HomeMy WebLinkAbout1967-05-09 MinutesMINUTES OF A PLANNING COMMISSION MEETING The Planning Commission met in a regular meeting Tuesday, May 9, 1967, at 4:00 p.m., in the Directors Room in the City Administration Building, Fayetteville, Arkansas. Members Present: Clark McClinton, Ernest Jacks, Roy Clinton, Allan Gilbert, Wade Fincher, James Mashburn, Members Absent: Henry Shreve, Suzanne Lighton, Byron Boyd, Others Present: Mr. Fox, Mr. J. A. Vizzier, B. A. Shamblin, A. D. McAllister, Mrs. Frank Broyles, Mr. L. D. Berry, Mr. J. P. Fulton, Don Fitzgerald, Mrs. William Norris, Mrs. Crowley, Mr. Carl Springston, Mr. Glen Rose, Mr. Wendell Ward, Mrs. Fowler. The meeting was called to order by Chairman, Clark McClinton. The Chairman re- ported that the purpose of this meeting was to hold public hearings on three petitions for rezoning. The Chairman said the petition filed by Kenneth McKee, Emma G. McKee, Laura Jane Jinske, Zora Lee Thomas, and Mary Carolyn Thomas would be heard first. The petition called for the rezoning from A-1, Annexed Territory, to R-3, Multi -Family Residential District, of Lots 1 through 10 in Block 2 of Parker's Plat of Valley View Acres Add- ition also Lot 3 and the North half of Lot 6 in Evins Farm Addition. The Chairman asked that the proponents be heard and then the opponents. • B. A. Shamblin (203 North College) was present to represent the petitioner. Mr. Shamblin stated that the area was contiguous to R-3, Multi -Family Zoning, already, so in his opinion this would not be spot zoning. This does touch some property zoned R-3 and R-4 which belongs to a man who lives in Little Rock, Arkansas and did not want to join in the rezoning. This manta name was Taylor. The Chairman pointed out that Poplar Street was only 40 feet and that they would need an extra'. 10 feet for street widening. Mr. Shamblin said this would be no problem. The Chairman then asked if there was any opposition on this petition? There was no opposition present to this petition. The next petition was filed by the Phi Mu Alumnae Chapter for the rezoning from R -1h. Single Family Residential District, to P-1, Institutional District, of property located on the North side of Cleveland Street between Sunset Avenue and Hall Avenue. The other petition filed was for the rezoning from R-lA, Single Family Residential District, to P-1, Institutional District, also. This petition was filed by the Delta Nu House Corporation of Kappa Alpha Theta Fraternity. These two petitions were discussed together. Mr. A. D. McAllister (20 East Center) represented the petition for the Delta Nu • House Corporation, Mr. McAllister said that a rezoning of this property provides space for the construction of sorority houses capable of housing women students -2 - and providing off-street parking facilities in a location immediately adjacent to Reid Hall, Hotz Hall, and Fulbright Hall, all high-rise.dormitories for women students. Mr. McAllister reading from the petition submitted, stated that the rem • zoning of this property would provide a district for property controlled by the University of Arkansas and would permit any use of such property considered by the University of Arkansas to be essential for its purposes and requirements. Mr. McAllister said the petitioner has sought to find a location which they felt is congenial with the University. The Chairman asked who represented the petition filed by the Phi Mu Alumnae Chapter. Mrs. Frank Broyles (1525 Hope) represented the petition for the Phi Mu for the rezoning from R -1B, Single Family Residential District, to P-1, Institutional District. Mrs. Broyles said the Phi Mu's has option on the property which is presently owned by Mr. and Mrs; Thomas M. Liles. She said they had been under consideration by the University for a year. The Chairman then asked if there was anyone opposing the petitions. Mr. L. D. Berry (725 Hall) said he was opposed to the petition for several reasons: 1. The people in this area has spent a lot of money and time for their homes. 2. The owners themselves paid for the streets and sewer system. 3. Cleveland already has a serious traffic problem. 4. By rezoning this property it would depreciate the value of the surrounding property. • 5. Hall Street has no sidewalks and the safety of the school children would be involved. 6. The security of the homeowners would be jeopardized. 7. Approval of this would be spot -zoning. 8. It would produce water and drainage problems. Mn Berry said they felt that the University should not be able to bore their way into a peaceful neighborhood and as far as he knows the University does not have the authority to approve or disapprove. Mr. J. P. Fulton (727 Hall) said he was opposed to this petition and if the University does have a say so in this situation then they should be here to do so. Mr. Fulton stated that they were not aware of this until they read it in the paper. Mr. Berry said the people purchased the land around in faith that the Zoning Ordinance would be carried out. Mr. Don Fitzgerald (930 Hall) said his children will be going to school and would be endangered. Mrs. John W. White said she was not a speaker but would like to say she was against the petition. Mr. McAllister said he thought their should be a representive present from the University, and if we are going to have a growing University then we have to make • room for it. -3 - Mrs. William Norris (802 Sunset) said they .now lived at 704 West Maple and that they were being crowded out of there so they were remodeling the home on Sunset hoping they could live there in peace. . Mrs. Crowley said her husband works at the University and that the faculty people have to have a place to live and would prefer the more quite neighborhood. If the zoning is broken down then the people of Fayetteville can not have faith in anything. Mr. Carl Springston (816 Hall) said he wanted to make only one statement on what it will do to homes in the area and that would be to make them undesirable placea to live. Mr. Glen Rose (927 Hall) said they represented all the people around and not dust the people on Hall Avenue. He said the University can take property if they want to, but are neutral in this case. All they want to do is to protect their homes. Mr. C. B. Williams (935 Sunset) said he was not affected by this Building Code because he had been their so long, but if this was permitted to be rezoned what— else could go in there? The Chairman asked if there was anyone present who lived on Cleveland Street? No one was, Mrs. Norma Kennedy (1314 Shadowridge) said as the University grows property will go up and a decision should not be made until the University can be here to speak for themself. • There being no further discussion, the Chairman declared the purpose of the public hearing on the petitions of the Delta Nu House Corporation of Kappa Alpha Theta Fraternity and the Phi Mul Alumnae Chapter having been accomplished, the hearing was closed. After the public hearing, the Planning Commission Members indicated they were ready to make a recommendation on the first petition. Allan Gilbert moved to approve the petition of Kenneth E. McKee, Emma G. McKee, Laura Jane Jinske, Zora Lee Thomas, and Mary Carolyn Thomas for rezoning from A-1, Annexed Territory District, to R-3, Multi -Family Residential District, Lots 1 through 10 in Block 2, all of Block 3 of Parkerts Plat of Valley View Acres Add- ition conditioned upon the owners of Lots 8 through 12 in Block 3 of Parker's Plat of Valley View Acres Addition dedicating to the City of Fayetteville an add- itional ten (10) feet of right-of�way off the South edge of these lots. On motion by Ernest Jacks, seconded by Roy Clinton and passed unanimously the Planning Commission voted to defer action on the two petitions filed by the Delta Nu and the Phi Mu Sororities until a meeting can be set with a representive from the University.
