HomeMy WebLinkAbout1970-05-05 MinutesMINUTES OF A PLANNING COMMISSION MEETING may/ /9, 1970 The Fayetteville Planning Commission met at 3:50 P.M., Tuesday, May 53 , 1970, in the Directors Room of the City Administration Building, Fayetteville, 18 Arkansas. Members Present: Clark McClinton, Dr. Walter Brown, Allan Gilbert, Morton Gitelman, ^A1" Donaubauer, Dr. James Mashburn, Roy Clinton. Members Absent: Byron Boyd, Ernest Jacks, Others Present: Larry Wood, Harold Lieberens, Wesley Howe, James Vizzier, J. W. Eoff, Marie Eoff, Johnie Bassett, Richard Wommack, N. H. Sines. Chairman Clark McClinton called the meeting to order. The first item on the agenda was U Marie Eoff, and Johnie Bassett for 71 North and South of Millsap Road, e rezoning petition of J. W. Eoff, property located East of Highway Mr. & Mrs. Eoff own a portion of this property and have a purchase option on the remainder. Both properties are zoned C-2, Thoroughfare Commercial, to a depth of 300 feet off Highway 71 North. The Eoffa desire to extend the C-2 zoning back to the property line on the East. Mr. Eoff presented a preliminary drawing illustrating their proposed use of the property as a furniture store. Richard Womack, Attorney, represented Roger Alexander the property owner adjoining on the East. He noted that the comtemplated use of the property is contingent upon the option to purchase the Bassett property being exercised. He questioned what the use would be if the option were not exercised. His client's home is immediately adjacent to the property. Mr. Eoff said the full amount of property was needed in order to provide the necessary parking. He plans a 20 foot driveway across the rear of the property with screening on the East. Mr. Donaubauer asked if it would be possible to widen the driveway. The public hearing was closed. The next item on the agenda was the rezoning petition of Mrs. A. J. Head for property located South of Old Farmington Road, North of Highway 62 West, and East of Highway 71 By -Pass. N. H. Sines represented the application and stated that he desires to purchase the property and move his body shop business there. He is asking for C-2, Thoroughfare Commercial, zoning. His business would face the Old Farmington Road. Root Avenue is dedicated along the East side of the property but is not open. The Arkansas State Highway Department took all the remainder of the property except this tract. Dr. Brown asked what street carried the traffic to Ramay Junior High School. Old Farmington Road does. There was a discussion concerning an access road alongside Highway 71 By-pass. J.W. & MARIE EOFF & JOHNIE BASSETT MRS. A. J. HEAD 5-5-70 -z- The public hearing was closed. Mr. McClinton informed the Planning Commission members that they were each invited to the ground -breaking ceremony for the Housing Authority's hi -rise apartment building at the old Hillcrest School site. The ground breaking is to be at 11:30 A.M., Monday, May 11, and the membere are also invited to attend a lunche6n afterwards as guests of the Housing Authority. Dr. Mashburn arrived at 4:30 P.M. The Commission returned to the J. W. Eoff, Marie Eoff, Johnie Bassett petition. Mr. McClinton asked whether the applicant would be willing J.W. El MARIE to comply with the proposed ordinance in developing the tract, were it & JOHNIE BAS to be approved at this time. Morton Gitelman gave a run down on the requirements of the proposed ordinance and explained that the Commission is concerned because a couple of shopping centers have promised to take care of traffic patterns and landscaping in the past, but have failed to do so. Allan Gilbert moved that the Planning Commission approve the Eoff- Bassett petition; Al Donaubauer seconded. Jim Vissier said he and Harold Lieberens met and discussed Mr. Lieberens's "Comments on the Proposed Zoning Regulations" dated'March 11, 1970. He then summarised their decisions, as follows: Item 6: Salvation Army put in a couple of other units. Items 81 91 10: Suggested that accessory uses be clarified to take care of single-family dwellings for caretakers in warehouse, manufacture, and industry areas. Item 31: Set up performance standards on home occupations and add something on parking and other things. Item 14: Discussed allowing accessory building on back of lot for parents. This could be done if sufficient frontage and building area are present. MRS. A. J. HEAD ••1.1.T � 1• � Item 15: On Page 63, leave "A", mark out "B^, and insert: "Any deviation of bulk and area regulations on less than one acre would require approval of the Board of Adjustment." Item 18: Change "original" to "copy" and add the recommendation on Page 76. 5 -5 -7- -3 - Item 19: In Article 2, paragraphs 7 and 8, change Hoard of Adjustment to Planning Administrator. It will not be necessary to add this recommendation then. (Page 3) Item 21: Mr. Vizzier and Mr. Gitelman felt the words "is the minimum variance that. " should not be deleted. At an earlier meeting the Planning Commission had not signified any objection to the deletion, Item 22: At an earlier meeting, it was decided not to make this recommended deletion. Roy Clinton arrived at 5:15 P.K. Item 24: The Commission talked about requiring full lot area, but waiving street frontage requirement to enable persons to locate their elderly parents on the back of their lot. It was noted that after the death of the parents, the building exists and is usually rented. It was decided to leave the regulations as they are. Item 23: Salvage yards, service stations, and used car lots were discussed, but no changes made, Item 25: Pot chickens, ducks, ponies, ate. should be handled through 10 some other ordinance. Item 26: Suggested two changes: On"improvements existing 1. on Page 7 IVPage 9 underparagraphsimprovementof existing nonconforming Item 27: Clarify accessory uses to take care of this. Under definitions, add a definition of a townhouse which is a rowhouse with common walls with another rowhouse. The yard requirements for side yards will have to be changed to allow for it. Drop "mobile home" from prefabricated residential units permitted outside mobile home parks on Page 58. Jim Vizzier is to edit the proposed ordinance and recopy with corrections. Then, the Planning Commission is to re -check it. Mr. Usberens explained that Red Arrow No. 3 wants their rezoning case re -opened. As the zoning request has been changed, the Commission asked that the petitioner re -submit by letter. The meeting was adjourned at 6:00 P.M.
