MINUTES OF THE PLANNING COMMISSION MEETING
The Planning CommiBsion met in a special meeting Tuesday, February 28, 1967 at
4:00 p.m., in the irector's Room of the City Administration Building,
Fayetteville, Arkansas.
Members Present: Clark McClinton, Suzanne Lighten, Ernest Jacks, Wade Fincher,
Allan, Gilbert, James Mashburn, Byron Boyd.
Members Absent: Bryan Walker, Henry Shreve.
Others Present: Arthur Skelton, Mrs. Bob -Stout, Tom Duncan, Larry Wallace,
Ken Riley, C. 0. Nelson, Bill Chaplin, W. 0. Shirley.
The meeting was called to order by chairman Clark McClinton. The chairman said
the purpose of the special meeting was to hold public hearings on 4 petitions
for rezoning.
Chairman Clark Mc Clinton reported the first petition to be heard would be that of
Johnie Bassett for the rezoning from 0-1 Open Land District to C-2 Thoroughfare
Commercial District of property located north of Stearns Road on east side of
Highway 71 North.
Those persons in favor of the petition for rezoning were asked to speak.
Arthur Skelton spoke in behalf of the petitioner and said he was planning to build
an office on the part of his business that being the Ozark Windows Inc., to be able
to do this the property would have to be rezoned to C-2 Thoroughfare Commercial zone.
Chairman McClinton asked the opponents of said petition to speak.
Mrs. Bob Stout (Route 2) said she opposed the petition if it meant rezoning all of
Mr. Bassetts property, but her understanding when she signed the petition Mr. Skelton
took around for the adjacent`property owners to sign was Mr. Skeltons property only
was to be rezoned.
After discussion, on motion by James Mashburn, seconded by Allan Gilbert, the
Planning Commission unanimously voted to recommend to the Board of Directors the
rezoning from 0-1 Open Land District to C-2 Thoroughfare Commercial District of
property particularly owned by Arthur Skelton described as follows:
A part of the SEt, SEk, of Section 23, T -17-N, X=30 W, of the
5th P.M., County of Washington, State of Arkansas, and being
more particularly described as follows, to -wit: beginning at a
point on the last R.O.W. of U. N,Hwy, No. 71, said point of
beginning being 1263.3 feet West and NO0241W, 37.5 feet, from
a Stone marking the SE cor. of said 40, thence NO°241W, along
said R.O.W. 160.0 feet, thence East 167.0 feet, thence S00241E
160.0 feet, thence West 167.0 feet, to the point of beginning.

28,.1967, fifteen (15) days after a sign was erected upon the property and after a
notice was published in the Northwest Arkansas Times, a Newspaper of general

of the 5th P.M„ County of Washington, State of Arkansas
and being more particularly described as follows, to -wit:
beginning at a point on the last R.O.W. of U.S. Hwy. No. 71, said
point of beginning being 1263.3 feet West and NO024'W 37.5 feet,
from a Stone marking the Se cor, of said 40, thence N00241W,
along said R.O.W. 160.0 feet, thence East 167.0 feet, thence
SO0241E 160.0 feet, thence West 167.0 feet, to the point of
beginning.
SECTION 2. That the above-described property be rezoned from Q-1 Open
Land District to C-2 Thoroughfare Commercial District so that the petitioner
may develop the property for commercial use.

The public hearing on the petition of College Club Dairy was next. Chairman
Clark McClinton asked that the proponents and opponents of said petition be
heard. There was no one present at this meeting to voice any objection to the
petition also there was no one present to represent the petitioner either.
After discussion of the petition filed by College Club Dairy for rezoning from
R -1B Single Family;Residential District to I-lA Light Industrial District of
property south of proposed 16 East bypass, Allan Gilbert moved that the Planning
Commission recommend to the Board of Directors the rezoning from RtlB to I-lA,
as petitioned, the following discribed real estate:
Part of the NW�, of the SAL of section 22, T -16-N, R -30-W
described as beginning at a point 395.5 feet East of the NW corner
• of said forty acre tract, and running thence South 1110.0 feet,
thence East 334.5 feet, thence South 21.1 feet to the center of Town

WHEREAS, a public hearing was held by the Planning Commission Tuesday,
February 28, 1967, fifteen (15) days after sign was erected upon the property
and after a notice was published in the Northwest Arkansas Times, a Newspaper
of general circulation; and
WHEREAS, after the hearing, the Planning Commission voted to make a
recommendation to the Board of Directors on the rezoning petition of College
Club Dairy*
SECTION 1. That an ordinance be adopted for the purpose of rezoning
from R4& Single Family Residents to I -JA Light Industrial District property
described as foll9ws:
Part of the NWS, of the SW�, of section:22, T=16 -N. R-30=►,
described as beginning at a point 395.5 Peet East of the Nw Corner
of said forty acre tract, and running thence South 1110.0 feet, thence
East 334.5 feet, thence South 21.1 feet to the center of Twon Branch
thence South 65.05' East 71.8 feet, thence S -59.31'E 155.0 feet,
thence East 61.1 feet, thence South 80.0 feet, thence East 330 feet,
to the East Line of said forty acre tract, thence North 1320.0 feet,

Thomas for rezoning from R-2 Two Family Residential District to LC4 Thoroughfare
Commercial District of property north of Highway 62 and east of Stadium Road.
James Mashburn moved that the Planning Commission recommend to the Board of
Directors the rezoning from R-2 to C-20 as petitioned, the following discribed
real estate;

Further consideratioq.mas given to the petition filed by thi Rolling Hills
Development Corporation for a change of rezoning from R -1B ingle Family
Residential District to R-4 Multi -Family Residential District.
The chairman asked that those present who wished to be heard in regard to the
rezoning petition before the Planning Commission be heard at this time.
KEN RILEY (33.18 Sheryl Avenue) said he felt that Multi -Family development,
while necessary for the sound development of a community, is more logically
poaced closer to areas of work, educational institutions and large shopping
areas to serve as buffers for low density residential development and to
decrease the travel distance for this increased traffic generation,
Neither Sam Rogers, petitioner, nor his attorney, Bill Murphy, wefe present.
• On motion by Susanne Lighton, seconded by Byron Boyd, the Planning Commission
unanimously voted to deny the petition of the Rolling Hills Development
Corporation for the rezoning from RrlB Single Family Residential District to
R-4 Multi -Family Residential District property described as:
Lots five (5) to eleven (11) including a seven (7) feet
off of the Nobth side of Lot 12, all in Block one (1),
Oakland Hills Addition, Fayetteville, Arkansas.

and after a notice was published in the Northwest Arkansas Times, a newspaper

NOW THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE BOARD
OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
• SECTION 1. That the petition requesting the rezoning of property
described as follows from R -1B Single Family Residential District to R-4
Multi -Family Residential District be denied:
Lots five (5) to eleven (11) including a seven (7) feet
off of the North side of Lot 120 all in Block one (1),
Oakland Hills Addition, Fayetteville, Arkansas.
SECTION 2. Th6 rezoning of the above-described real estate be denied
because the real estate was originally zoned for single family residential
purposes and has not been developed enough to justify a R-4 Multi+Family
Residential zoning district.

There being no further business Allan Gilbert moved to adjourn. The motion
was seconded by James Mashburn and passed unanimously.
