The meeting was called to order by the Chairman, Clark McClinton.
The first item of business was the Final Plat of Eastgate Addition.

Mr. Lieberens, City Building Inspector, then asked the Planning Commission to
authorize the IhAlding Inspectors' Office to issue building permits on .,: or two
lots of Eastgate Addition prior to acceptance of the Plat by the Board of Directors.

WHEREAS, the Planning Commission voted to make a recommendation to the
Board of Directors on the rezoning of property of James and Billye Fletcher,
for rezoning the.following described property from A-1, Annexed Territory
District to C-1, Neighborhood Commercial District]
Part of the SW� of the SW� of Section 13 and part of the NW� of
` the NW� of Section 24, all in Township 16 North of Range 30 West
of the 5th P.M., County of Washington, State of Arkansas, being

more particularly described as follows, to -wit: Beginning at a
point on the North side of Section 24 where it intersects with
the South side of State Highway No. 16, said point being 440.7
feet East of the NW corner of said Section 24, thence South 72
degrees 5 minutes West along the right of way 42 feet; thence
South 14 degrees 2 minutes East 340 feet; thence South 3 degrees
48 minutes West 106.3 feet to the center line of a public road;
thence South 81 degrees 8 minutes East along the center line of

The third item taken up was the petition for rehearing submitted by Johnie Bassett.
A discussion was held concerning the request for rehearing. Charles Atkinson
represented Mr. Bassett's request for rehearing of his case.
Mr. Atkinson stated that for Giles Road to serve Mr. Bassett's property the
Road would have to be widened and Mr. Basset is willing to dedicate the needed
20 feet for the widening.
Chairman McClinton stated it was his
feeling
that with the new
information given
in the Petition for Rehearing and Mr.
Bassett"s willingness to
dedicate the
needed,20 feet for widening of Giles

rehearing should be granted,

At this time 'the public hearings on 7 petitions was started.

The first public hearing of the meeting was the request of the Delta Nu House
Corporation of Kappa Alpha Theta Fraternity. The request is for approval of
a site plan in order to construct a sorority house at the corner of Hall Avenue
and Cleveland Street which is zoned R-30 Multi -Family Residential District.
A. D. McAllister represented the site plan as attorney for the Sorority. Mr.
McAllister presented Mr. Mott, architect for the proposed Sorority house.
Mr. Mott discussed each of the requirements for a sorority house one at a time
as stated in Ordinance 1624. At the end of his discussion he stated that each
requirement had been met in the site plan as presented.
Chairman McClinton then asked if any of the Planning Commission members had any
questions.
Roy Clingon asked how tall the proposed fence would be.
Mr. Mott answered that the plans were not that complete at this time, therefore
he could not give an exact answer.
` A member of the audience asked what provisions had been made for drainage.
Mr. Mott answered that there will be adequate drainage work done, but as to the
type he did not know.
Mr. J. R. Fulton stated that it was his feeling that the type of fencing or
screening had not been specifically mentioned and he wanted to know what was
• proposed.
Mr. Mott answered that a decission had not been made on the exact type of
screening, but that it could be worked out to everyone's liking at a later time.
After more discussion the public hearing was declared closed.
The next public hearing was on the rezoning petition of Inwood Development
Corporation for rezoning of property from A-1, Annexed Territory District
to C-2, Thoroughfare Commercial District.
Bass Trumbo, as attorney for the petitioner, represented the rezoning request.
Mr. Trumbo stated that this petition is requesting rezoning of the same property
which was petitioned by Joe Cogdell, but that Mr. Cogdell had withdrawn hie
request. Mr. Trumbo further stated that the proposed use of the property was
service station and that being right across from the Fair Grounds Stock Barns
the property would not be desireable for residential use.
(At 5:00 p.m., Dr. James Mashburn was called from the meeting.)
The Chairman asked if there were any questions from the Commission members, or
from the Building Inspector.
Harold Lieberenz, City Building Inspector, asked if this property would be used
for a service station only or would there by a bulk gasoline plat located there
also.

Mr. Joe Coddell, a member of Inwood Corporation answered that this would be
• only a service station.
There being no opposition present the public hearing was closed
The next rezoning petition for public hearing was from W. R. Porter, Ola J.
Porter and Barbara L. Jones for rezoning of property on South Gregg Avenue
from I -1B, Light Industrial District to R-4, Multi -Family Residential District.
Representing the petitioners was Walter Niblock, their attorney.
Mr. Niblock presented a drawing of the proposed apartments which the petitioners
want to construct on the property.
There being no discussion and no one present opposing the request the public
hearing was closed.
The next petition for rezoning was from Lonnie Gregg and Richard Gragg for
rezoning of property on Phillip Drive in Giles Addition from R-2, Two Family
Residential District to R-3, Multi -Family Residential District,
Mr. Lonnie Gregg was present to represent the petition.
Walter Brown asked how the area near this property is developed presently.
Lonnie Gragg answered that just East of the property in question are 5 deplexes
and that there are tri-plexes and a store near this property.
• There being no more questions and no opposition present, the public hearing
was closed.
The next rezoning request was from Hoyt Greenwood for rezoning of property on
Storer Avenue.ffom R-2, Two Family Residential District to R-4, Multi -Family
Residential District,
Representing Hoyt Greenwood was his son, Stanly Greenwood.
One of the members of the Planning Commission asked Mr. Greenwood of R-3 zoning
would be acceptable to him.
Mr. Greenwood answered that R4, would be best because the plan for the property
was to construct two (2) apartment buildings and in R-3, the buildings could
not be separated as they could be in R4.
Chairman McClinton then asked if there was anyone present wanting to speak concerning
this request for rezoning.
Gerald Byrd, an adjoining property owner, asked how close a building can be placed
to the side property line in R4 Zoning,
Harold Lieberenz answered that in both R-3, and R-4 the side yard set back must
be five (5) feet.

• There being no further questions the public hearing was closed.
The next request was from J. R. Hatfield and Catherine Hatfield for rezoning
of property on Highway 16 West, just West of the New By-pass, from A-1, Annexed
Territory District and I4, Heavy Industrial District to C-2, Thoroughfare
Commercial District. Representing the petitioners was Bass Trumbot
Mr. Trumbo presented a preliminary commercial arrangement drawing to the Planning
Commission members., stating that this 49J acre tract was ideal for commercial
development because of the location, Mro Trumbo further told the Commission
members that one of the motel chains was considering this property as a site
for a large motel complex*
The Chairman then asked if there were y questions or any..: present opposing this
There being no questions or opposition the public hearing was closed.
The last public hearing to be held was on a petition from Red Arrow Land Company,
Incorporated for rezoning of,property on West Custer Lane of Red Arrow Subdivision
Number 2 from R-2, Two Family Residential District to Cm2, Thoroughfare Commercial
District.
Walter Niblock represented the rezoning request.
Mr. Niblock stated that because of the location of the property at the intersection
. of Custer Lane, 18th Street and the Highway By-pass a gasoline service station was
a logical use for the.property.
Walter Brown asked if this property has direct access to the By-pass.
Mr. Niblock answered that the By-pass level is higher than the property in
question and therefore does not have direct access.
There being no further questions and no one present opposing the rezoning, the
public hearing was closed.
At this time the Planning Commission returned to the first item for public
hearing to complete action on the requests of the applicants.
The first item for action was the site plan of the Delta Nu House Corporation
of Kappa Alpha Theta Fraternity.
After a brief discussion of the site plan Morton Gitelman made a motion to
approve the cite plan with adequate screening along driveways and property lines.
The second was given by Walter Brown and the motion carried by unanimous vote.
The next action taken concerned the rezoning petition of Inwood Development
Corporation. During a discussion with the members of the Planning Commission
Wade Fincher stated that he had been out to see the property and his feeling
• was that because of the location of the property, directly across from the live
stock barns, the only use for the property is Commercial use.

Roy Clinton told the Commission members that it is the duty of the Planning
Commission to protect the By-pass from becomeing a commercial strip, but that
because the Highway Department did grant the property owners access to the
By=pass, each case must be considered on it's own location and merit.
On a motion by Roy Clinton and seconded by Byron Boyd the Planning Commission
approved rezoning of the Inwood Development Corporation property from A-1,
Annexed Territory District to C-2, Thoroughfare Commercial District. The
vote was 6 ayes and 2 nay votes.
WHEREAS, a public hearing was held by the Planning Commission, Tuesday,
January 21, 1969, fifteen (15) days after a sign was erected upon the property
and after a notice had been published in the Northwest Arkansas Times, a news-
paper of general circulation; and
WHEREAS, after the hearing the Planning Commission voted to make a
recommendation to the Board of Directors of the rezoning petition of Ott
Inwood Development Corporation.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE
BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
• SECTION 1. That the petition be approved as to rezoning A-1, Annexed
Territory District to C-2, Thoroughfare Commercial District.
SECTION 2. That an ordinance be adopted for the purpose of rezoning from
A-1, Annexed Territory District to C-2, Thoroughfare Commercial District, the
property described as follows:
A part of the Southeast Quarter (SEJ) of the Southwest Quarter (SWj)
of Section 33, Township 17 North, Range 30 West, of the 5th P.M.,
County of Washington, State of Arkansas, and being more particularly
described as follows, to -wit: Beginning at a point which is 330.00
feet East of the Southwest corner of the above mentioned forty acre
tract, thence North 890 24' East, 91.60 feet, thence North 30° 58'
East, 540.20 feet, thence North 27°32' East 500.90 feet; thence
North 300 58' East, 92.80 feet, thence North 890 45' West, 646.71
feet, thence South 0° 13' West, 583.35 feet, thence South 407.30
