The City Planning Commission met in a regular and special session at
• 4:00 p.m., Tuesday, March 21, 1967 in the City Directors Room in the
City Administration Building, Fayetteville, Arkansas.
Members Present: Suzanne Lighton, Wade Fincher, James Mashburn
Members Absent: Clark McClinton, Ernest hacks, #enry Shreve,
Byron Boyd, Allan Gilbert Bryan Walker.
Others Present: Helen Edmiston, Ken Riley, Jem Vizzler, B. A.
Shamblin Robert Lee Curtis, Vine Blumenberg.
The meeting was called to order by vice-chairman Suzanne Lighton who
presided in the absence of the chairman.
Miss Lighton reported that although a gyorm was not present, the public
hearings on the three petitions before the Planning Commission would be
held.
TEe first petition to be heard was that of Charles D. McNeal. The petition
requested the rezoning from R-2 Two Family Residential District to R-3 Multi -
Family Residential District of property described as: Part of the WJ of NWS of
Section 91 lying South of Lawson Street all in Township 16 North, Range 30 West.
B. A. SHAMBLIN represented the petition of Charles D. McNeal. Mr. Shamblin
said there are two buyers who have contracted to purchase this property for the
• purpose of constructing an apartment house of the number of units permitted
by R-3 zoning.
VINE BLUMENBERG said he owns property directly east of the property in
question and could see no reason why this should not be rezoned to R-3 as
far as he was considered he had no objections.
The vice-chairman asked for the opponents to be heard.
ROBERT LEE CURTIS (1413 North Oakland Avenue) said he opposed to this
rezoning because it would result in spot -zoning. Mr. Curtis said he also
objected to apartments going up in this vicinity.
MARGARET BROUWN said hhe lived on the corner of Lawson Street and Oakland
Avenue, and in her opinion this would be a mistake to rezone this to Multi -
Family Residential use because it will be rented to mostly students and this
area is mostly permanently retired piople.
There being no .further discussion, the vice-chairman declardd the purpose
of the public hearing having been accomplished, the hearing on the petition
of Charles D. McNeal was closed.
The second petition heard was filed by Jere Block and Helen Edmiston.
The petitioners requested the rezoning from I-lA Light Industrial District
to R-4 Multi -Family Residential District lots 5, 6, 7, 8, and 48.38' feet
of lots 4 and 9 all in Block 11 of Parker's Plat of Valley View Acres, a
• subdivision to the City of Fayetteville, Arkansas.
HELEN EDMISTON, petitioner, was present. She explained that she and Mr.
Block had requested the zoning change in order to build apartments.
JIM VIZZIER said he would like to point out to Mrs. Edmiston that in a
R -4 -zone dormitories and mobile or trailer homes would also be able to
go in if it were zoned to R-4 whereas in an R-3 sone it would be.a little
more restricted as to the use.
The vice-chairman recommended to change the rezoning to R-3 Multi -Family
Residential District instead of R-4 Multi -Family Residential District.
Mrs. Edmiston said this would be satidfactory with her and Mr. Block.
There were no opponents present.
The next petition filed by Helen Edmiston was heard. Mrs. Edmiston requested
the rezoning from R-2 TWocFamily Residential District to R-4 Multi -Family
Residential District lots. 1, 90 10, in Block to of Parker's Plat of Valley View
Acres, a subdivision to the City of Fayetteville, Arkansas.
MRS. EDMISTON said she would like this petition changed also. Instead of
rezoning to R-4 as originally requested, she would like to rezone from I-lA
to R-3.
There were no opponents present.
Miss Lighton reported the purpose of the public hearings on the petitions
filed by Helen Edmiston and Jere Block having been accomplished, the hearing
was closed.
A quorm not being present, Miss Lighton said all three petitions would be
given further consideration at a special meeting Tresday, March 28, 1967.
• The Planning Administrator read aloud a letter from the City Manager on
zoning and street improvement regulations the letter stated that until a
definite policy statement is prepared by the City Attorney on this matter for
Board of Director's action,/I would request that no clearances for zoning and
building permits be given unless the present street improvement standards be
met in all cases where the streets have been dedicated but not opened for
traffic and no improvement contract filed with the city;/Further, that no
streets will be allowed to be opened or extended unless they meet present
standards for construction. The City Attorney will be asked to prepare suce
regulation at an early date.
Further consideration was given to the requests of Mr. Riley for the restudy of
the area zoned 0-1 Open Land District in the Oakland Hills Addition.
