MINUTES OF A CITY PLANNING COMMISSION MEETING
The City Planning Commission met in a special meeting at 4:00 P. M.,
Friday August 2, 1968 in the Board of Directors' Room of the City
Administration Building, City of Fayetteville, Arkansas,
Members Present: Clark McClinton, Ernest Jacks, Wade Fincher, Roy
Clinton, Morton Gitelman, Walter Brown,
Members Absent; Allan Gilbert, James Mashburn, Byron Boyd,
Others Present: Walter Niblock, Dan Maneth, George Plybon, Jack
Burge, Gerald Fox, Sturman Mackey, Harold Lieberenz,
Jim Vizzier.
The meeting was called to order by Chairman Clark McClinton.
The only item of business on the agenda was a petition by Commonwealth
R -F Corporation to rezone their dive -in movie property on Highway 62,
West from A-1, Annexed Territory District to C-2, Thoroughfare Commercial
District.
The Chairman asked if anyone was present to represent the petition. Mr.
Walter Niblock answered that he was the attorney for the Corporation re-
questing the variance. Mr. Niblock then introduced Mr. Maneth, Mr. Plybon,
• and Mr. Burge, who also were representing the Corporation.
Chairman McClinton then asked if anyone was present to oppose the application.
No one was.
Dr. Brown asked why there was a pnbblem concerning the property being
classed as a non -conforming use.
Mr. Niblock answered the question by stating that in case of damage, in
the future, there could be problems and considering the investment involved,
the possibility of such problems could be very costly.
Mr. McClinton thanked the representives of Commonwealth R -f Corporation,
and they were dismissed from the room.
The mom ere of the Commission discussed the application and then Roy
Clinton made a motion to accept the request of Commonwealth R -F
Corporation and the second was given by Wade Fincher. The morion
passed unanimously.

CommissionNext Jim Vizzier asked if the Planning

Department,The members agreed that a meeting of this nature would be helpful and Mr.
Vizzier said he would take the matter up with the Arkansas Highway

WHEREAS, the petition of Commonwealth R -F Corporation, for rezoning
their property from A81, Annexed Territory District to C-2, Thoroughfare
Commercial District.
WHEREAS, at a meeting on Friday, August 2, 1968, the Planning
Commission voted to make a recommendation to the Board of Directors on
the petition to rezone the Commonwealth R -F Corporation property.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION
TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That after the public hearing an ordinance be adopted
for the purpose,of the rezoning of the parcel of real estate described
as follows:
A part of the East half of Section 19, Township 16 North Range
30 West, Washington County , Arkansas, described as beginning
at a point which is 445.7 feet South of the Northwest corner
of the Southwest � of the Northeast j of Section 19, Township
30 West, along the West line of the East j of said Section;
thence North 700 01' East along the South right of way of U. S.
Highway 62, a distance of 187.0 feet, thence North 690 01' East,
• along the South right of way of U. S. Highway 62, a distance of
834.7 feet; thence South 50 34' East 1,110.52 feet; thence West
119.0 feet; thence South 139.77 feet, thence South 800 54' 43"
West 957.52 feet; thence North along the West side of the East
half of Section 19, a distance of 1,033.47 feet to the point of
beginning, containing 25.83 acre/s, more or less.
