MINUTES OF A PLANNING COMMISSION MEETING
• The Planning Commission met at 4:00 p.m., November 12, 1968, in the Board
of Directors' Room of the City Administration Building, Fayetteville, Arkansas.
Members Present: Ernest Jacks, Wade Fincher, Allan Gilbert, Roy Clinton,
James Mashburn, Byron Boyd, Morton Gitelman, Walter Brown,
Members Absent: Clark McClinton
Ridgway,Others Present: Gerald Fox, Harold Lieberenz, Bass Trumbo, I. Boyd

The meeting was called to order by Vice�Chairman Allan Gilbert,
The first item of business was a petition from Mr. I. Boyd Ridgway for rezoning
of his property on Harold Street from R -1B, Single Family Residential District,
to C-2, Thoroughfare Commercial District. The property petitioned for rezoning
is Lots No. 1, 2, 3, and 4 of Block No. 1 in Oakland Hills Addition.
Mr. Trumbo presented to the Planning Commission plans for a shopping center
proposed for property that adjoins the property in question. He stated that
Mr. Ridgway would be the developer of the shopping center and his rezoning
petition was to permit use of the first 4 lots of Blodk No. 1 of Oakland Hills
Addition for ingress and egress to and from the shopping center.
• Mr. Gitelman asked if Lot number 4 was necessary as a part of the shopping
center plans. He felt that if it wasn't, it should be left as R -1B to serve
as a buffer between the Commercial use and the Residential area.
Marvin Eck, a property owner in the area, stated that if the land to be rezoned
was used for parking or some 91mila use, rather than for a large building he
would have no objections to the rezoning,
Mr. Gilbert then asked if there was anyone present opposing the rezoning. There
being no one present in opposition, the public hearing on this rezoning petition
was closed.
The next item of business was the petition of Fayetteville Lodge No. 1870, Loyal
Order of Mooae0 Hass Trumbo. attorney for the petitioner, represented the petition.
The rezoning requested is from R -1B, Single Family Residential District to C-2,
Thoroughfare Commercial District.
Ar. Trumbo introduced Gary Perkins, the buyer and developer of the property, to
the Planning Commission. Mr. Perkins told the Commission Members that he proposed
to build a restaurant on the property, if it is rezoned,

A member of the Commission asked if this would be a public restaurant or a private
• club.
Mr. Perkins answered that the restaurant would be for use by the public, not for
a private group or club.

Mr. Lewis Jones, Attorney for the property owners in the area of the Kappa Alpha
Theta property on Avenue, asked to speak to the Planning Commission.
OrdinanceMr. Jones stated that he was opposed to the public hearing being hold at this
time because the City
not yet gone into effect,
Mr. Tom Gurk, representing the Kappa Alpha Theta Sororitys stated that the architect
for the proposed sorority house had come from Fort Smith for this meeting
and he felt that the Plenni Commission should be able to question the
architect even if the public hearing was hold at a later date,'
Mr. Jones stated that he felt this would prejudice his case and that no form
of hearing should be hold. '
Mr. Gerald Fox., City Manager of Fayettevillep stated that the Planning Commission
should set another date for a public hearing to prevent further difficulties.
Upon suggestion of the City Manager the Planning Commission requested the Planning
Administrator to set a future date for the site plan public hearing.

After some discussion the motion was made by Morton Gitelman and seconded by
Byron Boyd to rezone Lots ls 2. and 3 of Block No. 1 of Oakland Hills Addition,

WHEREAS, a public hearing was held by the Planning Commission,
newspaperNovember 12, 1968, fifteen (15) days after a sign was erected upon the pro�-
party and after a notice had been published in the Northwest Arkansas Times,
W11EREAS, after the hewing the Planning Commission voted to make a re�
commendation to the Board of Directors on the rezoning petition of I. Boyd

SECTION 2. That an ordinance be adopted for the purpose of rezoning
from R -1B, Single Family Residential District to C-2, Thoroughfare Commercial
District, the property described as follows: ,
All of Lots 1, 2, and 3 of Block No. 1, in Oakland Hills Addition to
the City of Fayetteville, Arkansas, all this in Township 17 North
Range 30 West, of Washington County, Arkansas.
• SECTION 3. That the above described property be rezoned from R-lB,
Single Family Residential District to C-2, Thoroughfare Commercial District.
Next the Planning Commission returned consideration to the rezoning petition of
the Fayetteville Lodge No. 1870, Loyal Order of Noose.
CommissionMr. Roy Clinton stated that he felt this 7.45 acres was too large an amount of
land to rezone to C�2, because after the property.is.resoned the ,

Roy Clinton made a motion for the Chairman to appoint a committee to study :,.

Harold Lieberenz, City Building Inspector, presented two (2) subdivision plate
for action by the Planning Commission,
The first plat was the preliminary plat of Eastigate Addition, Mr. Lieberenz
stated that there were only a few minor additionis-and-cli0iges that were needed
and he recommended the Preliminary Plat of Eastgate Addition be accepted.
A motion for approval of the plat of Eastgate Addition, Subject to approval of
the City Building inspector, was made by Morton Gitelman and seconded by Ernest
Jacks. The motion carried un -ani usly.
The last plat for consideration was the Final Plat of Country Club aR*� ae.
On a motion by Morton Gitelman and second by Ernest Jacks the Final Plat of
Country Club Estates was unanimously approved, subject to approval of the City
Building Inspector and the City Attorney.
The meeting adjourned at 5'30 p.m.
