The Fayetteville.Planning Commission met at 4:00 P.M., Tuesday,
,. January 13,'1970, in the Directors Room of the City Administration
Building, Fayetteville, Arkansas.
Members Present: Clark McClinton, E. H. "A1" Donaubauer, Allan
Gilbert, Dr. Walter Brown, Morton Gitelman,
Ernest Jacks, Byron Boyd,
Members Absent: Roy Clinton, Dr. James Mashburn,
Others Present: Harold Lieberenz, Wesley Howe, Jim Vizzier,
Loris Stanton.
Chairman Clark McClinton called the meeting to order.
The first item before the Commission was a letter from
Edmiston Builders requesting their rezoning petition for
property located North and West of Old Wire Road be left
on table. This is also the location of the proposed Butter-
field Addition.
Ernest Jacks moved that the petition be left on table until
such time as the Planning Commission considers it advisable to
reopen the case. Allan Gilbert seconded the motion and it was
approved unanimously.

The Commission briefly discussed the statement of intended use
of the Bullington property by Washington General Hospital as WASHINGTON GENERAL HOSPITAL
filed before the Board of Adjustment. Harold Lieberenz quoted
the zoning ordinances which allow similar uses on appeal to the
Board of Adjustment. There was no action called for on this
matter, as the statement was given to the Planning Commission
for informational purposes only.
The Commission discussed the letter from Loris Stanton, The
Stanton Company, requesting a separate use unit for small
animal hospitals in the Proposed Zoning Ordinance. He BETTER FROM LORIS STANTON
desires at least a conditional use in the R-0, Residential -
Office District. Varioua:members of the Commission expressed
concern that if such a unit were created, not all veterinarians
affected would maintain the quiet, clean hospital atmosphere.
The matter was referred to Morton Gitelman's committee on
the Proposed Zoning Ordinance for study and evaluation.
The next item discussed was the letter from Wesley Howe, City
Manager, regarding staff reports on zoning matters and the LETTER FROM WESLEY HOWE
procedure for public hearings. Each Planning Commission member Staff Reports
had been mailed a copy of the Planning Commission By -Laws as
amended May 6, 1969, in which staff reports were called for.
Chairman McClinton read the letter from Mr. Howe,
Ernest Jacks stated that he thought it was a good idea to have
the staff presentation of the staff report before the opening
of the public hearing. He liked the staff recommendations.

Mr. McClinton said he personally had no objection to the staff
making recommendations. He asked the other members to express
their opinions as to whether the staff report should be made
available to the public prior to the Planning Commission meetings.
He had no objection to this either and Ernest Jacks agreed with
him.
Allan Gilbert said he felt the staff report should be made
public. He felt it might help to educate interested parties.
In a good, thorough staff report the conclusions should be
evident by the facts presented therein. He saw no necessity
for publishing the recommendations, but felt the news media
should have access to the factual part of the report.
Morton Gitelman said he felt a danger might be in the possibility
that the Planning Commission can take the heat off themselves
by saying they were following the staff recommendations in
controversial cases.
Mr. Donaubauer felt that unless the Planning Commission requested
conclusions, they shouldn't expect them. He favored making
the staff reports public.
Mr. Howe was asked for his opinion. He stated he had heard good
arguments on both sides. He didn't feel the staff work would be
jeopardized one way or the other. A good staff report could be
presented under either procedure.
Walter Brown.stated he doesn't pay that much heed to the
recommendations in making his decisions. He would like to see
the reports made public. He questioned whether the staff
presentation might complicate the hearings. Mr. McClinton
stated that the Planning Commission would be the only ones
permitted to question the staff during presentation. He would
not wish to place the staff in the position of having to defend
their position to the public.
Mr. McClinton said he would try to follow the recommendations
of Mr. Howe regarding procedures of public hearings.
The Commission noted the lists of 1968 and 1969 rezonings and
their relation to the Proposed Boning Map. No changes or
corrections were proposed at this time.
Chairman McClinton stated that he has realized there is a gap
in the Proposed Zoning Ordinance.between the density allowed
in R-1, Low Density Residential District, and R-2, Medium Density
Residential District. R-1 allows up to four families per acre.
R-2 allows up to 24 families per agre. R-3 allows up to 40
families per acre. He asked Mr. Vizzier about adding another
district that would be limited to duplexes only. Mr. Vizzier
said that rather than set up a new zone, he would be more
inclined to add duplexes to R-1, perhaps as a conditional
use. There was some discussion on the matter. Mr. Gitelman

said he favored allowing duplexes in R-1 on approval of the
Planning Commission and also requiring a larger lot area.
Chairman McClinton asked Mr. Gitelman's committee to work on
this problem. Walter Brown expressed his desire to maintain
a separate R-2 zone for duplexes as in the current ordinance.
Mr. McClinton asked if there were any corrections, opinions or
changes to be made on the minutes for the December 16, 1969,
meeting. There were none and the minutes were approved as
mailed.
Jim Vizzier gave a report on the status of the zoning map and
texts being printed. They have been promised to him in about
two weeks.
Dr. Brown moved that the Planning Commission meet at 4:00 P.M.,
the first Tuesday in February to elect officers for 1970.
Mr. Donaubauer seconded the motion. It was approved unanimously.
The meeting was adjourned at 5:45 P.M.
