HomeMy WebLinkAbout1970-07-28 MinutesMINUTES OF A PLANNING COMMISSION MEETING The Fayetteville Planning Commission met at 4:00 P.M., Tuesday, July 28, 1970, in the Directors Room of the City Administration Building, Fayetteville, Arkansas. Members Present: Ernest Jacks, Helen Edmiston, Roy Clinton, Al Donaubauer, Morton Gitelman. Members Absent: Clark McClinton, Dr._ Walter Brown, Byron Boyd, Dr. James Mashburn, Others Present: Mr. Bryce Davis, Mr. & Mrs. T. E. Duncan, Harold Lieberenz, Wesley Howe. In the absence of a chairman and vice-chairman, Ernest Jacks being the oldest appointive member present served as chairman. The first item on the agenda was a review of the expansion plans UNIVERSITY BAPTIST of University Baptist Church, 315 West Maple Street. The Church CHURCH Expansion is located in the R-3, High Density Residential District. Churches are permissible on appeal to the Planning Commission in this district under Use Unit 4. Bryce Davis represented the appeal. He explained that although the present building is approximately 7 feet from the East property • line, the addition would be about 20 to 22 feet from the East property line. The Planning Commission asked to see a plot plan showing the location of the present building and how the addition would be located. Mr, and Mrs. T. E. Duncan own the property on the East. They explained that they had objected to the present building being constructed so close to the property line in the beginning. They stated that they would like to see the addition made as they hoped this would stop the cars from coming out on the back side during the night and stop the noise from the "rock and roll" music in the late night and early morning hours. Mr. Davis promised the Duncans that this matter would be brought to the attention of the deacons since this was not church sponsored activity. The original building permit plans were found showing a plot plan. Mr. Davis illustrated how and where the addition would be. Roy Clinton asked how high the building would be. Mr. Gitelman said he thought the Planning Commission could vary the setback only if this was reviewed as a planned development or a large- scale development. Mr. Lieberenz said in checking the ordinance the Planning Commission has a lot of authority spelled out. They can vary a lot of things on the planned developments, but it is not as lenient on the large scale: The ordinance does not require that a public hearing be held on these, but we notified the adjoining property owners as we feel they should know something is being considered. 7-28-70 -2- • Mr. Gitelman thought the variance would have to be granted by the Board of Adjustment unless it was considered as a large scale development or a planned development. Roy Clinton felt the Board of Adjustment should be the one to vary the setback as the use is existing. Mr. Jacks suggested that the Commission review the expansion as a large scale development. Mr. Lieberenz suggested that in the future the Office of City Planning prepare some information on these before forwarding to the Commission. Roy Clinton moved that the Planning Commission allow the University Baptist Church to proceed with the addition to the church sanctuary as shown on the plans submitted. Helen Edmiston seconded the motion and it was approved unanimously. Roy Clinton moved that the rezoning petition of Red Arrow No. 3 be taken off table and put on the agenda for August 4. Al RED ARROW NO. 3 Donaubauer seconded. It was approved unanimously. A summary of rezoning petitions which have been tabled was reviewed by the Planning Commission. Helen Edmiston has three petitions on table. She stated none of hers would need to be Tabled Petitions reopened. C. T. Pearson, Jr. and Lushbaugh and Cole have not contacted the Office of City Planning regarding what they wish to have done. The Commission will not reopen the cases unless requested to do so by the petitioner. The Commission reviewed the time table for rezoning petitions on table with respect to Humble Oil and Refining Compatyfs petition. The next Planning Commission meeting after the highway design hearings on August 20 will be September 1. This would exceed the 45 day limit a hearing can be left on table without agreement of the petitioner. The Planning Administrator was instructed to check with the attorney for the petitioner about leaving the case on table until September 1. If they do not agree put it on the agenda for August 4. It was decided to wait until more members were present to elect a vice-chairman. The minutes of July 2 and July 7 were approved with one correction. R. C. Andersons name in the July 7 minutes should be changed to Mrs. R. C. Anderson. The meeting was adjourned at 5:10 P.M. 0
