HomeMy WebLinkAbout1967-08-22 Minutes• MINUTES OF THE PLANNING COMMISSION MEETING The Planning Commission met in a special meeting Tuesday, August 22, 1967 at 4:00 P.M., in the Directors Room of the City Administration Building, Fayetteville, Arkansas. Members Present: Roy Clinton, Ernest Jacks, Byron Boyd, Henry Shreve and James Mashburn. Members Absent: Allen Gilbert, Clark McClinton, Suzanne Lighton, and Wade Fincher, Others Present: Jim Vizzier, Harold Lieberenz, and 12 interested persons. The meeting was called to order by Acting Chairman, Ernest Jacks. The Acting Chairman said the purpose of the special meeting was to act on the six petitions for rezoning for which public hearing was held on August 15, approve minutes of meetings of July 11 and August 15 and consider the preliminary plat of Harris Addition subdivision. The petition of Evelyn Hills Shopping Center, Inc., was first on the agenda. Mr. Jacks asked for discussion on this petition. is Roy Clinton, Planning Commission member asked Mr. Lewis Jones, attorney for the opponents of this petition, if any attempts at arbitration had been made between the opponents and proponents to perhaps divide the 150' strip of property in question to provide parking space for the shopping center and leave a buffer zone between the commercial and residential properties. Mr. Lewis Jones said it would not be ethical for the opponents to comment on this since the proponents were not present, but that any attempts which may have been made in this behalf had been unsuccessful. James Mashburn, Planning Commission member said he would abstain from voting on the petition as he had previously stated that he would like for the property to be rezoned for commercial use. He expressed the opinion that commercial use would be better than having smaller, less desireable residences constructed on the property. On motion by Henry Shreve, seconded by Roy Clinton, the Planning Commission unanimously voted to deny the petition of Evelyn Hills Shopping Center Inc. for rezoning from R-lA, Single Family Residential District,to C-2, Thoroughfare Commercial District, property described as: A part of the South .half of the Northwest Quarter of the Northwest Quarter of Section ten (10) in Township sixteen (16) North of Range thirty (30) West, described as follows: Beginning at a point three hundred fifty two and nine -tenths (352.9) feet West and twenty-five (25) feet North of the • Southeast corner of said twenty acre tract, and running, thence North six hundred thirty-five (635) feet; thence East one hundred fifty (150) feet, more or less to the West side of the extension of Walnut Avenue in the City (2) of Fayetteville, thence South six hundred thirty five (635) feet; thence • West one hundred fifty (150) feet to the place of beginning, containing two and nineteen hundredths (2.19) acres, more or less. Situated in the unplatted portion of Evelyn Hills Addition to the City of Fayetteville:. WHEREAS, a public hearing was held by the City Planning Commission, Tuesday, August 15, 1967 fifteen (15) days after a sign was erected on the property and after a notice was published in the Northwest Arkansas Times,a newspaper of gen- eral circulation; and WHEREAS, after the public hearing, a quorum for the Planning Commission was present and the Planning Commission voted to make a recommendation to the Board of Directors on the petition of Evelyn Hills Shopping Center, Inc., for rezoning; NOW THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS. SECTION 1. That the petition requesting the rezoning of property described as follows from R-lA, Single Family Residential District, to C-2, Thoroughfare Commercial District, be denied. That an ordinance be adopted for the purpose of rezoning from R-3, Multi -family Residential District, to R-4, Multi -family Residential and Dormitory District, property described as follows: Beinning at a point nine (9) feet North of the Southeast corner of lot fine (15 in Block Seven (7) in I.W. Duncan's Addition to the City of Fayetteville, and running thence West three hundred six feet and eight inches; thence North one hundred twenty-five (125) feet; thence East three hundred six feet and eight inches; thence South one hundred twenty-five (125) feet to the place of beginning. SECTION 2. That the above described property be rezoned from R-3, Multi- family Residential District, to R-4, Multi -family Residential and Dormitory District, so that the petitioner may use the property for multi -family apartment units. Motion was seconded by Roy Clinton, passed unanimously. Mr. and Mrs J. Austin -Parish's petition for rezoning from R-2, Two Family Residential District, to C-1, Neighborhood Commercial District, of one lot 801 x 1501 located on the East side of State Highway 112 and being the first property North of the drive to Oak Plaza Shopping Center, was the next given consideration. Motion was made by Henry Shreve that the Planning Commission recommend to the Board of Directors the rezoning from R-2 to_.0-1, as petitioned, the following described real estate: A part of the Southwest Quarter (SW�) of the Northwest Quarter (NWS) of Section Nine (9) in Township Sixteen (16) North of Range Thirty (30) West, described as follows, to -wit: Beginning at a point which is 750 feet South and 30 feet East of the Northwest corner of said forty acre tract and running thence East 150 feet, thence South 80 feet, thence West 150 feet, thence North 80 feet to the place of beginning. Motion seconded by Roy Clinton and passed unanimously, XXXX RESOLUTION WHEREAS, a public hearing was held by the City Planning Commission, Tuesday, August 15, 1967, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recomm- endation to the Board of Directors on the rezoning petition of J. Austin Parish and Ethel R. Parish. NOW THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That an ordinance be adopted for the purpose of rezoning from R-2, Two Family Residential District, to C-1, Neighborhood Commercial District, the property described as follows: A part of'the Southwest Quarter (SWC) of the Northwest Quarter (NW4) of Section Nine (9), in Township Sixteen (16) North of Range Thirty (30) West described as follows, to -wit: Beginning at a point which is 750 feet South and 30 feet East of the Northwest corner of said forty acre tract, and run- ning thence East 150 feet, thence South 80 feet, thence West 150 feet, thence North 80 feet to the place of beginning. • SECTION 2. That the above described property be rezoned from R-2, Two Family Residential District, to C-1, Neighborhood Commercial District so that the petitioner may develop the property for commercial use. Duggar for rezoning from R -IA, Single Family Residential District, to C-2, Thoroughfare Commercial District, of property located on the East side of Green Acres Road between Gibson's Discount Center and Poplar Street. Motion was made by Henry Shreve that the Planning Commission recommend to the Board of Directors the rezoning from R-lA to C-2, as petitioned, the following described property: A part of the NW� of the SW� of Section 3, Township 16 North, Range 30 West more particularly described as follows, to -wit: Beginning at a point on the North line of said 40 acre tract, which is 370 feet West of the West line of U.S. Highway No. 71, and running, thence South bearing East 350 feet to a point which is 292 feet West of the Center line of said highway, thence in a direct line South bearing east 150 feet to a point which is 210,feet West of the Center line of said Highway No. 71, thence continuing on the same line in a Southeasteriy direction 10 feet, thence South to a point which is 35 rods South of the North line of said 40 acre tract; thence West to the center line of the Old Fayetteville -Springdale Road; thence North along the center of said road to a point on the North line of said 40 acre tract which is 52 rods West of the Northeast corner of said 40 acre tract; thence East to the point of beginning. Motion seconded by James Mashburn and passed unanimously. RESOLUTION PC 24-67 WHEREAS, a public hearing was held by the Planning Commission Tuesday, August 15, 1967, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recom- mendation to the Board of Directors on the rezoning petition of Harold E. Duggar, NOW THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That an ordinance be adopted for the purpose of rezoning from R-lA, Single Famile Residential District, to C-2, Thoroughfare Commercial District the property described as follows: A part of the NWS of the SW4 of Section 3, Township 16 North, Range 30 West, more particularly described as follows, to -wit: Beginning at a point on the (7) Nobth line of said 40 acre tract, which is 370 feet West of the West line of U.S. Highway No. 71, and running, thence South bearing East 350 feet to a point which is 292 feet West of the center line of said highway, thence in a direct line South bearing East 150 feet to a point which is 210 feet West of the center line of said Highway No. 71, thence continuing on the same line in a Southeasterly direction 10 feet, thence South to a point which is 35 rods South of the North line of said 40 acre tract; thence West to the center line of the Old Fayetteville -Springdale Road; thence North along the center of said road to a point on the North line of said 40 acre tract which is 52 rods west of the Northeast corner of said 40 acre tract; thence East to the point of beginning. That the above described property be rezoned from R -IA, Single Family Residential District, to C-2, Thoroughfare Commercial District, so that the pe- titioner may develop the property for commercial use. ATTEST: APPROVED: Ernest Jacks Secretary Clark McClinton Chairman xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx- James Mashburn said he would like to mention again a matter which he had prev- iously brought up concerning the traffic situation on Highway 71 North at the entrance to the Drive -In Theater. He pointed out that traffic is tied up on this United States Highway from both directions while people are waiting to turn into the drive to the theater. Jim Vizzier suggested that the management of the theater be asked to provide space on their property for customers to wait for admittance. On motion bade by James Mashburn seconded by Byron Boyd the minutes for meetings of July 11 and August 15 were unanimously approved with the following correction to the minutes of August 15; Mr. Walter Brown spoke in behalf of Mrs. Richart who owns the property at 1516 Hillcrest. The nest item of business was consideration of.the preliminary plat of Harris Addition Subdivision. Mr. Lieberenz, City Building Inspector, explained that this preliminary plat had been checked by the Office of City Planning and corrections made by the Engineer. James Mashburn moved that the Planning Commission approve the preliminary plat of Harris subdivision seconded by Henry Shreve and approved unanimously. 0 There being no further business, the meeting was adjourned by Mr. Jacks.
