HomeMy WebLinkAbout1969-08-19 MinutesMINUTES OF A PLANNING COMMISSION MEETING The Planning Commission met at 4:00 p.m, on Tuesday, August 19, 1969 in •the Directors Room of the City Administration Building, Fayetteville, Arkansas. Members Present: Clark McClinton, Ernest Jacks, Roy Clinton, Byron Boyd, Morton Gitelman, Members Absent: Wade Fincher, Allan Gilbert, James Mashburn, Walter Brown, Others Present: Floyd Nonnamaker, David Malone, Thomas C. Comley, Tom Pearson, Harold Lieberenz, Wesley Howe, Ken Riley, Glen Wing, Gerald Byrd, Carol Miller, E. J. Ball, Ellis Burgin. The meeting was called to order by the Chairman, Clark McClinton. The first item on the agenda was the rezoning petition of Floyd F. Nonnamaker for property located east of Highway 71 South from R-2, Two Family Residential District to 0-1, Open Land District. Representing this petition were Mr. Floyd Nonnamaker and his attorney, Mr. David Malone. Mr. Malone stated that Mr. Nonnamaker wants to rezone this in order to put trailers on individual lots. There being no further discussion, the public hearing was closed. The next rezoning petition was submitted by Wheeler Motor Company for • property located just north of Highway 45 and northeast of Fairview Cemetery from A-1, Annexed Territory District to R -IA, Single Family Residential District. There being no one present to represent the petition, and no opposition, the public hearing was closed. The third item on the agenda was the rezoning petition of Thomas C. Comley for property located at the northwest corner of the inter= section of Hazel Street and Storer Avenue from R-2, Two Family Residential District to R-3, Multi -Family Residential District. Representing this petition was Mr. Comley and his attorney, Mr. Tom Pearson. Mr. Pearson stated that his client wants to rezone the property for the proposed extension of the Colonial Arms3Apartments, Mr. Gerald Byrd, who owns lot 6 (an adjoining property owner), stated that he was concerned about what these apartments will do to the value of his property. There being no further discussion, the public hearing was closed. The fourth item on the agenda was the rezoning petition of Lester W. Bale for property located on the south side of Highway 16 West and just east of the Ozark Electric Building from A-1, Annexed Territory . District to C-2, Thoroughfare Commercial District. Representing the petition was Mrs. Carol Miller, Mrs. Miller stated that Mr. Bale wishes to put in a carpet and floor covering shop on the property. Thomas Comley Lester Bale - 2 - There being no opposition and no further discussion, the public hearing was declared closed. The next item of business taken up was the request by McIlroy Bank and McIlroy Bank Industrial Finance Company to close alleys located behind the bank. Alley Closing Representing McIlroy Bank was Mr. Ellis Burgin and his attorney, Mr. E. J. Ball. Mr. Burgin explained the future plans for the bank and explained why the alleys needed to be closed in connection with their future plans. The next item of business to be discussed was the preliminary sub- Wheeler -Sawyer Addition division plat of Wheeler -Sawyer Addition located north of Highway Preliminary Plat 45 East. Mr. Lieberenz, City Building Inspector, mentioned several changes that the Subdivision Committee asked for. Ernest Jacks made a motion that the preliminary plat be approved on the condition that the changes which the Subdivision Committee suggested, be made. Morton Gitelman seconded the motion and the plat was approved unanimously. The next item of business was a request by Bryce Davis to name an TRUCKERS DRIVE existing street, which is located west of Highway 112 and north of the Washington County Fair Grounds, Truckers Drive. • A motion was made by Roy Clinton to approve this request. The motion was seconded by Byron Boyd and approved unanimously. • • • ••••• ••• • WHEREAS, the City Planning Commission has considered a request that an unnamed road located in the northwest part of the city be assigned the name of TRUCKERS DRIVE. NO.d, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That an ordinance be enacted for the purpose of officially naming TRUCKERS DRIVE the road described as follows: This street is located and situated as follows: Beginning ata point on the west side of State Highway 112, where the street herein described intersects said Highway, which point is approximately one hundred sixty five (165) feet east and "ifour hundred seventeen and seventy four hundredths (417.74) feet south of the northwest corner of the Northeast Quarter (NEW) of the Northeast Quarter (NE-,) of Section 33, Town- ship 17 North, Range 30 West, and running thence west along said street 1237.5 feet to the end of said street. SECTION 2. That the above described road be officially • named TRUCKERS DRIVE as petitioned. PASSED AND APPROVED this 19th day of August 1 1969. -3 - APPROVED: CLARK McCLINTON, CHAIRMAN A motion was made by Roy Clinton to approveC.the alley closing petition requested by McIlroy Bank and the Industrial Finance Company. Ernest Jacks seconded the motion and it was approved unanimously. N(19, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING CowISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That after the public hearing an ordinance be • adopted for the purpose of closing the two public alleys herein described as follows: All that portion of the North-South alley in Block 16 Original Town of Fayetteville, Arkansas, lying between and adjacent to Lots 12, 13, 14, and 15 on the one hand and Lots 1, 2, 3, and 4 on the other hand. Y All that portion of the East-West alley in Block 16, Original Town of Fayetteville,"Arkansas, lying east of North-South line (the center line of the North-South alley in Block 16) which line is parallel to and six feet west of the West line of lot 4, Block 16, Original Town of Fayetteville, Arkansas, SECTION 2. That McIlroy Bank and Industrial Finance Company work with the City Engineer to provide any needed utility easements through their property. PASSED AND APPROVED this 19th day of August , 1969. Mr. Howe, City Manager, at this time explained that the Northwest Arkansas Regional Planning Commission will now be doing the staff reports. At this time the Nonnamaker rezoning case was discussed again. Mr. Nonnamaker stated that he only wants to put trailers on the east and the south sides of this property. Morton Gitelman made a motion that this petition be tabled until the next Planning Commission meeting (September 2, 1969) in order to give Mr. Malone time to write a legal description stating the exact part of the property that Air. Nonnamaker wants to rezone. This motion was seconded by Byron Boyd and approved unanimously. Ernest Jacks made a motion that the rezoning petition of Wheeler Motor Company be approved on the grounds that it is in keeping; with the future Land Use Plan. Byron Boyd seconded the motion and it was approved unanimously. WHEREAS, a public hearing was held by the Planning Commission, Tuesday, August 19, 1969, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recommendation to the Board of Directors on the rezoning petition of Wheeler Motor Company, Incorporated. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION 1. That an ordinance be adopted for the purpose of re- zoning from A-1, Annexed Territory District to R -1A, Single Family Residential District said real estate. A part of the West half (W2) of the West half (W2) of the North- east quarter (PE") of the Southwest quarter (Sill.) of Section 2, Township 16 North, Range 30 West, more particularly described as follows, to -wit: Beginning at the Northwest corner of said 10 acre tract, and running, thence South 1150 feet, thence East 50 feet, thence South 150 feet, thence North 63° 301 East 157.5 feet, thence North 35 feet, thence North 561 East 170 feet to a point 1.100 feet South and 330 feet East of the Beginning point, thence North 1100 feet, West 330 feet to the point of beginning, subject to an easement for a roadway 50 feet wride, running North and South through the center of said tract, and containing herein 7.5459 acres, more or less. • SECTION 2. That the above-described property be rezoned from A-1, Annexed Territory District to R-lA, Single Family Residential District, so that the petitioner may subdivide the property. Comley on the grounds that the R-3, Multi -Family Resi- dential District would conform with the land use in that area. The motion was seconded by Ernest Jacks and approved unanimously. That an ordinance be adopted for the purpose of re- zening from R-2, Two Family Residential District to R-3, Multi -Family Residential District said real estate. Lots Numbered One (1) and Two (2) in Block fifteen (15) in College Addition to the City of Fayetteville, Arkansas, as designated upon the corrected plat of the south 660 feet of said Addition and recorded in the Office of the Circuit Clerk and Ex -Officio Recorder of Washington County, Arkansas. SECTION 2. That the above-described property be rezoned from R-2, Two Family Residential District to R-3, Multi -Family Residential District, so that the petitioner may construct apartment units on the property. Lester Bale Bale be denied on recommendation of the staff report. The motion was seconded by Roy Clinton and approved unanimously. }{y�g RESOLUTION PC 42-69 WHEREAS, a public hearing was held by the City Planning Commission, Tuesday, August 19, 1969, fifteen (15) days after a sign eras erected on the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the public hearing, the Planning Commission voted to make a recommendation to the Board of Directors on the petition of Lester W. Bale for rezoning; NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COI.IMISSION TO TRE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS. SECTION 1. That the petition requesting the rezoning of property, described as follows, from A-1, Annexed Territory District to C-2, Thoroughfare Commercial District, be denied. Part of the Fractional IxF,',i-, of the SWI and part of the Fractional SW� of the NcTll; of Section 7 in Township 16 N of Range 30 W, described as follows: Beginning at a point in H 16 ter which is 44.17 feet N and 349.27 feet E of the ITd corner of the first mentioned fractional 40 acre tract and running thence E on a line 22.76 inches S of and parallel with the center line of State Highway 16 434.61 feet; thence S 222.75 feet; thence W 217.47 feet; thence S 70.02 feet; thence W 210.87 feet; thence N 293.04 feet, more or less, to the place of beginning, except that part on the N side in said Highway. SECTION 2. That the rezoning of the above described real estate would not presently be desireable. PASSED AND APPROVED this 19th day of Aupust 1969. APPROVED: CLARK McCLINPON, CHAIRMAN The final item of business was the approval of the final subdivision Bev -O -Rama plat of the Bev -C -Rama Subdivision. Nr. Gitelman made a motion that Subdivision this plat be approved. Mr. Boyd seconded the motion and it was approved unanimously. There being no further business, the meeting was adjourned at 5:35 P.m. 0,
