HomeMy WebLinkAbout1970-02-26 MinutesMINUTES OF A PLANNING COMMISSION MEETING • The Fayetteville Planning Commission met in an adjourned session February 26, 1970, at 7:00 P.M., in the Directors Room of the City Administration Building, Fayetteville, Arkansas. Members Present: Ernest Jacks, Clark McClinton, Dr. Walter Brown, Byron Boyd, Morton Gitelman, Dr. James Mashburn, Al Donaubauer. Members Absent: Roy Clinton, Allan Gilbert, Others Present: James Vizzier, Wesley Howe, David Malone, Harold Lieberenz, L. M. McGoodwin, Carl Yates, Hugh Kincaid, Leon Edens, Mr. Williams, Conlee Bodishbaugh, D. G. Glass, Tom Comley, Kenny Bell, Harold Griggs, Loris Stanton, Mr. Kerstetter, The Chairman called the meeting to order. Carl Yates representing the firm of McGoodwin, Williams, and Yates presented a brief and summarized the firms request for C-1 on the proposed map. This was one of the properties rezoned within the last two years. David Malone, City Attorney, asked what the bulk and area regulations would be for the firm in R-3 as it is proposed. There was some discussion of the matter. Hugh Kincaid represented Dr. Jack Edmiston asking for professional zoning on the proposed map. This is the former Kate Mitchell property rezoned within the last two years. He stated that as yet no major alterations have been made on the property. If the property is nonconforming no alterations or expansions could be made. In the event of fire the building could not be reconstructed. There are 2 acres of land in the tract. Mr. Williams, Mr. Karstetter, and Leon Edens jointly asked for commercial zoning for their business property located on the North side of Highway 16 West. They were all existing at the time of their annexation. They ask for whatever zoning would make them conforming. Al Donaubauer and Dr. Mashburn arrived at the meeting at 7:45 P.M. Conlee Bodishbaugh stated that due to the uses formerly allowed in C-2 and not allowed in the proposed C-2 his plumbing shop at 22nd Street and Highway 71 South would be nonconforming. He wishes to replace the present building at some time in the future. Plans and financing are not firm enough to obtain a building permit at this time. Under the proposed ordinance, it would require I-1 to be conforming and utilize his property to the fullest. He stated he keeps the grounds in good shape and does not litter them with equipment and materials. Mr. Bartholomew, Mr. Williams, and Kenny Bell on Highway 62 West said they would like to get zoning so that they could have appropriate uses. Tom Comley asked if any consideration would be given to a planned comples under 20 acres in size. Mr. Vizzier said a certain amount can be done 2-26-70 -2- under the large scale development, but it is not as flexible as he wishes. Mr. Conley suggested a P -R2 or planned R-2 development which would allow more units under special circumstances. Much of his property would be nonconforming with the existing units under the proposed ordinance. He stated his apartments pay to the City $40,000 per year for taxes and fees. There was considerable discussion with Mr. Comley, Harold Griggs represented Roy Ritter of the A. Q. Chicken Houses. Mr. McClinton read a letter submitted by Mr. Ritter's attorney opposing the change in zoning classification. Ernest Jacks and Dr. Brown both expressed that at the time of the rezoning it was promised by Mr. Ritter that no eating facilities would be built here. It would only be a drive by and pick up type of business. Loris Stanton said Donald Grimes of Fort Smith had asked him to check on the proposed zoning of his property on Poplar. He has 5 lots facing on Poplar; 3 or 4 others face the other way. There is nine acres in all. He is concerned the uses on his property will be nonconforming and he is concerned about his property values being hurt. Mr. McClinton asked that Maupin Cummins, Carl Tune, and Tommy Haseloff be called and notified of the next meeting. There was again considerable discussion with Tom Comlff relative to allowing heavier densities in R-2 if the plan merited such. Dr. Mashburn and Al Donaubauer stressed the factors of beauty, pride, and economics. Mr. Howe asked for clarification of the planning principle which calls for a residential area with different den:ities. Mr. Gitelman said you must determine what densities an area can carry with regard to traffic circulation, and water and sewer facilities. Mr. McClinton asked the Commission members to give some thought to the suggestions made before the next meeting, Tuesday, March 3, at 4:00 P.M. He asked them to keep two things in mind ----economic growth and aesthetic values.. The Chamber of Commerce is asking various board, commissions, agencies, etc, to meet with them to discuss "Dialogue 70". They have asked the Planning Commission members to meet on the 16th of March. Mr. McClinton said he would like to have all the members present. Mr. McClinton thanked Mr. Howe and Sturman Mackey for their help in providing the Commission with places to hold the public hearings and for the preparations made for the meetings. The meeting was adjourned at 9:20 P.M.
