MINUTES OF A PLANNING COMMISSION MEETING
The Fayetteville Planning Commission met at 3:30 P.M., Wednesday,
September 2, 1970, in the Directors Room of the City Administration
Building, Fayetteville, Arkansas.
Members Present: Dr. Walter Brown, Helen Edmiston, Clark McClinton,
Ernest Jacks, Al Donaubauer.
Members Absent: Roy Clinton, Byron Boyd, Morton Gitelman.
Others Present: N. H. Sines, Mr. Westbrook, Tom Campbell, Wesley
Howe, Harold Lieberenz, Mr. Sanders the Administrator
at City Hospital.
Chairman Clark McClinton called the meeting to order and announced
that this was an adjourned meeting of the regular September 1 meeting.
The first item considered today was Item 2 on the agenda—a review
of the expansion plans for City Hospital and Geriatric Center,
221 South School Avenue. Mr. Sanders, the Administrator, represented
the proposed plans. It is necessary for the Planning Commission
to review these plans as the total area is more than one acre.
Mr. Sanders explained that eventually it will be necessary to
tear out the old original building. This plan is drawn with that
in mind. At this time, they wish to tear off the porch and
columns. The one May drive off School Avenue is needed to pro—
vide a ground level unloading sone for therapy pool patients.
There is not room to place the addition on the rear.

1. Building too close to streets. Canopy comes within
7 feet of School Avenue. Ordinance says building
must be back 30 feet.from street ROW; if parking
between, it must be back 50 feet. On the South side
the canopy would be 19 feet from South Street ROW.
2. He has been requiring people to set back extra to
allow for street widening to comply with Major Street
Plan, School Avenue is 40 feet wide; proposed 60
feet wide.
3. Ordinance calls for 1 parking space per bed. How many
does the Hospital have?
Mr. Donaubauer suggested the canopy on the front be shortened to
cover only the half of a car on the passenger side. It was also
suggested that the walk be kept as close to the recessed part of
the building as possible with the drive against the walk.
• Mr. Sanders said the Hospital would not receive anyone except
visitors and therapy out patients through the front entrance.
Parking will not be'permitted in this drive.

Ernest Jacks moved that the expansion be approved with the following
conditions:
1. Harold Lieberena check into parking facilities.
2. A variance in setbacks be sought from the Board of
Adjustment for the South and East sides. The Planning
Commission recommends that these variances be granted.
3. That there be left a provision of 5 feet for future street ROW.
4. That the drive and canopy be held as close to the building
as possible.

approval of change from one non -conforming use to another non -conforming
use for property located on the East side of Highway 71 South and
South of Whillock Street. (as provided in Ord. 1747, Art. 4,5,0).)

A statement from James Freeman says the non -conforming business
(upholstery shop) has existed within the past 6 months. Mr.
Westbrook represented the request. He stated he and Mr. Blevins
wanted to put in a nice produce market. The property is
zoned R-1. They had been unaware of the zoning and zoning
regulations. They were working on a temporary access drive to
be used until the Highway is widened some. They would like two
drives --in and out—and eventually hope to blacktop it and
have a planter or something between drives. They would like a
canopy on the front of the building to cover an outside fruit
display.

Mr. Lieberenz stated a non -conforming building cannot be structurally
altered under the existing zoning ordinance. This problem of change
of occupancy of a non -conforming structure would have been handled
by the Building Inspector and City Attorney under Ord. 1239; but
responsibility has been passed to the Planning Commission under
Ord. 1747,
Dr. Brown moved that the Planning Commission authorise the change
from one non -conforming use (upholstery shop) to another (produce
market). Mr. Westbrook must work out any remodeling problems with
Mr. Lieberenz. Mrs. Edmiston seconded the motion. It was
approved unanimously.

Dr. Brown moved that the Planning Commission authorize the Church

the motion. It was approved unanimously.

Mr. Lieberenz showed the Planning Commission the final copy, of a LAZENBY'S 3rd ADDITION
proposed Informal Plat for Lazenby's Third Addition. Mr. Donaubauer
moved it be approved as a Final Informal Plat. Mrs. Edmiston
seconded. It was approved unanimously.
The minutes of the August 18, 1970 Planning Commission Meeting wer:

Helen Edmiston was appointed to serve on the Subdivision Committee
i with Roy Clinton and Ernest Jacks,
Item 9, a list of corrections to the official zoning district map
to be initiated by the Planning Commission, was postponed until
September 15•
The meeting was adjourned at 5:45 P.M.

BE IT RESOLVED, that the Planning Commission request the City Manager
and the Planning Consultant to collect information as to how other cities
have met the problem of regulating billboards and signs, draw up a provisional
amendment to our Ordinance No. 1747, and submit it for the consideration of
the Planning Commission,
