The Fayetteville Planning Commission met at 4:00 P.M., Tuesday,
July 7, 1970, in the Directors Room of the City Administration
Building, Fayetteville, Arkansas,
Members Present: Byron Boyd, Dr. Walter Brown, Clark McClinton,
Helen Edmiston, Ernest Jacks,
Members Absent: Dr. James Mashburn, Roy Clinton, Al Donaubauer,
Morton Gitelman.
Others Present: Harvey Smith, Charles W. Atkinson, Jim Tidwell,
Jim Brock, Evangiline Archer, R. C. Anderson,
Joe Clark, Jeff Shearer, Lois.Imhoff, Don Wegand,
Mrs. George H.
The Chairman called the meeting to order.
The first item on the agenda was the rezoning petition of Humble
Oil and Refining Company for property located on the East side HUMBLE OIL & REFINING CO
of Highway 71 North and North of Stearns Street immediately North
of Ozark Windows, Inc. Charles W. Atkinson, Attorney, represented
the application. He stated the applicant desires to build a
modern filling station at this location. Mr. McClinton reminded
Mr. Atkinson that the applicant would be required to construct a
50 ft. service road across the highway frontage. This would
decrease the usable area of the property.
There were no further questions and no opposition present, so the
public hearing was closed.
The second item on the agenda was Spring Brook Mobile Home
Park request for tentative approval as to location and basic
layout. Mr. Lieberenz read a memo from Paul Mattke, City SPRING BROOK MOBILE HOME
Engineer, stating he could not approve the plans as they were COMMUNITY
not completed in full to the requirements of Ordinance No. 1509.
However, he stated he had no objection to the proposed location
from the engineering point of view; and could recommend approval
in principle subject to staisfactory completion and sutmittal of
complete engineering plans and specifications. He did also
recommend that the Planning Commission should retain sufficient
easement for an access road to parallel Highway 71 By-pass.
There was considerable discussion between the Planning Commission
members and Mr. Smith about a service road. The minutes of
May 19, 1970 were discussed as related to Al Donaubauer's motion,
"that the Planning Commission not require Mr. Smith to build a
bridge and access road over the 6 -acre tract he wishes to develop
and that the Commission defer making a recommendation for the
development of the balance of the tract until such time as Mr.
Smith comes in with a plan for the development of that region,
and that the Planning Commission require dedication of a right of
way across the East portion of Mr. Smith's property at this time
with the ultimate view of eliminating the access point onto
Highway 71 By-pass." Several of the members of the Commission
felt the word "this" should have read "that" as they felt it was
not the intention of Mr. Donaubauer to require dedication of

right of way on the East portion at the time the West portion was
developed. Mr. Smith stated he would gladly dedicate the right
of way if the Commission would just tell him where they wanted the
road located.
The next item on the agenda was a conference with Donrey Outdoor DONKEY OUTDOOR ADV.
Advertising concerning the setbacks required for billboards under (Billboard Setbacks)
the new zoning ordinance. Jim Tidwell and Jim Brock represented
Donrey and stated that the 50 ft. setback in the new C-2, Thorough- -
fare Commercial would require that all their billboards be relocated
at a cost of about $400.00 per sign for a total of 80 signs. The
gentlemen showed signs of their existing billboards and read letters
from a number of their advertisers. Mr. Tidwell also asked why
billboards would not be permitted in the C-11 C-3, and A-1 zoning
districts. Most of Highway 71 By-pass will be in A-1.
Mr. McClinton asked those in the audience who wished to voice
their opinions to do do.
Joe Clark said billboards are a distraction to him when driving and
he considers them all unsightly,
Jeff Shearer is an architectural student. He thinks the residents
need to be concerned about clearing up the appearance of the City.
He favors keeping the ordinance as passed,
Lois Imhoff with Fayetteville Garden Club complimented the Commission
on the new ordinance and urged them to study carefully before making
any change.
Mrs. George H. Holcomb with the Year Round Garden Club but speaking
as an individual stated her support of the Planning Commission and
definite regulations.
Joe Clark said there is a silent majority in Fayetteville against
billboards and if any change is considered the people should be
yam, allowed to vote on it.

Mrs. Jack Burge, Fayetteville Council of Garden Clubs, asked how
much farther the signs would have to be moved. She was told the
signs range from just off the right of way to 25 ft. off the right
of way.
Don Wegand with Donrey said they had supported Lady Bird Johnson's
bill on billboards. He admitted there should be some regulations,
but asked to be recognized as a legitimate business.
Mrs. Rogers agreed with Mr. Clark that there is a vast silent majority.
The next item of business was approval by the Planning Commission CHAMBER OF COMMERCE
for off-site parking by the Chamber of Commerce utilizing the City Off -Site Parking
parking lot. Under the new ordinance if on-site, off-street parking
is not available, but public parking facilities are within 300 feet
of the front door of the building, the Planning Commission must
approve issuance of a building permit. The Chamber plans to
remodel the building West of the City Administration Building to
use for office space.
Ernest Jacks moved that the Planning Commission approve the City
owned parking lot as off-site parking for the Chamber of Commerce
as set out in Article 8, Section 9, a (1) of the new zoning ordinance.
Dr. Brown seconded the motion. It was approved unanimously.
The minutes of .the June '16,.Jun6 22, and June 29, 1970 Planning-
Coammission-Meetings were approved as mailed.
The Commission returned to the petition of Humble 011 & Refining H
Company for rezoning of property on Highway 71 North, Dr. Brown
moved that the petition be denied as in his opinion the master plan
for that area calls for that to be developed residentially. Also,
there is involved a service road -to be developed along Highway 71
at this point.
The motion died for lack of a second.
Mr. McClinton expressed his concern about adequate depth for the
property not knowing what the requirements of the Arkansas Highway
Department for making Highway 71 a four -lane road at this point.
They could require another 35 feet. A service road would require
50 feet. This could leave only 115 feet of depth in the parcel.
Dr. Brown moved to table this petition before making arW change and
make a study of the area on East side of Highway from Millsap Road
to North City Limits. Mr. McClinton said the Highway Department
has hearings set concerning this area. Helen Edmiston seconded;
the motion passed unanimously, and the petition was tabled.
Mr. Atkinson asked whether a proposed plot use plan would be of
any use to the Commission. Mr. McClinton said he did not think
the Planning Commission should act on this until they know what
the plans of the Highway Department are in this area. He did not
feel the Commission should put the Highway Department in the position
of having to pay commercial prices for newly zoned property.

Regarding the Spring Brook Mobile Home Community plans, Dr. Brown
moved to approve the lay out as submitted subject to completion
of water and sewer plans being drawn to the satisfaction of the
City Engineer. Byron Boyd seconded. The motion was approved unanimously,
The plat book in the Planning Office and Building Inspector's Office
is to be marked preventing issuance of additional permits until a road is dedicated.
Ernest Jacks stated that this makes two cases in which the highway
access ordinance has been circumvented. He felt that an access road
should have been dedicated. Mr. Smith said that there is actually
only one place where a 50 ft, road could be put in due to a drainage
problem. Mr. Boyd said that this particular piece of property has
a geographical boundary separating it from the other portion of
Mr. Smith's property.
Dr. Brown moved that the Commission recommend to the Board of
Directors that we adhere to the setbacks for billboards under
Zoning Ordinance No. 1747, Helen Edmiston seconded.
Ernest Jacks asked that before action was taken on Dr. Brown's
motion, the matter be referred to Larry Wood, Northwest Arkansas
Regional Planning Commission and to Morton Gitelman especially
about additional requirements. Mr. McClinton felt there should
be something to regulate spacing and some thought should be
given to allowing billboards in A-1. He did feel they should be
set back to conform to other building lines. He would like to
consult with Larry Wood, Morton Gitelman, and Jim Vizzier.
Ernest Jacks moved that Dr. Brown's motion be tabled for further
study with Gitelman, Wood, and Vizzier. Byron Boyd seconded.
It was approved unanimously. Dr. Brown's motion was tabled.
