HomeMy WebLinkAbout1969-07-15 MinutesMINUTES OF A PLANNING COMMISSION MEETING • The Planning Commission met at 4:00 p.m, on Tuesday, July 15, 19695 in the Directors Room of the City Administration Building, Fayette- ville, Arkansas, Members Present: Clark McClinton, Ernest Jacks, Allan Gilbert, Roy the rezoning Clinton, Byron Boyd, Walter Brown. Members Absent: James Mashburn, Wade Fincher, Morton Gitelman. zone according to the Future Land Others Present: Sturman Mackey, Harold Lieberenz, Jim Vizzier, Alice Voss, Mrs. Lindsey, Clarence Tune, Bass Trumbo, Gene Carter, Jim Scroggs, David Scruggs, Mrs. Joe Fleming, Don Ward, Mrs. Davidf_Scruggs, Pete Estes, Fred Shaffer, Lloyd Elam, Homer Hanson, C.A. Green, E. P. Heiney, W. R. Elliott, George Meyer, Lester C. Atkison, Vernon Wilson, Glen Rose, John Gabel, Mrs. Hathcock, Mrs. Hoffman, Glen Wing. The meeting was called to order by the Chairman, Clark McClinton. The first item on the agenda was a rezoning request by William M. Voss and Alice Voss for property located on the north side of Sycamore Street and 100 feet east of Leverett Avenue from R -1B, Single Family Residential District to C-11 Neighborhood Commercial District. • Present to represent the petition were Mrs. Voss and Mrs. Lindsey, Mrs. Voss stated that she wished to rezone this property in order to build and operate a day nursery there. Mrs. Voss stated that there would be a mi=*um of 30 childrenin the nursery and that Mrs. Lindsey would be in charg"e of the nursery. Mr. Clarence Tune stated that he had no objections but that he thought that his property which adjoins the property in question should be zoned the same (C-1, Neighborhood Commercial District), Chairman McClinton stated that the proper procedure for him to rezone his property would be to file a petition for amendment to the zoning map, There being no further questions and no objections the public hearing was closed. Second on the agenda was the rezoning request of Jerry D. Sweetser and Sharon J. Sweetser for property located on the northwest corner of the intersection of North Street and Gregg Avenue from R -1B, Single Family Residential District to R-3, Multi -Family Residential District, Representing Mr, Sweetser's petition was his attorney, Bass Trumbo, Mr. Jim Vizzier stated that the rezoning requested, R-3, was the • proper zone according to the Future Land Use Plan. William Voss Jerry Sweetser - 2 - Dr. Stephan asked what plans the city has for conjestion on North Street and that the apartment, if built, would cause a worse traffic problem. Mr. Jim Scroggs stated that he objected to the rezoning on a state- ment that Mr. Sweetser had made, that some didn't know how poorly a R-3,structure could be built. Ms. Scroggs also stated that he was concerned about the limited access roads there. Mr. David Scruggs said that he was concerned about the problem of traffic, also the structures that Mr. Sweetser has already built on North Leverett Avenue, Mrs. Joe Fleming stated that she would be glad to seezthe apartment go in but she felt that the building should compliment the area. Bass Trumbo said that Mr. Sweetser would want to build his apartments well because he would,be renting and maintaining them. Don -Ward suggested that Mr. Sweetser offbr_ his -plans•ao.,Planning Commission and public inspection. Bass Trumbo stated that this would not really be fair because this was not required of everyone when they were applying for a building permit. Mrs. David Scruggs stated that she does not think it would be unfair •to ask for public inspection of the plans and that this sort of thing has been done before. Mrs. Scruggs said that she would be glad to go along with this project if the plans could be inspected and approved. The third item on the agenda was a rezoning request by William H. Bassett for property located at 222 South College, on the east side of South College Avenue and south of Rock Street from C-2, Thoroughfare Commercial District to R-4, Multi -Family Residential and Dormitory District, Mr. Pete Estes and'Mt. William Bassett were present to represent the petition. Mr. Estes stated that his client, Mr. Bassett, wishes to tear down the existing dwelling and pawn shop buildings located on this property and put in a house trailer for his residence. There being no further discussion and no objections, the public hearing was closed. Next on the agenda was a study, requested by the City Planning Commission, of the present zoning of property on the 4 sides of the intersection of Highway 16 East and Stone Bridge Road. Consideration will be given to the rezoning of property at this location to C-2, Thoroughfare Commercial District or a more • restrictive zone. Fred Shafer, whose brother owns the garage on the property concerned, stated that his brother would like to see his property stay in a C-2, Thoroughfare Commercial District, William Bassett Planning Commission Highway 16 East -3 - Floyd Elam who lives in Tract B stated that he could see no advantage • to having the zoning changed. Mr. Homer Hanson stated that if the people that live on the property concerned are not asking for a zoning change, he sees no reason for the Planning Commission to rezone the land. _Mr. C. A. Green said that this area was a nice place to live and that he would like to see it left zoned as it is. Mr. E. P. Heiney said that people don't understand that the Planning Commission is trying to get a specific zone for the area. Mr. W. R. Elliott stated that he wanted the land to stay suitable for a home there. Mr. Don Ward stated that he wanted the zoning to remain as it is. Next was the rezoning petition requesjed by Vernon Wilson for property Vernon Wilson located on the northwest corner of the intersection of Garland Avenue and Wedington Drive from R -1B, Single Family Residential District to C-1, Neighborhood Commercial District. Mr. Wilson and his attorney, Mr. Walter Nibblock, had asked for a continuance at the July 1, 1969 Planning Commission Meeting. Mr. Nibblock reported his findings on the studies which the staff report required. • &r. Glenn Rose stated that he objected to the Wilson rezoning petition because he feels that commercial development would damage the value of the surrounding property. He also stated that he thinks Garland Avenue should be a buffer, and that there is plenty of room east of Garland Avenue to develop commercially. Mr. John Gabel asked what use the future Land Use Plans proposed for this property. Mr. Vizzier stated that the future Land Use Plans for this area are for medium density apartments but that the Land Use Plan has not yet been accepted by the Planning Commission, the Board of Directors, or the people. Mr. Gable and Mr. Rose stated that they did not object to a R-3, Multi -Family Residential District, Mr. Nibblock stated that the R-3 zone would not be suitable for his client because there is no money available for apartment projects, and that Mr. Wilson wants to build a shopping center on the property. The next item of business concerned the requirements for the Bev -0 -Rama Bev -0 -Rama Subdivision, which is within a 5 mile radius outside the City but falls Subdivision under the jusisdiction of the City Planning Commission. Representing the Bev -0 -Rama Subdivision were Bass Tf•umbo and Glen Wing • who stated that a plat had been prepared. -4 - The Planning Commission members decided to have the Subdivision Committee, Ernest Jacks and Roy Clinton, check the Bev -0 -Rama is Subdivision Plat. Action on the rezoning petitions were deferred until Ju13r 29, 1969. There being no further business, the meeting was adjourned at 6:10 p.m. • CI
