MINUTES OF A PLANNIIU COMMISSION MEETING
The Planning Commission met at 4:00 p.m. on Tuesday, June 17, 1969, in
the Board of Directors Room of the City Administration Building,
Fayetteville, Arkansas.
Members Present: Clark McClinton, Ernest Jacks, Allan Gilbert, Roy
Clinton, Morton Gitelman, Byron Boyd.
Members Absent: Wade Fincher, James Mashburn, Walter Brown,
Others Present: Wesley M. Howe, Harold Lieberenz, Irvin Fitzgerald,
Jim Vizzier, Bryce Davis.
The meeting was called to order by the Chairman, Clark McClinton.
First on the agenda was the rezoning request of Bryce Davis arra
Company for property located on the west side of Highway 112 just
north of the University of Arkansas Experimental Farm from 0-1, Open
Land District, to C-2, Thoroughfare Commercial District.
No one was present at this time to represent the petition or to oppose
it.
Ernest Jacks asked if Mr. Davis' petition gave information as to what
he wants to rezone the property for.
Mr.
Lieberenz
stated that the
reason Mr.
Davis gave was so
that Arkansas
Best
Freight
Lines can build
and operate
a truck terminal
on the land.
There being no further questions and no opposition, the public hearing
was closed on this petition.
Second on the agenda was the rezoning request of Irvin S. Fitzgerald
for property located just west of the intersection of Old Wire Road
and Old Missouri Road from A-1, Annexed Territory District to R-2,
Two Family Residential District. Mr. Fitzgerald was present to
represent his petition.
There being no opposition and no further questions, the public hearing
was declared closed.
The next item on the agenda was the approval of the minutes of the May
20, 1969 Planning Commission Meeting. Ernest Jacks made a motion that
the minutes of this meeting be approved as mailed. The motion was
seconded by Roy Clinton and passed unanimously.
The petition of Bryce Davis was brought up again at this time. Bryce
Davis came in at 4:20 p.m. to represent his rezoning petition. The
Planning Commission asked Mr. Davis what he would do for water and
sewer facilities since they are not available to the property. Mr.
Davis stated that both companies said that they would drill wells
until City water was put out there. He also stated that the ground
would support septic ?systems.
Clinton made a motion that

• Byron Boyd seconded the motion and it passed by a vote of 4 ayes and
2 nays by Mort Gitelman and Clark McClinton.

WHEREAS, a public hearing was held by the Planning Commission
Tuesday, June 17, 1969, fifteen (15) days after a sign was erected
on the property and after a notice was published in the Northwest
Arkansas Times, a newspaper of general circulation; and
UREAS, after the hearing the Planning Commission voted to make a
recommendation to the Board of Directors on the rezoning petition of
Bryce Davis and Company.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION
TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS,
SECTION 1. That the petition requesting the rezoning of the
property described below from 0-1, Open Land District to C-2, Thorough-
fare Commercial District, be denied.
Part of the North half of the Northeast Quarter of Section 33,
Township 17 North, Range 30 West described as follows: Beginning
165 feet East of the Northwest corner NE NE of Section 30 and
running thence South 417.74 feet, thence West 819.76 feet, then
• 417.74 feet North, thence East 819.76 feet to the place of
beginning, 7.83 acres more or less, less that part within the
right of way of highway 112 and east of it in the Northeast
corner.
SECTION 2. That an ordinance be adopted for the purpose of
rezoning from 0-1, Open Land District to I-lA, Light Industrial
District the above described property.
SECTION 3. That the above-described property be rezoned from
0-1, Open Land District to I-lA, Light Industrial District so that
the petitioner may develop the property for commercial uses.

Next, action was taken on the petition of Irvin S. Fitzgerald. Byron Irvin Fitzgerald
.Boyd moved that the petition be accepted; the motion was seconded by
Norton Gitelman and passed unanimously.

• WHEREAS, a public hearing was held by the Planning Commission,

SECTION 1. That an ordinance be adopted for the purpose of
rezoning from A-1, Annexed Territory District to R-2, Two Family
Residential District said real estate.
A part of the East half of the West half of Section thirty-
six (36) in Township seventeen (17) north of Range thirty
(30) West, being more particularly described as beginning
at a point on the West Side of the public road which is
154 and eight tenths (154.8) feet West and North 15 Degrees
201 West Ninety Six (96) feet from the center of said section
36, and running, thence along the West side of said road
South 15 Degrees 201. East Two hundred twenty three (223)
feet, thence South 28 Degrees 451/ West 138 and five tenths
• (138.5) feet to the Northeast corner of land sold to Grace
Baptist church thence West with the North line of said tract
North 75 Degrees+.:501, West Six Hundred Eight (608) feet to
the West line of Old Wire Road as previously located, thence
with said road North 11 Degrees 441. East Three Hundred
forty seven and three tenths (347.3) feet, thence south
easterly five hundred fifty five feet (555) to the place of
beginning, containing four and sixty four hundreths (4.64)
acres, more or less.
SECTION 2. That the above-described property be rezoned from
A-1, Annexed Territory District to R-2, Two Family Residential District
so that the petitioner may build duplexes on the property.

• The meeting was then turned over to Wesley M. Howe, City Manager,
for a discussion on the future street plans. Mr. Jim Vizzier
presented and discussed the street circulation map which is
part of the City Comprehensive Plan.

Ernest Jacks moved that the final plats of Rockwood Addition and Wilson -
Wilson Subdivision be approved subject to the minor corrections and
stipulated by the Subdivision Committee. Roy Clinton seconded the motion
• and it passed unanimously.
WHEREAS, at its regular meeting on Tuesday, June 17, 1969, the Planning
Commission voted to make a recommendation to the Board of Directors on the
final subdivision plat known as Wilson -Wilson Subdivision submitted by John
Vernon Wilson and Irvin Wilson,
NCW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION
TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the City of Fayetteville, Arkansas accept the
final plat along with the land dedicated for streets and other public
uses in the Wilson -Wilson Subdivision described as follows:
LEGAL DESCRIPTION
A part of the Northwest Quarter of the Northeast Quarter
of Section 10, Township 16 North, Range 30 West of the
Fifth Principal Meridian, County of Washington, State of
Arkansas, being more particularly described as follows:
Beginning at a point that is 517.5 Feet South of the North-
west corner of said Section 101,Thence N 890 541 E, 786.02
Feet to the center of Old Wire Road; Thence S 121 15' W,
• 204.66 Feet; Thence S 89° 54' W 742.59 Feet; Thence North
200 feet to the point of beginning; containing 3.50 acres
more or less.

WHEREAS, at its regular meeting on Tuesday, June 17, 1969, the
Planning Commission voted to make a recommendation to the Board of
Directors on the final subdivision plat known as Rockwood Addition
submitted by Young Enterprises, Inc. and
WHEREAS, the Planning Commission recommend that because the
necessary,improvements have not been installed in said subdivision
that Young Enterprises enter into and furnish the City with the
• necessary final subdivision plat.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION
TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. The necessary subdivision contract be executed
with the City prior to the Board of Directors accepting the final J
subdivision plat.

feet from the Northeast corner of said Forty acre tract, and
running; Thence South 00 54' West Thirteen Hundred and seventy--
eight hundredths (1300.78) feet to an existing iron pin, said
point being on the North right-of-way line of Rockwood Trail
in the City of Fayetteville, Arkansas, Thence North 880 58'
West Six Hundred Sixty-two and fifty=five hundredths (662.55)
