met at 4:00 P.M., Tuesday,
November 3, 1970, in the Directors Room, City Administration Building,
Fayetteville, Arkansas.
Members Present: Ernest Jacks, Helen Edmiston, Clark McClinton,
Byron Boyd, Albert Witte, Roy Clinton, Al Donaubauer.
Members Absent: Dr. James Mashburn, Dr. Walter Brown.
Others Present: Wesley Howe, Larry Wood, Eunice Rudolph, Harold
Lieberenz, Jug Wheeler.
Chairman Clark McClinton called the meeting to order.
The first item on the agenda was the informal plat to Replat Lot 17,
Block 1, Oakland Hills Addition. Mrs. Eunice Rudolph represented
herself. Roy Clinton reported the Subdivision Committee has checked
the plat. All factors have been met. The surrounding property INFORMAL PLAT TO
owners have been notified and the only requirements are: REPLAT LOT 17.1 BLOCK 11
OAKLAND HILLS ADDITION
1. Additional setbacks to conform with Major Street Plan,
2. 20 ft. radius as requested by Street Superintendent.
He stated the Subdivision Committee recommends approval. Helen
Edmiston moved that the Planning Commission approve the Informal
Plat, Byron Boyd seconded. It was approved unanimously.
The second item on the agenda was the proposed Final Plat of
Wheeler -Sawyer Addition. Mr. Jug Wheeler was present. Roy Clinton
reported the Subdivision Committee has reviewed the plat and WHEELER -SAWYER ADD,
recommends approval with the following additional easements: Final Plat
1. 10 ft.
between Lots
1 and 2,
Block 2, and Lots 4 and
5,
Block
1.
2. 5 ft. between Lots 5 and 6. Block 2, for future street
light.
3. Also, sewer line is right on easement on West side;
5 ft, additional easement is needed for total of 25 ft.
Roy Clinton moved that the Planning Commission approve the Final
Plat of Wheeler -Sawyer Addition; Mrs. Edmiston seconded. It was
approved unanimously.

The next item on the agenda was a discussion of the letter from Mike
McDowell of the Housing Authority concerning certification of the LETTER FROM MIKE
University of Arkansas Campus Plan by the Planning Commission. This McDOWELL, HOUSING
is necessary to obtain credit for University expenditures on the AUTHORITY (U. of A.
current Urban Renewal application. A public hearing has been set Campus Plan)
for November 17 on this matter.

Mr. McClinton appointed a committee to study the proposed curb -cut
ordinance as follows: Ernest Jacks, Helen Edmiston, Byron Boyd,
Dr. James Mashburn, and Harold Lieberenz.
Under other business, Harold Lieberenz explained to the Planning
Commission that he has been faced with a number of requests to place
mobile homes on individual lots or property outside mobile home parks.
He had asked one person to write a letter to the Planning Commission.
Mr. Lieberenz explained that due to the definition of single-family
dwelling in the zoning ordinance, he has interpreted this as excluding
mobile homes outside mobile home parks. He gave a history of past
experiences along this line. The term "prefabricated" structure
was discussed. Mr. Lieberenz felt there might be two ways to have
mobile home units meet the building code: (1) Have people to make
units have them inspected and certify that they meet the building
code, or (2) Get the Southern Standard Building Code Committee to
label them as meeting the code.
Wesley Howe suggested the Staff Consultant, Larry Wood, study the
regulations pertaining to mobile homes, both in and out of mobile
home parks, and make some recommendations. Mr. McClinton cautioned
Mr. Wood to try to carry out the intent of the Planning Commission
when they worked on these regulations. Mr. Wood expressed concern
about people trying to sell lots in a mobile home park.
Al Donaubauer stated the news of the public hearing on the University
Campus Plan came as a surprise to certain people at the University.
He recommended asking Dr. Mullins or another appropriate official to
attend the hearing. He also recommended explaining the situation
directly to Dr. Mullins,
CURB -CUT ORDINANCE
Mr. Jacks noted that on the October 20 minutes Gene Billingsley should
have been spelled Gene Billingslea. The October 20 minutes were approved
as mailed with correction as noted
The meeting was adjourned at 5:30 P.M.

• WHEREAS, a public hearing was held by the Planning Commission, Tuesday,
October 20, 1970, fifteen (15) days after a sign was erected upon the
property and after a notice was published in the Northwest Arkansas Times,
a newspaper of general circulation; and
WHEREAS, after the hearing the Planning Commission voted to make a
recommendation to the Board of Directors on the rezoning petition of
Mrs. Clay Yoe.
NOW,
THEREFORE, BE
IT RECOMMENDED BY THE CITY
PLANNING COMMISSION TO
THE BOARD
OF DIRECTORS
OF THE CITY OF FAYETTEVILLE,
ARKANSAS,
SECTION 1. That an ordinance be adopted for the purpose of rezoning
from C-2, Thoroughfare Commercial District, to R-2, Medium Density Residential
District, said real estate:
LEGAL DESCRIPTION:
The point of beginning is South 0126' West 1039.47 feet from the
Northeast Corner of the Southwest Quarter of the Southwest Quarter
of Section 1, Township 16 North, Range 30 West in Washington County,
Arkansas along the East line of said Southwest Quarter of the Southwest
Quarter; thence North 89°50' West 1260.70 feet to the East Right-of-
way of Arkansas State Highway 265; thence South 0009' West 276.50
feet along said Highway Right-of-way; thence South 89050'East 1260.70
• feet; thence North 0026' East 276.50 feet to the point of beginning,
containing 8.0 acres, more or less.
SECTION 2. That the above-described property be rezoned from C-2,
Thoroughfare Commercial District, to R-2, Medium Density Residential District,
so that the petitioner may erect garden -style apartments.

RESOLUTION PC 20-70
WHEREAS, at its regular meeting on Tuesday, November 3, 1970, the Planning
Commission voted.to make a recommendation to the Board of Directors on the
final subdivision plat known as Wheeler -Sawyer Addition submitted by Wheeler
Motor Company, and
WHEREAS, the Planning Commission recommended that because the necessary
improvements have not been installed in said subdivision that Wheeler Motor
Company enter into and furnish the City with the necessary subdivision
contract before the Board of Directors accepts this final subdivision plat.
NOMI, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO
THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. The necessary subdivision contract be executed with the
City prior to the Board of Directors accepting the final subdivision plat.
SECTION 2. That the City of Fayetteville, Arkansas, accept the final
plat along with the land dedicated for streets and other public uses in the
Wheeler -Sawyer Addition subdivision described as follows:
A part of the West One-half of the West One-half of the Northeast
Quarter of the Southwest Quarter of Section 2, Township 16 North,
Range 30 West of the Fifth Principal Meridian, Fayetteville,
Arkansas. Being more particularly described as follows: Beginning
at the Northwest Corner of the Northeast Quarter of the Southwest
Quarter of said Section 2, thence S 0° 32' W, 1150.0 feet; thence
S 89° 49' E, 50.0 feet; thence S 00 321 W, 150.0 feet; thence
N 630 301 E, 157.5 feet; thence N 00 321 E, 35.0 feet; thence
N 56° 17' E. 169.01 feet; thence N 00 321 E, 1100.0 feet; thence
N 890 49' W, 330.0 feet to the point of beginning containing 9.07
acres more or less.
