HomeMy WebLinkAbout1970-03-03 MinutesMINUTES OF A PLANNING COMMISSION MEETING The Fayetteville Planning Commission met at 4:00 P.M., March 3, 1970, in the Directors Room of the City Administration Building, Fayetteville, Arkansas. Members Present: Morton Gitelman, Al Donaubauer, Dr. Walter Brown, Roy Clinton, Clark McClinton, Ernest Jacks, Allan Gilbert, Byron Boyd. Members Absent: Dr. James Mashburn. Others Present: Wesley Howe, James Vizzier, Harold Lieberenz, Tommy Haseloff, Maupin Cuamiirgs, Roy Ritter, Frank Waters, Harold Johnson, Donald Grimes, Helen Edmiston, Mrs. Pelosi, Mrs. Orton, Doyle Shelton, Chairman Clark McClinton called the meeting to order. He stated there were at least three persons who had been asked to attend this meeting and state their requests for zoning consideration on the proposed map. Tommy Haseloff was asked to explain his plans for his property along the East side of Highway 71 North, North of Clear Creek which the Planning Commission has considered recommending as A-1 on the proposed map. Mr. Haseloff stated he preferred C-2; he now has a golf driving range, fruit stand, and restaurant, but plans for further development are only tentative. He suggested the possibility of a service road along the property to eliminate two dangerous intersections. He hoped the State would build it. . Judge Maupin Cummings asked for consideration for three areas: The property rezoned to C-1 by Ordinance No. 1674. He asked it be permitted to remain C-1. Lots on the North side of Highway 62 between Lewis Street and Razorback Road which have been C-2 since 1960. Harold Johnson joined in requesting this remain C-2. Property on the North side of Cato Springs Road (Highway 265 South) between Ashwood and Vale Streets presently zoned C-1. He asked that they remain C-1. Roy Ritter spoke on behalf of his commercial property at Eagle and Leverett. The proposed map shows this zoned residential thereby making the use nonconforming. The restaurant is undergoing expansion at this time. Frank Waters, Attorney, also spoke. He emphasized this is not a drive-in; but a drive by and pick up. The entire area is covered with apartments. Ernest Jacks stated the minutes of the original rezoning stated that there would be no eating facilities on the premises. Mr. Waters said the plans as submitted called for seating of 26 persons. Harold Johnson said he desires to develop a low income housing development South and West of Red Arrow. Harold Lieberenz informed the Commission that a plot has been presented to the Planning Office complete with the legal description and will be put before the Planning Commission at its next meeting. Donald Grimes owns 9j acres in Block 7 of Valley View Acres which has been zoned I-1, Light Industrial, for the past seven years. Ozark News Agency is on a portion of the property. It is proposed as R-2; Mr. Grimes asked the Planning Commission to leave Block 7 as it is presently zoned. 3-3-70 .2. Byron Boyd arrived at 4:45 P.M. Helen Edmiston objected to zoning the triangle of property owned by Mr. Grimes differently from the zoning of the surrounding property. She would like to see it all residential. Mrs. Pelosi and Mrs. Orton of the League of Women Voters made the following recommendation to the Planning Commission: "We recommend that developers (including commercial and industrial developers) be required to file a subdivision plat and a site plan for review and approval and post a performance bond before the necessary building permits be issued." Very often commercial and industrial developers promise beautiful plans but don't finish the plans. This distracts from the appearance of the community. They not only do not put in any land- scaping; but some parking areas are hazardous with no access points pointed out, no traffic flow, etc. The League recommends that sub- dividers have to post a performance bond. There are no "teeth" in the current provisions. Doyle Shelton stated he wishes to purchase a portion of the Donald Grimes property if the zoning remains the same as it now is. Roy Clinton arrived at 5:00 P.M. The Planning Commission began their consideration of the requests for zoning on the proposed map. Dr. Walter Brown moved that the McGoodwin, Williams, and Yates property remain R-3 on the proposed map as it would serve as a buffer between the commercial property nearby and the low density residential. Mr. McClinton observed this would make it necessary for them to come before the Planning Commission again if they desired to expand. There was no second to Dr. Brown's motion and it died. Roy Clinton moved the zoning be changed to R-0 which is acceptable to the firm. Morton Gitelman seconded the motion. Gitelman, Donaubauer, McClinton, Jacks, Gilbert, Boyd, Clinton voted "Aye"; Dr. Brown voted "Nay." The motion carried. Mr. McClinton stated he favored having eating places in the R-0 District on approval of the Planning Commission. He asked the other members to give the matter some thought. Roy Clinton moved that the 2 lots zoned present R-2 by Ordinance No. 1600 for 0. U. Green be changed to the proposed R-2. Gilbert seconded the motion. There was some discussion about the number of houses in that area which are duplexes on small lots. It will be necessary to come in for a variance in order to improve them under the proposed ordinance and map. Donaubauer, McClinton, Jacks, Gilbert, Boyd, Clinton, and Dr. Brown voted "Aye." Gitelman voted "Nay." The motion carried. Morton Gitelman suggested Jerry Sweetser's commercial property (Ordinance No. 1585), Roy Ritter's commercial property (Ordinance No. 1627), and the commercial property of Skull Creek Development Company be considered together as they are all in the same general area. Dr. Brown moved they 3-3-70 -3- all remain R-3 as they are currently shown on the proposed zoning map. Mr. Gitelman seconded the motion. A discussion followed. Al Donaubauer expressed his dismay for the purchaser who buys property with one zoning which is later changed making his use nonconforming. Roy Clinton stated the commercial development is for the accomodation of students in walking distance. There will be additional commercial use requests in that area. He felt the Commission should give it strong consideration when it is for the students. He could not see any effect on land values in this area in view of the high rise apartments and commercial returns. Mr. McClinton stated he felt it would be a mistake to rezone this again. Morton Gitelman noted that Leverett Avenue cannot take commercial development and carry commercial traffic. Dr. Brown stated the present development had not been as the Commission expected and he considered it a mistake. Dr. Brown and Mr. Gitelman voted "Aye." Ernest Jacks abstained from voting. Donaubauer, McClinton, Gilbert, Boyd, and Clinton voted "Nay." to dery the motion. All three are to remain as they are currently zoned ----commercial. AMC, Inc. property East of Highway 71 South and South of 22nd Street will need industrial zoning to be conforming under the proposed ordinance. Roy Clinton moved that the proposed map show this property as being zoned I-1. Ernest Jacks seconded the motion. Approval was unanimous. Dr. Brown moved that Carl Tune's property and the other properties North of North Street, South of Poplar Street, East of Leverett, and West of the railroad tracks with the exception of the North Street Church of Christ property and Carl Tune's property recently rezoned C-1 remain on the proposed zoning map as R-2, Medium Density Residential. Al Donaubauer seconded the motion. This would include the Donald Grimes property. Mr. McClinton expressed concern for the fact that this would devalue these properties. He felt Urban Renewal might eventually improve the area. Ernest Jacks suggested a sketch be prepared of the entire area showing the location of the uses, etc. The motion and second were with- drawn for further study. Dr. Brown moved the meeting be adjourned until Saturday, March 14, at 8:00 A.M. The meeting was adjourned at 5:50 P.M.
