The City Planning Commission met in a special session at 4:00 p.m.,
• Tuesday, March 28, 1967 in the City Directors Room in the City Administration
Building, Fayetteville, Arkansas,
Members Present: Clark McClinton,,Byron Boyd,.Alaw"ilbert, Wade
Fincher, Ernest acks.
Members Absent: Bryan Walker, Suzanne Lighton, Henry Shreve,

The meeting was called to order by chairman Clark McClinton. The Chairman
reported that the first item on the agenda was the restudy of Charles D.
McNeal's rezoning petition from R-2 Two Family Residential District to R-3
Multi -Family Residential District of Property described as: Part of the
WJ of h* of Section 9, hying South of Lawson Street all in Township 16 North
Range 30 West,
Ernest Jacks pointed out that the minutes of March 21, stated there could be
no building permits issued unless the streets in that area were improved to
meet present standards for construction. Until this was done no one could.
build in this area.
The Chairman said if this was rezoned it would be getting back into a spot
zoning situation, he hoped they could prevent spot zoning if possible.
• There was no one present at this meeting to voice any objection to the
petition also there was no one present to represent the petition either.
After discussion, on motion by Allan Gilbert, seconded by Ernest Jacks, the
Planning Commission unanimously voted to deny the petition of Charles D.
McNeal for the rezoning from R-2 Two Family Residential District'to R-3
Multi -Family Residential District,

WHEREAS, a public hearing was held by the Planning Commission Tuesday,
March 28, 1967, fifteen (15) days agter a sign was erected upon the property
and after a notice was published in the Northwest Arkansas Times, a newspaper
of general circulation; and
WHEREAS, after the hearing the Planning Commission voted to make a
recommendation to the Board of Directors on the rezoning petition of Charles
D. McNeal,
NOW THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE BOARD
OF DIRECTORS OF THE CITY OF FAYETTEVIL.LE, ARKANSAS:
Section 1. That the petition requesting the rezoning of property
• described as follows from R-2 Two Family Residential District to R-3 Multi -
Family Residential District.
Part of the Wj of NW*,,of Section9, T -16-N R -30-W of the
5th Pm M. described as beginning at the N. E. Corner of
said 80 acre tract, thence running South 1140 feet and
thence West 310 feet to the point of beginning, thence
South 190 feet, thence west 110 feet, thence North 190 feet, thence
East 110 feet to the point of beginning.
SECTION 2. The rezoning of the above-described real estate be denied
because to rezone said property would result in spot -zoning.

The petitions of Helen Edmiston and Jere Block were next. Mrs. Edmiston was
present for this meeting, but said she had misunderstood and thought this meeting
was for another rezoning petition she has in this same area that is'bAing rezoned
now.
Mrs. Edmiston was told the petition she was thinking of is scheduled for April 18,
Mrs. Edmiston left the Directors Rdom.
• After discussion on the two petitions filed by Jere Block and Helen Edmiston for
rezoning from R-2 Two Family Residential District and I-lA Light Industrial District
to R-3 Multi -Family Residential District. Allan Gilbert moved that the Planning
Commission recommend to the Board of Directors the rezoning from R-2 To R-3 and
the rezoning from I-lA toIR-3 as petitioned, the following described real estates:

SECTION19 That an ordinance be adopted for the purpose of rezoning
from R-2 Two Family Residential District to R-3.Mult1-Family Residential IJistrict
property described as follows:
All of Lots One (1), Nine (9), and Ten (10) in Block
• Numbered Ten (10) of Parker's Plat of Valley View Acres,
a subdivision to the City of Fayetteville, Arkansas, as
per plat of said subdivision on file in the office of the
Circuit Clerk and Ex=Officio Recorder of Washington County,
Arkansas, and being all that part of Block Ten (10) lying
East of the creek, containing three (3) acres, more or less.

SECTION 2. That the abovd-described property be rezoned from R-2 to
T-3 so that the property may be used for apartments.

The West 48.38 feet of Lots 4 and 9 and all of Lots 5, 6, 7, and
8, all in Block ll -of Parker's Plat of Valley View Acres, a sub-
division to the City of Fayetteville, Arkansas, as per plat of
said subdivision on file in the office of the Circuit Clerk and
Ex -Officio Recorder of Washington County, Arkansas,
SECTION 2. That the above -described property be rezoned from I -la
to R-3 so that the property may be used for apartments.

The motion was seconded by Wade Fincher and passed unanimously&
The minutes of February 7, February 14, were approved as written and mailed
to the members. The minutes of February 28, were approved with the following
correction:
"The petition for rezoning from O-1 Open Land to C2 Thoroughfare
Commercial of property located ftsr h of Stearns Road on the East side of
Highway 71 North. The petition was filed by Johnnie Bassett and
Arthur Skelton."
The minutes of March 21, were approved with the following correction:
• Allan Gilbert Absent at meeting.

passed unanimously.
