HomeMy WebLinkAbout1968-08-20 MinutesMINUTES OF A CITY PLANNING COMMISSION MEETING • The City Planning Commission met in a meeting at 4:00 P. M., Tuesday, August 20, 1968, in the Board of Directors' Room of the City Administration Building, City of Fayetteville, Arkansas. Members Present: Ernest Jacks, Roy Clinton, James Mashburn, Byron Boyd, Morton Gitelman. Members Absent: Clark McClinton, Wade Fincher, Allan Gilbert, Walter Brown. Others Present: Bass Trumbo, Benny Winborn, Gerald Fox, Harold Lieberenz. The meeting was called to order by Acting Chairman, Ernest Jacks. The first item of business was a petition by Richard Walden and Betty Walden for rezoning a parcel of their property from R-lA, Single Family Residential Distbict to 6 3, Multi -Family Residential District. Mr. Jacks asked if anyone was present to represent the petition. No one was. He then asked if anyone was present to oppose the petition. There was no one present to oppose the petition. The public hearing was closed on the petition. • The second item of business was a petition by Joe B. Cogdell for rezoning his property West of the Washington Fair Grounds from A-1, Annexed Territory District to C-2, Thoroughfare Commercial District. Representing the petition was Bass Trumbo, attorney for Mr. Cogdell. A brief discussion was held, during which the question of use of the land was brought out. Mr. Trumbo stated that a service station was proposed for the property with possibly some excessory use such as a restaurant. There being no further questions the public hearing was closed. Next on the agenda was a preliminary plot review and study of Winwood Sub- division, with Benny Winborn representing it. Mr. Jacks ask if there were anai problems envolved with the plat. Harold Lieberenz, City Building Inspector, stated that there were a few minor problems, but that these could be worked out in the final plat. Mr. Lieberenz,suggested the preliminary plat be approved subject to working out the street paving plans, drainage and water distribution system with t the City Engineer and other minor changes required with the Building I Inspector's Office. Minutes - page 2 8/20/68 • Ending the discussion was a motion for approval of the preliminary plat of Winwood Subdivision subject to approval by the City Engineer of all street paving plans, drainage and water distribution system made by James Mashburn and seconded by Roy Clinton. The motion was carried by unanimous vote. Ll The approval of the minutes of July 16, 1968, July 23, 1968, and August 2, 1968* was next on the agenda. James Mashburn moved that the minutes be approved as mailed and the second was given by Morton Gitb]man. The motion passed unanimously. Acting Chairman, Ernest Jacks, reopened the discussion on the petition of Richard Walden and Betty Walden. The discussion was ended by a motion by James Mashburn to approve the rezoning of the Waldens' property from R-lA, Single Family Residential District to R-3, Multi Family Residential District/ The second was given by Byron Boyd. The motion passed by unanimous vote. Mr. Jacks said that because of the location of the property it would be best to wait on the Planning Commission's decission until after the meeting on September 10, 1968 With the aArkansas Highway Department concerning the location of the By Pass. The motion for the postponement was made by James Mashburn and seconded bj: Morton Gitelman. M., in the Board of Directors' Room of the City Administration Building on certain amendments to the Zoning Ordinance 1239, as amended, Article V. ARKANSAS. SECTION 1. That amendments to Sections 3, 4, and 5 of Article V of Zoning Ordinance No. 1239, as amended (Appendix A, Fayetteville Code of Ordinances.) be considered as detailed below: 1. Article V, Section 3 is amended by adding at the end of subsection 2 the following new subsection: 112.a. Uses Permissible Upon Application to the Planning Commission. Fraternity and Svvority houses, subject tb the follwoing standards and and conditions: a. Density — at least 1,000 sgyare feet of land shall be required for each resident to be housed. b. Open space — no more than 33 1/3 per cent of the lot shall be occupied by the structure. c. Area and bulk — only one (1) principal building shall be located on the site, which shall be subject to the following • requirements: Minutes - page 4 8/20/68 • Minimum depth of front yard 25 feet Minimum depth of rear yard 30 feet Minimum side yard on each side 20 feet Minimum side yard along an intersecting street, except where the site fronts on the side (intersecting) street, in which case the side yard requirements shall be the same as for the front yard . , . . 20 feet d. Off-street parking -- one parking space shall be provided for each resident. e. Other standards and.conditions — in addition to the above standards, the Planning Commission shall consider the follwoing factors in deciding whether to grant the application: (1) Provision of adequate ingress and egress to the parking area. (2) The traffic problems khich may be created by the use. (3) The extent of interference with surrounding land uses. (4) The provision of adequate screening, fencing, or land- scaping to propeet adjacent property, f. Procedures -- any party or parties desiring to make an application under this subsection shall (1) Comply with the fee and public hearing requirements of Article IX (Amendment) of the Zoning Ordinance: and (2) Furnish to the Planning Commission at least 15 days • Prior to the public hearing a site plan sufficiently detailed to show compliance with the above standards and conditions. In the event the application is app approved, no substantial variation from the said site plan may be made without formal approval of a majority of the Planning Commission.,, 2.
