HomeMy WebLinkAbout1968-12-03 Minutes'.1.- 11-(09 MINUTES OF A PLANNING CCMMISSION MEETING • The Planning Commission met at 4:00 p.m., in the Directors' Room of the City Administration Building, Fayetteville, Arkansas. 12/3/68 Members Present: Ernest Jacks, Wade Fincher, Allan Gilbert, Roy Clinton, Byron Boyd, Morton Gitelman, Walter Brown. •J, Members Absent: Clark McClinton, James Mashburn Others Present: Harold Lieberenz, Gerald Fox, Jim Vizzier, Bill Hawkins, Charles Atkinson, Johnie Bassett, Bob Hatfield, Frank Giles, Baas Trumbo, Mr. Perkins. The meeting was called to order by Acting Chairman, Ernest Jacks. The first petition considered by the Planning Commission was from Bill H. Hawkins for rezoning of property on Highway 62 West from A-1, Annexed Territory District to C-2, Thoroughfare Commercial District. Mr. Hawkins was present to represent his request. Mr. Jacks asked Mr. Hawkins what use, if any, was proposed for the property. Mr. Hawkins answered that his plan was to construct an automobile body repair shop: • Mr. Jacks then asked if there was anyone present opposing the request. There being no opposition present and no questions from the Planning Commission members the public hearing was closed. The second public hearing of the meeting was the petition of Johnie Bassett for rezoning of property located at the corner of Highway 16 (Wedington Road) and Giles Road. The zoning change requested is from A-1, Annexed Territory District to C-2, Thoroughfare Commercial District. The Acting Chairman asked if there was anyone present to represent the petition. Mr. Charles Atkinson stated that as attorney for Mr. Bassett he was representing the petition. Mr. Atkinson further stated that Mr. Bassett was present and both he and Mr. Bassett would answer any questions the Commission members asked. Mr. Atkinson answered that the plan was to build and operate an automobile service station on the property. Mr. Gerald Fox, City Manager, stated there would be an over pass on Giles Road to the By-pass and therefore, there would be no access to the By-pass. Mr. Atkinson stated that this would have little affect on the proposed use be- 40 cause the frontage would be of Highway 62. Acting Chairman Jacks asked if there was anyone present wishing to speak. • • - 2 - A member of the audience asked what uses are permitted in C-2, Thoroughfare Commercial District Zoning. Harold Lieberenz, City Building Inspector, read aloud the list of uses permitted in the C-2, Thoroughfare Commercial District. Mr. Ted Williams stated that he and the others in the area were not objecting to the service station, but the people of the area did not want to live around old junked cars, etc., that sometimes accompany a service station. There being no further discussion, the Acting Chairman declared the public hearing closed. The applicant and his attorney left the room. The third rezoning request considered was from William Thurman and Ellie Trumbo for rezoning of property on Leverett Avenue from R-2, Two Family Residential District to R-3, Multi=Family Residential District. Representing the petitioners was their attorney, Bass Trumbo. Mr. Trudbo stated that the proposed use of the property is to construct 6 or 8 apartments on the property and because of the several apartments in the area this proposed use would not conflict with the area's naturse Mr. Trunbo further stated that he and the applicants were aware that a building permit could not be issued for this property until the street on the 3outh side of the property was improved. Mr. Jacks then asked if .there was anyone else present to speak for the petition. No one spoke. Mr. Jacks then asked if there was anyone present opposing this request. congestione. Dodd Daggett stated that he owned the property across Leverett from the property in question and he was opposed to rezoning this property for apartmens because it is his feeling that the added traffic on IAverett would cause even -.: There being no further discussion the public hearing was closed. The next request was from Shirleet Skeith and Clifford Clevenger for rezoning of property on Leverett Avenue from R-2, Two Family Residential District to R-3, Multi -Family Residential District. Presenting the petition was Mr. George Lewis. Mr. Lewis told all present that the proposed plan for the property was construction of a 16 to 20 unit apartment building. Mr. Richard Greer spoke in favor of the rezoning and stated that sewer is available to the property at this time. Mr. Jacks then asked if anyone else wanted to be heard concerning this request. There being no further discussion the public hearing was closed. A, 3 - The fifth petition considered was from Bryce Davis and Company, requesting rezoning of property on Highway 112 North approximately � of a mile from the 0 New By�pass. The zoning change requested is from A-19 Annexed Territory Distrill to Cw2. I The rezoning petition of the Fayetteville Lodge # 1870, Iayal Order of Moose was taken under cinsideration at this time. This request had been tabled from the last meeting. The zoning change requested is from R -1B, Single Family Residential District to C-2, Thoroughfare Commercial District. Bass Trumbo represented the petition. Mr. Trumbo stated that the proposed use of the property is construction of a restaurant by the prospective owner. During a discussion of:the.request Mr. Trumbo stated that at a later date the buyer was considering construction of a motel on the property along with the restaurant. There being no opposition present the public hearing was closed. The minutes of the November 12p 1968, Plannin Camission meeting were approved as mailed on a motion by Roy Clinton and Seconded by Morton Gitelman. At this time the Planning Commission returned consideration to the rozonirm petition of Bill He Hawkins. Dr. Walter Brown stated that there is a land use plan before the Planning Commission zoning request would fit into this plan. James Vizzier, City Planning Consultant, the location is good for commercial use, be to C-1 or C-2. After a brief discussion Walter Brown made a motion to approve the rezoning as requested. PASSED AND APPROVED this 3rd day of December, 1968 Next the rezoning petition of William Thurman and Ellis Trumbo and the petition of Shirleen Skeith and Clifford Clevenger were discussed. (Due to the close distance between these two plots of land the two petitions were discussed jointly, but voting was done on the petition of William Thurman and Ellis Trumbo first and then action was taken on the petition of Shirleen Skeith and Clifford Clevenger.) Jim Vizzier, City Planning Consultant, told the Planning Commission members that • Leverett Avenue would be improved next year and this should ease the traffic problem along the street. Mr. Vizzier further said that just West of the Thurman and Trumbo property was property presently zoned R-3, Multi -Family Residential District. . 6 . PASSED AND APPROVED this 3rd day of December The last rezoning petition acted upon at this meeting was from the Fayettevillz F,odge No. 1870 Loyal Order Roy Clinton asked if the road to the property would have to be paved in order to get a building permit, Bass Trumbo stated that Mr. Perkins, the developer., realized that the paving work would have to be done before the building permit could be iBmisda Dr. Walter Brown asked if it would be acceptable with the developer to leave a buffer zone on the Fast side of the property between the residential property and this property if rezoned commercial, A,4,discussion was hold concerning the amount of land to be left for a buffer zone. Ending the discussion was a motion by Walter Brown to approve rezoning of the Moose Lodge propert;i.e�2;spt for a 75 foot wide strip along the East side of the property to serve as a buffer zone between the residential propertl and the commercial propertye Morton Gitelman gave the second to the motion and the motion was unanimously passed. The final Business was presentation of two (2) Subdivision Plate to the Planning Commission. Harold Lieberenz., City Boilding Inspector,, first presented the preliminary plat of Rockwood Addition and stated there were no major problems concerning this plat. A motion for approval of the Preliminary Plat of Rockwood Addition was made by Roy Clinton and second was given by Morton Gitelman. The motion carried by unanimous The second plat was the final plat considered at this meeting was the Final Rapist of Oaks Manor Addition, S There being no discussion on the plat Morton Gitelman made a motion to approve the replats Roy Clinton gave the second and the motion carried unanimouslyo There being no further business the meeting was adjourned at 6:05 p.m. • x
