HomeMy WebLinkAbout1969-02-25 Minutes4�D3� Z -A MINUTES OF A PLANNING COMMISSION MEETING iThe Planning Commission met at 4:00 p.m. on Tuesday, February 25, 1969, in the Board of Directors Room of the City Administration Building, Fayetteville, Arkansas. Members Present: Ernest Jacks, Roy Clinton, James Mashburn, Walter Brown, Morton Gitelman, Members Absent: Clark McClinton, Wade Fincher, Allan Gilbert, Byron Boyd. Others Present: Frank Giles, Jim Vizzier, Johnie Bassett, Charles Atkinson, Vernon Wilson, Leo P. Peel, Harold Lieberenz, Harry Jackson, V.Q. Blumenberg, T. E. Williams, D. B. Glass. The meeting was called to order by the Acting Chairman, Ernest Jacks. The first item of business was the approval of the minutes of the February ll, 1969 Planning Commission Meeting. Roy Clinton said that Mr. Walter Brown's name should be corrected. It was down as Warren Brown, Walter Brown then moved to approve the minutes and Roy Clinton seconded the motion. The minutes of the February 11, 1969 meeting were approved as corrected. At this time the public hearings on 5 rezoning petitions were started. The first public hearing of the meeting was the rezoning petition of W. D. and Flossie Drake for the rezoning of property on the north side of Wyman Road, East of Stone Bridge Road from A-1, Annexed Territory to R-2, Two Family Residential District. Acting Chairman, Ernest Jacks, asked if there was anyone present to represent the reaoning'petition or was there anyone present to oppose the petition. Since no one was present to speak for or against the petition, the public hearing on the proposed rezoning petition was declared closed. The next public hearing was the rezoning petition of Leo P. Peel of property located on the south side of Spruce Street and on the east side of Gregg Avenue from R -1B, Single Family Residential District to R-2, Two Family Residential District, Mr. Peel was present to represent his rezoning petition. He stated that there was one new house which is up for sale now in this area where this rezoning study is being made. No one was present to oppose this rezoning and there being no further discussion, the public hearing was declared closed. The next public hearing was on the rezoning petition of Joe L. and Madge Rutledge in regard to property located on the Northeast corner of the intersection of Highway 62 West and One Mile Road. They request rezoning of property from A-1, Annexed Territory District to C-2, Thoroughfare Commercial District. •There was no one present to speak in favor or in opposition of the rezoning petition and there being no more discussion the public hearing on this petition was declared closed. - 2 - The next public hearing was on the rezoning petition of Charles D. and Ruth McNeal • for the rezoning of property on the south side of Lawson Street between Oakland and Leverett Avenue from R-2, Two Family Residential District to 'R'-3, Multi -Family Residential District. Mr. V. Q. Blumenberg was present to speak in favor of the rezoning petition. He stated that property to the east of this area is zoned R-3, Multi -Family Residential District, Mr. Blumenberg said Lawson Street was partly opened up because traffic does go through but it is not paved. There being no more questions and no opposition present, the public hearing on this petition was closed. The last public hearing was on the rezoning of Johnie Bassett's property located on the northwest corner of Giles Road and Highway 16 West from A-1, Annexed Territory District to C-2, Thoroughfare Commercial District. The south 300 feet of the above mentioned property has already been approved by the Planning Commission and is now before the city Board of Directors. There was concern as to the congestion of getting on and off the by-pass and some discussion about the building set backs on Wedington Drive for future widening of Wedington Drive. Mr. Walter Brown said Giles Road was only 30 feet wide and therefore would be too narrow for commercial use. Mr. Giles said that Giles Road was not paved. Mr. Walter • Brown stated that the city probably would not be able to pave Giles Road and that this would be up to the property owners. Mr. Atkinson said there was some commercial uses already on Giles Road with the small cabinet shop owned by Mr. T. E. Williams. Mr. Frank Giles said that property along the by-pass was usually more suitable for commercial because of the traffic noise and he thought that land where desirable should have consideration of commercial zoning. Acting Chairman, Mr. Ernest Jacks, asked if anyone was present to oppose this rezoning petition. Mr. Williams was in opposition to the rezoning. He said that the lastotime he didn't oppose it but that a C-2, Thoroughfare Commercial would throw the land open for every kind of business such as beer taverns, etc. He said that he would approve if the land was zoned for certain types of businesses. Mr. E. B. Glass said that he objected along with Mr. Williams. He said that he wouldn't oppose a daytime business. After more discussion the public hearing was declared closed. At this time, the Planning Commission returned to the first item for public hearing to complete action on the rezuests of the applicants. The first item for action was the petition of W.D. and Flossie Drake. There were comments that a few duplex residences existed in the area and a lot of the land • south of this property was zoned R-2, Two Family Residential District. It was felt that this rezuest conforms with the R-2, Two Family Residential trend in the area. -3 - There being no further discussion Walter Brown made a motion to approve the rezoning • of this property from A-1, Annexed Territory District to R-2, Two Family Residential District. This motion was seconded by James Mashburn and the vote was unanimous for approval of the rezoning request. RESOLUTION:PC 8-69 WHEREAS, a public hearing was held by the Planning Commission, Tuesday, February 25, 1969, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recommendation to the Board of Directors on the rezoning petiton of W. D. and Flossie Drake. NOMI, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That an ordinance be adopted for the purpose of rezoning from A-1, Annexed Territory District, to R-2, Two Family Residential District, the property described as follows: LEGAL The East halt (EJ) of the Northwest quarter (NW4) of the Southwest • quarter (SW�) of Section Thirteen (13) in Township Sixteen (16) North of Range Thirtyy(30) West, and being described on the plat and subdivision of the W. E. Anderson Farm as Lots 7 and 8, less and except the following, to -wit: Beginning at the Southeast corner of said 20 acre tract, thence running West 100 feet, thence North 435j feet, thence East 100 feet, thence South 4351 feet to the place of beginning, containing 1 acre, more or less, and containing in all 19 acres, more or less. SECTION 2. That the above-described property be rezoned from A-1, Annexed Territory District, to R-2, Two Family Residential Zone, so that the owner may develop the property for two-family dwellings. PASSED AND APPROVED THIS 25th day of February , 1969. APPROVED: W CLARK MCCLINTON, CHAIRMAN 0 Action was taken next on the rezoning petition of Leo P. Peel. -4 - Ernest Jacks said that property around this area is R -1B, Single Family Residential District but the lots are largienough for duplexes. The Planning Commission thought • that because of existing small houses in the area that the R-2, Two Family Residen- tial District would be upgrading the surrounding property. On a motion by Morton Gitelman and seconded by Walter Brown the Planning Commission voted to approve rezoning of Mr. Peel's property from R -1B, Single Family Residential District to R-2, Two Family Residential District. The motion carried unanimously, RESOLUTION PC 9-69 WHEREAS, a public hearing was held by the Planning Commission, Tuesday, February 25, 1969 fift�eena(15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recommendation to the Board of Directors on the rezoning petiton of Leo P. Peel, NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEOILLE, ARKANSAS: SECTION 1. That an ordinance be adopted for the purpose of rezoning from R -IB, Single Family Residential District, to R-2, Two Family Residential District, the property described as follows: LEGAL DESCRIPTION: • Part of lot numbered two Seamster Place, an addition to the City of Fayetteville, Arkansas, more particularly described as follows, to wit: Beginning at a point 10 feet south and 119.81 feet east of the Northwest corner of the Southwest quarter of the Northwest quarter of the Northeast quarter of Section Nine (9) in Township Sixteen (16) North of Range Thirty (30) West, Thence South 89 Degrees 28 Minutes East 540.19; thence South 0 Degrees 12 Minutes West 320 feet; Thence North 89 Degrees 28 Minutes West 290 feet; thence South 0 Degrees 12 Minutes West 80 feet; thence North 89 Degrees,28 Minutes West 178.4 feet; thence North 0 Degrees'v12 Minutes East7.159 feet; thence North 89 Degrees 28 Minutes West 127.7 feet to the East line of Gregg Avenue thence Northerly along the East line of Gregg Avenue 243 feet more or less to the point of beginning, containing 4.32 acres, more or less. n U SECTION 2. That the above-described property be rezoned from R -IB, Single Family Residential District, to R-2, Two Family Residential District, so that the petitioner may. construct duplexes on the property. PASSED AND APPROVED this 25th day of February , 1969. APPROVED: CLARK MCCLINTON, CHAIRMAN -5- • Action was taken next on the rezoning petiton of Joe L. and Madge Rutledge. The Planning Commission felt that since there was no one present at the meeting to explain the rezoning request and since the Planning Commission did not know what the property would be used for that the petition should be tabled. The Planning Commission felt that the Rutledges should be notified that they need to be present and expalin what the property is to be used for. After considerable discussion James Mashburn moved to table the petition and this was seconded by Roy Clinton. The motion carried unanimously. The rezoning petiton of Charles D. and Ruth McNeal was acted upon next. The Planning Commission discussed that this rezoning request seemed to conform with the land use of the area and that some more acerage in that area had recently been zoned R-3, Multi -Family Residential District. There being no fir ther discussion a motion was made by James Mashburn and seconded by Walter Brown to approve rezoning of the property in question from R-2, Two Family Residential District to R-3, Multi -Family Residential District. The motion carried unanimously. RESOLUTION PC 10-69 WHEREAS, a public hearing was held by the Planning Commission, Tuesday, • February 25, 1969 fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, A newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recommendation to the Board of Directors on the rezoning petiton of Charles D. and Ruth McNeal. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That an ordinance be adopted for the purpose of rezoning from R-2, Two Family Residential District, to R-3, Multi -Family Residential District, the property described as follows: [A A111 Part of the West i of the Northwest j of Section 9, Township 16 North, Range 30 West„of 5th PM. Beginning at a point which is 1310 feet North and 310 feet West of the Southeast corner of said tract and running North 210 feet, West 110 feet, South 210 feet, and East 3.10 feet. This property is located on the South side of Lawson Street between Oakland and Leverett Avenue. • SECTION 2. That the above-described property be rezoned from R-2, Two Family Residential District, to R-3, Multi -Family Residential District, so that the petitioner may sell the property as an apartment site. PASSED AND APPROVED this 25th day of February , 1969. - b - 0 APPROVED: CLARK McCLINTON, CHAIRMAN The last rezoning petition acted upon at this meeting was the rezoning request of Johnie Bassett. After a brief discussion Walter Brown moved to reject the rezoning request. He said that the owners had no proposal for use of the property in the near future and that the requested land use was not conforming with property on the north and east. Morton Gitelman seconded the motion. The motion carried with 4 ayes and 1 nay vote by James Mashburn. There being no further business, the, meeting was adjourned at 5:45 p.m. n U •
