HomeMy WebLinkAbout1969-07-29 MinutesMINUTES OF A PLANNING COMMISSION MEETING • The Planning Commission met at 2:00 p.m. on Tuesday, July 29, 1969 in the Directors Room of the City Administration Building, Fayetteville, Arkansas, Members Present: Clark McClinton, Ernest Jacks, Allan Gilbert, James Mashburn, Morton Gitelman, Walter Brown. Members Absent:: Roy Clinton, Wade Fincher, Byron Boyd. Others Present: Jim Vizzier, Harold Lieberenz, Hugh Kincaid, Walter Nibblock, Wesley Howe, Vernon Wilson. The meeting was called to order by the Chairman, Clark McClinton. The first item of business was the continuing study on the Compre- hensive Street Plan, Land Use Plan, and Community Facilities Plan. Next, decisions were made on the rezoning requests which were discussed at the July 15, 1969 Planning Commission Meeting. The first decision made on the rezoning requests was on the petition of William H. Bassett for property located at 222 South College, on the east side of South College Avenue and south of Rock Street from C-2, Thoroughfare Commercial District to R-4, Multi -Family Residential and Dormitory District. • Allan Gilbert moved that this petition be approved on the .,grounds that "the proposed zoning is in keeping with the proposed Land Use Plan. The motion was seconded by Walter Brown and approved unanimously. x RESOLUTION PC 33-69 WHEREAS, a public hearing was held by the Planning Commission, Tuesday, July 15, 1969, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recommendation to the Board of Directors on the rezoning petition of William H. Bassett, NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION 1. That an ordinance be adopted for the purpose of rezoning from C-21 Thoroughfare Commercial District to R-4, Multi - Family Residential and Dormitory District said real estate. LEGAL DESCRIPTION: Lot 4, Block 3, Boles Addition to the City of Fayetteville, • Arkansas. / SECTION 2. Voss and Alice Voss for property located onthe north side df Sycamore Street and 100 feet east of Leverett from R -1B, Single Family Resi- dential District to C-1, Neighborhood Commercial District. Walter Brown made a motion that this property be rezoned to R-3, Multi -Family Residential District as proposed in the future Land Use Plan instead of C-1, Neighborhood Commercial District as re- quested. Mort Gitelman seconded the motion and it was approved unanimously. l•:.MREAS, a public hearing was held by the Planning Commission, Tuesday, July 15, 1969, fifteen (15) days after a sign was erected on the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and l+IHEREAS, after the hearing the Planning Commission voted to make a recommendation to the Board of Directors on the rezoning petition of William M. Voxx and Alice L. Voss, NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING CONAfISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS. SECTION 1. That the petition requesting the rezoning of the property described below from R -1B, Single Family Residential District to C-1, Neighborhood Commercial District be denied. A part of Lot 7 in Block 10 in Parker's Plat of Valley View Acres. PASSED AND APPROVED this 29th day of July , 1969. APPROVED: CLARK McCLINTON, CHAIRMAN The next rezoning petition to be voted on was the request of Jerry Jerry Sweetser D. Sweetser and Sharon J. Sweetser for property located on the north- west corner of the intersection of North Street and Gregg Avenue from R -IB, Single Family Residential District to R-3, Multi -Family Residential District. Walter Brown made a motion to approve this petition on grounds that it is in keeping with the proposed Land Use Plan. The motion was seconded by Ernest Jacks and approved unanimously. Sweetser and Sharon J. Sweetser, NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION 1. That an ordinance be adopted for the purpose of rezoning from R -IB, Single Family Residential District to R-3, Multi -Family Residential District said real estate. 350 feet of equal and uniform width off of the south side of the following land, to -wit: Part of the Southeast Quarter (SEI) of the Northwest Quarter (DAVI) of Section 9, Township 16 North, Range 30 East, of the 5th P.M., the same being more particularly described as follows, to -wit: Beginning at a stone at the Southeast corner of the said 40 acre tract and running thence North 80 rods, thence West 12 1/5 rods, thence South 20 1/2 degrees West 34 3/5 rods, thence East 100 feet, thence South 16 1/2 degrees • West 45 rods, more or less, to the South line of said 40 acre tract and thence East to the place of beginning, containing 9.7 acres, more or less, LESS AND EXCEPT A strip of land 30 feet wide of equal and uniform width off of the South end thereof for public road. -. -4 - SECTION 2. APPROVED: CLARK MCCLINTON, CHAIRMAN Next on the agenda was action on the rezoning study of property on Highway 16 East the 4 sides of the intersection of Highway 16 East and Stone Bridge Road from C-2, Thoroughfare Commercial District; R-2, Two Family Residential District; and A-1, Annexed Territory District to C;�2, Thoroughfare Commercial District or a more restrictive zoning district. Ernest Jacks made a motion that this petition be denied on the grounds that this rezoning would not presently be desirable, but that if in the future any property was rezoned commercially on Highway 16 East, this would be the proper location for the re- zoning. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING?COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION 1. SECTION 2. That the rezoning of the above described real estate would not presently be desireable. PASSED AND APPROVED this 29th day of July , 1969. APPROVED: CLARK McCLINTON, CHAIRMAN The rezoning request of Vernon Wilson for property located on the northwest corner of the intersection of Garland Avenue and Wedington •Drive from R -1B, Single Family Residential District to C-1, Neighbor- hood Commercial District, was tabled. The members of the Planning Commission felt that additional information onthe traffic situation at Garland Avenue and Wedington Drive should be obtained, a study by the Traffic Consultant should be made on making Mount Comfort Road at this location a one way street, and a survey should be made by the City Engineer to determine how much land Mr. Vernon ldilson needs to donate totthe City for the right-of-way of the proposed North Street extension. Mr. Wilson has volunteered to donate this land to the City. Next on the agenda was a discussion of the Bev -O -Rama Subdivision which is in a five mile radius outside the City but is under the jurisdiction of the City Planning Commission, The Planning Commission informed Mr. Bass Trumbo that: 1. The streets on the final plat should be numbered as 50' wide. 2. A 10' power easement should be reserved in the rear of the lots for future easement use. 3. An inlestigation should be made and a letter obtained from the State Board of Health that septic systems will be acceptable in this area. The rezoning request of Kate Mitchell (public hearing April 15, 1969) for property located on Highway 45 East from A-1, Annexed Territory District to C-2, Thoroughfare Commercial District was brought up again at this time. • Representing the petition were Mr. Walter Nibblock, attorney for Mrs. Kate Mitchell, and Mr. Hugh Kincaid for Dr. Jack Edmisten, Vernon Wilson Bev -O -Rama Subdivision Kate Mitchell -9 - Mr. Kincaid asked the Planning Commission to reopen the rezoning case (which had been denied) on the grounds that Dr. Edmisten has made arrangements to use the zoning district R -P, Professional Office Residential District, which the Planning Commission had recommended at the public hearing. The By -Laws of the Planning Commission state that a rezoning case may be reopened with the unanimous consent of the members present at the meeting. All members present gave their consent to',reopen the rezoning case of Kate Mitchell. A motion was made by James Mashburn to rezone the Mitchell property to R -P, Professional Office Residential District. This motion was seconded by Allan Gilbert and was approved unanimously. WHEREAS, a public hearing was held by the City Planning Commission, Tuesday, April 15, 1969, fifteen (15) days after a sign was erected on the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the public hearing, the Planning Commission voted to make a recommendation to the Board of Directors that this rezoning request be denied; and 1•1HEREAS, at a meeting of the Planning Commission held Tuesday, July 29, 1969, the petitioners appeared before the Planning Commission stating that they would like to amend this rezoning petition to ask that said property be rezoned to R -P, Professional Office Residential District, and requesting the Planning Commission to reopen their rezoning case for further consideration and action; WHEREAS, at this meeting the Planning Commission voted to make a recommendation to the Board of Directors on the rezoning petition of Kate Mitchell, NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILIE, ARKANSAS, SECTION 1. That an ordinance be adopted for the purpose of rezoning from A-1, Annexed Territory District to R -P, Professional Office Residential District said real estate. Part of the Northeast Quarter of the Southwest Quarter of Section 1, Township 16 North of Range 30 West, more particularly described as beginning at the Southwest corner of said 40 acre tract, thence East Three Hundred eighteen feet; thence North three hundred and twenty-six and seventy five hundredths feet; to the south right-of-way line of State Highway No. 45; thence in a southwesterly direction along the south right-of- way line of said highway to the west line of said 40 acre tract; thence South to the point of beginning, containing • two acres more or less. -8 - SECTION 2. That the above-described property be rezoned from A-1, Annexed Territory District to R -P, Professional Office Residential • District so that petitioner may open doctors offices on the property.
