The City Planning Commission met in a regular meeting at 4:00 p.m., Kay 7, 1968
in the Directors Room of the City Administration Building, City of Fayetteville,
Arkansas.
',-.embers Present: Ernest Jacks, Wade Fincher, Allan Gilbert, Roy Clinton,
Lorton Gitelman, Walter Brown.
,embers Absent: Clark McClinton, James Mashburn, Byron Boyd,
Others Present: Harold Lieberenz, Ed Gibble, James Powell, Seth Young,
Jim Vizzier, Ed Clement, Vernon Wilson and other interested
persons.
The meeting was called to order by the Vice -Chairman, Allan Gilbert. The
first item of business was a discussion with Kr. Jim Vizzier and the Planning
Commission in regard to an existing street study and land use study. tlr.
Vizzier suggested that a computerized study of the street traffic problem
would be helpful.
Allan Gilbert asked if i.r. Clark McClinton had appointed any committees for
the land use and street study. No one knew of any new committees.
The Planning Commission discussed the possibility of the entire Planning
Commission meeting and going over the studies rather than individual
• committees. The Planning Commission decided that they had rather meet as
a group and go through the study.
Allan Gilbert asked if there was any old business to be brought before the
group. The rezoning request of Mrs. Billie Hunter was brought before the
group. Mrs. Hunter has requested the rezoning of her property on North Leverett
Avenue from R -1B to R-4.
Roy Clinton said that Mr. Haskell Utley who represented the petition in the
Planning Commission Meeting of April 16, 1968, said that a R-3 Multi -Family
Zone would be acceptable. Mr. Clinton said that he had talked to Mr. Utley
and that l;r. Utley agreed that no structure placed 50 feet from the South
property line would 'hurt anything if the R-3 zone was not abused.
Allan Gilbert asked if anyone was present in opposition to this rezoning
request.
D.r. James Powell, 820 Bel -Air Drive, coAnted that he had taken a traffic
survey count at the corner of Poplar and Leverett Streets and on up to
Bel -Air Drive on three different days. He read off the results of his traffic
count and then gave his record of the traffic count t6the Planning Commission.
He said that he would be in favor of the rezoning if the street problem
was corrected. The street problem being that the street is too narrow and
there is no sidewalk for the school children. llr. Powell said that he did not
favor the rezoning.

840 Bel -Air Drive said he opposed the rezoning due to the noise and that is
around apartment houses there was usually a lot of disruptions and that it
• would not be a quiet residential section.
::r. Ed Gibble, 900 Bel -Air Drive, said that the apartment house would devalue
his property.
Allan Gilbert asked for comments from anyone else. Roy Clinton moved that
this rezoning request be continued at the next meeting and that Mr. Utley be
advised of the meeting. jdade Fincher seconded the motion and it was approved
unanimously.
One of the objecting property owners asked -that they be notified of the meeting
so that they could be at the metting.
The minutes of the Planning Commission Meeting held April 16, 1968 were
unanimously approved as mailed, motion by Allan Gilbert and seconded by Roy
Clinton.
The next item of business on the agenda was a petition of Birch Brook, Inc.,
requesting the closing of part of an alley lying midway between Hill Avenue
and University Avenue and extending :'orth from the North boundary of Putman
Street for a distance of three hundred ten (310) feet.
i -:r. Tom Burke represented Birch Brook, Inc. at the meeting.
Allan Gilbert asked if anyone was present who was against the closing of
the alley.
• Kr, Lieberenz stated that the City Engineer felt that it would be a possible
advantage to provide some ten feet utility easements around the outside of
the property.
Mr. Burke said that this could be worked out at a later date.
Roy Clinton moved that the alley be vacated and abandoned on condition that they
work out any needed utility easements with the City Engineer. The motion was
seconded by Ernest Jacks and unanimously approved.

VIHE?EEAS, the petition of Birch Brook, Inc. for vacating an alley was
presented to the Cit; Planning Commission for recommendation.
WHEREAS, at a meeting on Kay 7, 1968, the City Planning Commission voted
to make a recommendation to the City Board of Directors on the petition to
vacate an alley.
Nal, THEREFORE, BE IT RECO141NDED BY THE CITY PLANNING COITiISSION TO THE
BOARD OF DIRECTORS OF THE CITY OF FAYLTTEVILIE, ARKANSAS:
SFCTIOIT 1. That after the public hearing an ordinance be adopted for
the purpose of vacating the public easement described as follotirs:

of Section 16, Township 16, 'Orth, Range 30 West of the 5th P.:`.. thence
three hundred twenty-five (325) feet South; thence hest six hundred twenty-
three and five tenths (623.5) feet to a point of beginning, thence South
• three hundred ten (310) feet to the I:orth boundary line of Putman Street,
thence West ninteen (19) feet nine (9) inches along the boundary line of
Putman Street, thence North three hundred ten.(310) feet, thence East ninteen
(19) feet nine (9) inches to the point of beginning. The real estate
abutting that portion of said alley sought to be vacated is a part of Block
one (1) in Putman's addition to the City of Fayetteville, Arkansas.
SECTIOI: 2. That Birch Brook, Inc. work with the City Engineer to provide
any needed utility easements through their property.

The next item of business was brought ur by I`.r. Jim Vizzier discussing the
reviewing of the City Zoning :Ia�s and comments about City expansion.
During the discussing :r. i'izzier brought out that he had talked with
the Universit;= on their nro-osed expanCion "rogram.
Roy Clinton moved that the meeting be ad�ourned. Wade Fincber seconded the
motion
There being no further business the meeting was ad4ourned.
