The Planning Commission met in a regular meeting Tuesday, November 21,
1967, at 4:00 p.m., in the Directors Room of the City Administration
Building, Fayetteville, Arkansas.
Members present: Roy Clinton, Ernest Jacks, Wade Fincher,
Allan Gilbert, Morton Gitelman and Byron Boyd
Members absent: Clark McClinton, Henry Shreve and James Mashburn
Others present; Mahlon Gibson, J.E. McClelland, John Maguire,
B.A. Shamblin, Roy Guthrie, Pete Estes, Jim
Vizzier, Harold Lieberenz, Gerald Fox and
Irving Eells.
The meeting was called to order by the Acting Chairman, Ernest
Jacks.
Mr. J.E. McClelland, Engineer for the proposed subdivision of
Sherwood Forests Estates was due at another meeting at 4:30,
so it was descided to proceed with the presentation of this
plat first rather than the items on the agenda.

A list of corrections and suggested improvements, as compiled
from the comments of the Utility Companys, the City Street
Superintendent, and the City Engineer, was presented by the
Office of City Planning.
Discussion was held and it was pointed out that although the
curvature of some of the streets did not meet the standards set
by the Subdivision Regulations, the layout is the best that can
be obtained due to the terrain of this piece of property. There-
fore, the Planning Commission could exercise their powers of
variances, as set out in Section V, paragraph A, and accept the
street layout as submitted.
Motion was made by Roy Clinton that the prelim nary subdivision
plat of Sherwood Forests Estates by accepted by the Planning
Commission on.condition of compliance with the corrections spec-
ified by the Office of City Planning, as follows:
1.
Some of the lot dimensions do not scale correctly.
2.
Mr. M.V. Parker Jr., requests a minimum 201 radius
on all
street corners.
3.
Additional utility easements are requested by Arnold Christie,
Arkansas Western Gas Company.
4.
Mr. C.R. Starr, City Engineer, requests the 2�" water line
to loop into the existing line. He also requested
that the
2�?' cast iron water line in Lovers Lane be located
on the east
side of the proposed pavement.

Engineer should contact Mr. M.V. Parker, Jr., City
Street
Superintendent;
A. If unable to reduce the final street grades to
10% grades.
B. About the manner in which the surface drainage
will be
taken care of on the proposed streets, and also in regard
to the size and location of street culverts.

Mr. C.R. Starr has indicated an additional fire hydrant to be
approved as
placed at the South end of Nottingham Place.

On the final plat a RESOLUTION to be signed by the Officers of the
Corporation authorizing the CERTIFICATE OF OWNERSHIP AND DEDICATION,
is to be shown.

Also the final plat is to show a CERTIFICATE verifying the RESOLUTION,
this CERTIFICATE is to be signed by the Secretary and (or) Treasurer of
the Corporation.

The final plat should also show approval by the 'Board of Directors' not
the 'City Council'.
The motion was seconded by Allan Gilbert and approved unanimously.
The next
business was
approval of
the minutes
of the Planning Commission
meeting
of October 10.
These were
approved as
written.
The first rezoning petition to be heard was that of B.A. Shamblin, Agent
for the owners, and Hare Associated, Limited,
Mahlon Gibson, Attorney for the petitioners, presented a plan for the pro-
posed use of this property if the rezoning is approved.
Mr. Gibson explained that Hare Associated, Limited, proposes the construction
and operation of an apartment complex in this area. The primary.plans can
• for 100 family units in 17 buildings with a future expansion of 50 more
family units in 7 more buildings.
The proposed �,•lashington Plaza Apartments are a result of surveys made by
the Federal Housing Administration and Hare Associated, Limited, the re-
sults of which indiacte that there is a real need for housing in the rental
range of the medium income family.
Mr. Gibson pointed out that this complex is not University oriented and
rentals would not be avail'. -able to single men, as this is primarily designed
for working families with bhildren.
The location is ideal for this type of complex as it is adjacent to the
Asbell School property and is near and easily accessible to a shopping
center.
The estimated costs
of the
land and building is
$1,300,000.00, which includes
planned playgrounds
for the
children. The plans
have been approved by FHA.
Mr. Irving Eel -Is of Hare Associated, Limited told the members of the Planning
Commission that the financing for this project would be through the FHA loan
classified as 221D-3 LD. This Company has this type of complex in several
locations and usually have the majority of the units rented ahead of the comp-
letion of construction. The aforementioned survey indicates a market for
three to four hundred units of this type houseing.
• Harold Lieberenz explained that the rezoning of this property would only
be the first step of this project as the complex would have to be approved
by the Board of Adjustment as a group housing project due to insufficient
street frontage for the number of buildings in the. complex.

Gerald Fox,
City Manager,
explained the
requirements for street front-
age
on dedicated
streets.
Mr. Jim Vizzier, City Planning Consultant, pointed out that in the event
the Board of Adjustment refused the 'group housing project', there would
be sufficient area in the development to put in a 50 foot dedicated street
by rearranging the parking space.
Acting Chairman, Ernest Jacks asked if there were any further questions.
Mr. Fox asked if access to Asbell School would be provided in order that
the school children would not have to get out on the streets to get to
school.
Air. Eells said it would.
Mr. Jacks asked if anyone opposed to this rezoning wished to be heard.
No one spoke, so the hearing on this petition was closed.
The rezoning petition of Mr. and Mrs. Roy Guthrie was next to be heard.
Pete Estes, Attorney„for the.,petitioners, presented this petition and
pointed out the location of this property in relation to the Nursing Home.
He asked the property owner, Mr. Guthrie to explain the proposed use.
• Mr. Guthrie, explained his plans to build approximately fifteen small apart-
ments designed primarily for older couples who would appreciate the view,
and quietness of the neighborhood. He said that most of the apartments
and apartment complexes in Fayetteville are built with student rentals in
mind and he has found that generally student couples and the older couples
are not compatible in the same apartment building.
Morton Gitelman asked why the applicant had asked for R-4, instead of R-3
Zoning.
Mr. Estes said he had simply put R-4 on the application since it would
accomplish the purpose in mind. However, he agreed that the R-3 would be
sufficient if this would be more acceptable to the Commission members.
Mr. Guthrie said that due to the grade of this property the plans are to
build a three story building with the middle floor on the ground level and
one flight of stairs down and one flight up.
The Acting Chairman asked for questions or opposition. There was none.
The hearing on this petition was closed.
The rezoning of property owned by Whickerbill, Incorporated was.next to
be heard.
The applicants were not present but it was pointed out that the reason
• for this rezoning request was so that the petitioners could develop this
property as a subdivision. The present A-1 Zoning would require two acre
lots and this size lots in a subdivision would not be feasible.
No one spoke in opposition to this rezoning so this hearing was closed.

The petitioners all left the Directors Room.
• Mr. Jacks, Acting Chairman, asked for the members feelings on the petition
of Mr. B.A.Shamblin and Hare Associated, Limited.
Mr. Fox commented that this is the type of site plan and correct manner
in which the rezoning petitions should be submitted for good development
and planning.
Allan Gilbert moved that the Planning Commission recommend to the Board
of Directors the rezoning from A-1, Annexed Territory District, to R-3,
Multi -family Residential District of property described as follows:
Tract # 1
All of lot four (4) of University Acres Subdivision according to the
plat of said subdivision recorded in the plat book on page 254 in the
Office of the Circuit Clerk and Ex -officio recorder of Washington
County, Arkansas.
Tract # 2
The south 787 feet of lot number six (6) of University Acres Subdiv-
ision according to the plat of said subdivision recorded in the plat
book at page 254 in the Office of the Circuit Clerk and Ex -officio
Recorder of Washington County, Arkansas.
• Tract # 3
All of lot number seven (7) of University Acres Subdivision according
to the plat of said subdivision in plat book at page 254 in the Office
of the Circuit Clerk and Ex -officio recorder of Washington County,
Arkansas, less and except the following described land: Beginning
at the Northwest corner of said lot seven (7) and running thence South
to 160 feet, thence East 66 feet, thence North to the North line of
said lot seven (7), thence West to the point of beginning.
Motion seconded by Morton Gitelman and passed unanimously.
RESOLUTION PC 31-67
WHEREAS, a public hearing was held by the Planning Commission
Tuesday, November 21, 1967, fifteen (15) days after a sign was erected
upon the property and after a notice was published in the Northwest
Arkansas Times, a newspaper of general circulation; and
WHEREAS, after the hearing the Planning Commission voted to make
a recommendation to the Board of Directors on the rezoning petition of
B.A.Shamblin, Agent for the owners, and Hare Associated,- Limited.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION
TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
• SECTION 1. That an ordinance be adopted for the purpose of rezoning
from A-1, Annexed Territory District, to R-3, Multi -family Residential
District, the following described property;

Allan Gilbert moved that the Planning Commission recommend to the Board
of Directors that the petition of Roy C. and Patricia Guthrie, for re-
zoning from R-2, Two Family Residential District, to R-4, Multi -family
Residential and Dormitory District of the property described below be
approved on condition that it be rezoned to R-3, Multi -family Residential
District instead of the R-4 Zone. The motion was seconded by Roy Clinton

eleven (11) in Block two (2), Rochier Heights Addition to the City of
Fayetteville, Arkansas, as per plat of said addition on file in the Office
of the Circuit Clerk, and Ex -officio Recorder of Washington County, Ak-
ansas; also, that land of equal and uniform width lying between Lot one
(1) and Lot eleven (11) Block two (2) of Rochier Heights Addition to the
City of Fayetteville, Arkansas, formerly being that part of Waunettah
Avenue lying between said lots.
SECTION 2. That the above-described property be rezoned from R-2,
Two Family Residential District, to R-3, Multi -family Residential Dist-
rict, so that the petitioners may develop the property for apartments.

On the petition of Whickerbill, Incorporated, Morton Gitelman asked
about the availability of City Utilities in the area.
Mr. Fox explained that City Water is in this area, it will be some time
before the sewer will be available and sanitation pick-up service has
been extended to the area.
Roy Clinton moved that the Planning Commission recommend to the Board of
Directors the rezoning from A-1, Annexed Territory District, to R-lA,
Single Family Residential District, the property described as:
A parcel of land.lying in the south 1/2 0£ the N474 SLd4 of the NES,
NW 1/a o£ the SE4 of Section 12, T -16-N, R-30-14, being morep[�
particularly described as follows: Beginning at a point S 89° 26'

This completed the items scheduled for public hearings and all the applicants
left the Directors Room.
• Roy Clinton asked the Planning Commission to consider rezoning at least
a part of the forty-four (44) acre tract on Crossover Road which had
recently been zoned to C-2, Thoroughfare Commercial Zone.
This tract at the time of rezoning belonged to Clay Yoe, who since that
time has passed away. Mr. Clinton expressed the opinion that should this

property now be sold
the use by someone else, of
this
large a tract of

property,
could be very detrimental to
the
City.
Ernest Jacks, Acting Chairman, asked if there were any other business
to be presented.
Harold Lieberenz presented the final subdivision plat of Harris Addition
for approval. He explained that the preliminary plat had been approved
by the Planning Commission August 22, 1967, and the final plat had been
checked by the Office of City Planning.
Motion was made by Allan Gilbert, seconded by Wade Fincher and passed
unanimously that the Fianl Plat of Harris Addition be accepted as pre-
sented and the Final Plat be forwarded to the City Board of Directors
with the Planning Commission's recommendation of acceptance.
There being no further business the meeting was adjourned.
