HomeMy WebLinkAbout1969-08-12 MinutesMINUTES OF A CALLED PLANNING COMMISSION MEETING The Planning Commission met at 4:00 p.m, on Tuesday, August 12, 1969 in •the Directors Room of the City Administration Building, Fayetteville, , Arkansas. Members Present: Allan Gilbert, Byron Boyd, Clark McClinton, Ernest Jacks, Wade Fincher, Roy Clinton, James Mashburn, Walter Brown, Members Absent: Morton Gitelman, ,SAicc4d- /9, /969 Others Present: Vernon .Milson, Wesley Howe, Jim Vizzier, Harold Lieberenz, Walter Nibblock. The meeting was called to order by the Chairman, C1ark McClinton. This meeting of the Planning Commission was called in order to take action on the rezoning petition of Vernon Wilson for property located on the northwest corner of the intersection of Garland Avenue and Wedington Drive from R -IB, Single Family Residential District to C-1, Neighborhood Commercial District, Mr. Wilson had volunteerd to donate enough of his land to extend North Street west to Wedington Drive which would relieve the traffic problem caused if the property was rezoned for commercial use. Claude R. Starr, City Engineer, was asked to make a study to find out how much right of way would be needed in order to extend North Street. Mr. Starr found that the present dedicated right of way of North Street is 60 feet wide, and recommended that the present 60 foot right of way be extended directly across the Wilson property to Highway 16 if possible. Mr. Starr had also prepared a map of the proposed intersection, a vicinity map, and a coutour map, Mr. Wilson agreed to donate the 60 foot right of way to extend North Street west 320 feet through his property to Highway 16 West. After some discussion by the Planning Commission, Ernest Jacks made a motion that all of the Wilson property north of the north line of North Street extended by rezoned to C-1, Neighborhood Commercial District. The motion was seconded by Roy Clinton and unanimously approved. WHEREAS, a public hearing was held by the Planning Commission, Tuesday, July 12, 1966, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation and at which time Vernon Wilson's petition was tabled; and. WHEREAS, the City Planning Commission reconsidered the rezoning •petition at their August 2, 1966 meeting and recommended by Resolution PC 26-66 that the property be rezoned from R -1B, Single Family Resi- dential District to C-1, Neighborhood Commercial District; and VERNON WILSON - 2 - WHEREAS, the rezoning petition was brought before the City Board of Directors at their September 19, 1966 meeting at which time they referred the rezoning petition back to the City Planning Commission for study as to whether or not this property could be rezoned to R-3, Multi -Family Residential District under the proposed Land Use Plan; and WHEREAS, the City Planning Commission restudied the rezoning petition at their November 1, 1966 meeting and recommended by Resolution PC 36-66 that this petition be deferred until a land use study has been made; and r WHEREAS, the City Planning Commission restudied the rezoning petition of Mr. Vernon Wilson at their August 12, 1969 meeting and voted to make a recommendation to the City Board of Directors. NOW, THEREFORE, BE IT RECOI4ENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION 1. That an ordinance be adopted for the purpose of re- zoning from R -1B, Single Family Residential District to C=1, Neigh- borhood Commercial District said real estate. A art of the SE14 of the NEI and a part of the NE1 of the SE y of Section 8 in Township 16 North, Range 30 West of the 5th P.M. and being more particularly described as follows: Beginning at a point 150 feet South of the NE -41 • and running thence North 717 feet along the section line, thence West 349 feet, thence South 11 101 East 567 feet, thence on a line in a Southeast direction to the point of beginning, containing 5 acres, more or less, less and except that portion presently embraced in the rights of way of State H•ghways 16 and No. 112 and existing utilities easements.'lIashington County, Arkansas, SECTION 2. That the above-described<property be rezoned from R -IB, Single Family Residential District to C-1, Neighborhood Commercial District, so that the petitioner may develop the property commercially.
