HomeMy WebLinkAbout1970-04-07 MinutesMINUTES OF A PLANNING COMMISSION MEETING The Fayetteville Planning Commission met at 4:15 P.M., Tuesday, April 7, 1970, in the Directors Room of the City Administration Building, Fayetteville, Arkansas. Members Present: Clark McClinton, Dr. Walter Brown, "A1" Donaubauer, Morton Gitelman, Roy Clinton, Ernest Jacks, Members Absent: Allan Gilbert, Dr. James Mashburn, Byron Boyd. Others Present: Harold Lieberenz, Wesley Howe, Jim Vizzier, J. E. McClelland, several unidentified persons. Chairman Clark McClinton called the meeting to order. The Commission considered Item 4 on the Agenda first which was a letter from Thomas Burke requesting that the Lushbaugh-Cole rezoning petition be brought off table and considered at the April 21 Planning Commission meeting. Morton Gitelman moved to take the petition off table and to consider it April 21. There was no second to the motion; therefore it died. One of the Commission members suggested that if any additional studies needed to be made by the staff, that it should be done. Mr. Donaubauer stated he would like to withdraw his second to the motion made by Dr. James Mashburn at the previous meeting that in those cases where the proposed map changed the zoning on property that had been rezoned by the Commission within the past 2 years, if the proposed change was not in agreement with what the property owner desired, that we leave it as we had zoned it in the past 2 years, so that we would not work a hardship on these people, /97o LUSHBAUGH-COLE letter Ernest Jacks reported that he had studied the number of units permitted in the present R-3 and R-4 as compared to what will be permitted under the proposed R-2 and R-3. He had used Jerry Sweetser!s tract as a basis for his study. The present R-3 permits 132 units; the present R-4 permits 136 apartment units. The proposed R-2 would allow 77 units; the proposed R-3 would allow 129 units. Harold Lieberenz studied the number of units permitted on the Skull Creek property. A good deal more units are allowed in the present R-3 than would be permitted in the proposed R-2. The proposed R-3 and present R-3 will allow approximately the same densities. Morton Gitelman remarked that the Commission had been under a wrong assumption. The old R-4 allows dormitories, sororities, and mobile homes not permitted in the other districts, but very little more density. The proposed R-2 and R-3 were discussed and the areas suited for them. Dr. Brown stated he felt the area between the railroad tracks and Gregg 1.0 Avenue (around North Street) would be a good buffer between the densities. LL -7-70 .2. Chairman McClinton observed that the property had been rezoned to R-3 and admitted that perhaps the Planning Commission had made a mistake in doing so; but thought the Commission should stay with their decision. It was noted that there seemed to be a reluctance to go to a blanket policy on these matters. Roy Clinton moved that the property Tom Comley purchased from Hoyt Greenwood (Ordinance No. 1650) be shown on the proposed zoning map as R-3; Morton Gitelman seconded the motion. It was approved unanimously. Roy Clinton moved that the Leo Peel property (Ordinance No. 1659) be shown on the proposed map as R-2; Morton Gitelman seconded the motion. It was approved unanimously. Ordinance 1650 Ordinance 1659 Roy Clinton moved that the property Tom Comley purchased from William Voss (Ordinance No. 1689) be shown on the proposed map as R-3. Ordinance 1689 Morton Gitelman seconded the motion and it was approved unanimously. Roy Clinton moved that the Jerry Sweetser property at North and Gregg (Ordinance No. 1690) be reflected as R-3 on the proposed map. Morton Ordinance 1690 Gitelman seconded. McClinton, Donaubauer, Gitelman, Clinton, and Jacks voted "Aye." Dr: Brown voted "Nay." The motion passed. Roy Clinton moved that Thomas Comley's property at Hazel and Storer (Ordinance No. 1696) be shown on the proposed map as R-3. Morton Gitelman seconded. Dr. Brown voted "Nay." McClinton, Jacks, Ordinance 1696 Donaubauer, Gitelman, and Clinton voted "Aye." The motion was approved. Roy Clinton moved that the Chateau, Inc. property at Leverett Street be reflected as R-3 on the proposed map. Ernest Jacks Ordinance 1700 seconded the motion. Dr. Brown voted "Nay." McClinton, Jacks, Donaubauer, Gitelman, and Clinton voted "Aye" to approve the motion. Roy Clinton moved that the Shepherd -Luttrell property on Oakland Avenue (Ordinance No. 1716) be shown as R-3 on the proposed map. Ordinance 1716 Ernest Jacks seconded the motion and it was approved unanimously. Roy Clinton moved that the Thomas Comley property at Holly and Storer (Ordinance No. 1717) be shown on the proposed map as R-3. Ordinance 1717 Ernest Jacks seconded the motion and it was approved unanimously. There was a discussion as to what zoning Bill Hawkins needs on his property on Highway 62 West between Dinsmore and Old Farmington Ordinance 1635 Road. He has requested C-2 for purposes of a garage. It was rezoned C-2 in 1968. This property is in close proximity to the STRATTOI43 BELL, Stratton (skating rink), Bell, Bartholomew, and Williams property. BARTHOLOMEW, & All have requested commercial zoning, so that they will cease to WILLIAMS be non -conforming. Ernest Jacks moved that the zoning bf the above properties be shoim on the proposed map in a group as C-2 to a maximum depth of 400 feet off Highway 62 West. He reported they have agreed to give right of way for a collector width street when the property is developed and do understand they will have to build the street themselves. Roy Clinton moved the zoning be proposed as C-2; Al Donaubauer seconded the motion. It was approved unanimously. Mr. McClelland asked about the property extending 150 to the West from the centerline of Walnut Street which is presently zoned R-2. It is proposed as R-1 on the map and will permit duplexes. The balance of the property lying Westward from a point 150 from the centerline of Walnut Street to North College Avenue is presently zoned C-2. Not all of this property is shown as C-2 on the proposed map. Mr. Vizaier stated this was an oversight, and he would get the legal description of this property and correct the map. Next the Commission discussed the Highway 71 By-pass access problem of Harold Johnson. Mr. McClinton read a memo from Larry Wood, Staff Consultant, to Mr. Wesley Howe. This was discussed. Jim Vizzier objected to Mr. Wood saying no use was projected for this area on the Land Use Map. Mr. Hoare asked why the Commission did not require Mr. Johnson to develop his tract all the way to the highway in residential use. He also asked if the present difficulties might indicate this development is premature. Mr. Gitelman favored drawing up a contract to require Mr. Johnson to build the service road at such time as the surrounding properties were developed and the road was needed. Roy Clinton left at 6:00 P.M. J. E. MC CIELLAND J. E. MC CLELLAND Mr. Gitelman said he thought they should tell Mr. Johnson that the Commission is willing to consider a proposed R-2 zoning subject to approval of a preliminary plat and certain other conditions. Mr. Johnson was unsure this would satisfy the FHA. Mr. Johnson was asked to have his engineer prepare and submit a preliminary subdivision plat. Al Donaubauer left at 6:10 P.M. The meeting was adjourned at 6:15 P.M. until Tuesday, April 14.
