The City Planning Commission met in a special session at 4:00 P.M., Tuesday,
October 25, 1966p in the Directors Room in the City Administration Building,
Arkansas,
ErnestMembers present: Suzanne Lighton, ii on GXbert,.,
James Mashburn and Wade Fincher,
Members absent: Clark McClinton, Bryan Walker and Henry Shreve.
Others present: Denver Samples, petitioner; Walter Niblock, attorney for
Dr. Edwin Whiteside; Mrs. Gilbert Morris; Hubert Burch,
attorney; and 8 persons interested in the petitions before
the Planning Commission.
The first request to be hears was that of Basil and Betty Dunn who had petitioned
for the rezoning from R�2 Two Family Residential District
Residential District of 5 lots in Meadowvale SubdhUion of .: City of Fayetteville,
Arkansas. The Vice�chairman asked that the proponents and then the opponents of
the petition be ,:

Mrs, Dunn's mother. She had been requested to attend this public hearing because
both Mr. and Mrs. Dunn were working. Mrs. Morris told the Planning Commission
the request had been made for an R-3 zone so the petitioner could build apartment
buildings upon the lots in question.
The Vice�chairman read aloud the petition which had been filed. Within the
petition were.statements of the petitioner as to why the rezoning was requested
as well as why the change in zoning would not conflict with surrounding land uses.
The Vice-chairman asked for the opponents to be heard. There was no opposition
present. The Planning Commission members •. .. questions. The Vice�chairuan,
purposetherefore, reported the .. the petition of Basil
and Betty Dunn having been accomplished, the hearing was closed.
The second petition before the Planning Commission was filed by Denver
FamilyMr. Samples petitioned for the rezoning of two lots on the south side of Berry
Street from R-lA Single ,: ntial
opponentsDistrict. Vice�chairman Suzanne Lighton declared the hearing open for discussion
and asked that first the.proponents and then the

number of houses on Barry Street and did not think the apartments would be

Doctor Whiteside, Mr. Burch continued, is attempting to rezone a woll plot which
is about'i acre. The changs in the opinion of the opponents would be considered
,as spot zoning. The land involved constitutes what would generally be considered
a residential -size lot. Mr. Burch said he could see no harm in a doctors office,
but he felt the purpose of the zoning was to keep from spotting areas of commercial
next to residential areas,
Mr. Burch pointed out the traffic problem created by the very narrow street. The
people have built lovely modest homes within this area on Millsap (Cemetery) Road
which dead ends at the cemetery to the east. A doctors office would put more
traffic on the street. This street would have to be widened in order to support
more traffic.
W. M. KEETON (1101 Millsap Road) said he would like to add it is his home he
wants to protect. He bought the land from Mrs. Millsap. He did not know about
the type of home the doctor would build, but it is the idea of the commercial
zoning he opposed. Mr. Keeton said he did not know how long the doctor would be
there. Once the doctor left anything could be put on the property within certain
limitations, of course. He mentioned the problems created by J. C. Cox's used
car lot. He said he had worked with the county to put in the road. He felt it
an imposition to make a commercial street out of it.
Dice -chairman Suzanne Lighton asked Mr. Niblock if Doctor Whiteside had contemplated
• applying for an R -P zone. She asked if this zoning classification would met with
the approval of the opponents. The opponents replied they dust did not wish to see
the R -1B zoning classification changed.

There was no further discussion. The ViceIIIIchairman reported the purpose of thz
public hearing having been accomplished, the hearing on Dr. Edwin Whiteside's
petition for rezoning was closed.
The pub:kc hearings had been heMA: on the three petitions for rezoning. The Plan�
-ri-TV Commission members indicated they were ready to make recommendations to the
BoI of Directors on these petitions.

Next, the Planning Commission discussed Denver Samples' petition for rezoning
• from R-lA Single Family Residential District to R-3 Multi -Family Residential
District two lots in South Sunny Acres Addition located in the NW part of
Fayetteville. Allan Gilbert moved to recommend to the Board of Directors that
an ordinance be enacted for the purpose of rezoning from R-lA Single Family
Residential District to R-3 Multi -Family Residential District Lots 7 and 8 of
Block 4 of South Sunny Acres Addition. The motion was seconded by James
Mashburn. Upon roll call the following vote was recorded: Boyd, Mashburn,
Fincher and Gilbert "AYE"; Jacks and Lighton "NAY." There being four "AYES"
and two "MAYS," the Vice-chairman declared the motion carried.

The petition of Dr. Edwin Whiteside for the rezoning from R -1B Single Family
Residential District to C-1 Neighborhood Commercial District of property on
the north side of Millsap Road was discussed. During the discussion James
Mashburn confirmed Roger Alexander's statement that if anyone objected,
Doctor Whiteside dial not wish to pursue the zoning change.
After further discussion, James Mashburn moved to deny Dr. Edwin Whiteside's
petition for rezoning from R -1B Single Family Residential District to C-1
Neighborhood Commercial District property described as: A part of the NE4
of the SEk of Section 26, Township 17 North, Range 30 West, Being more
• particularly described as follows, to -wit: Beginning at a point which is
N 840 East 476 feet from a point in the center line of U. S. Highway No. 71
which is 512.25 feet South of the NW corner of said 40 Acre Tract, and run-
ning, thence N 841 East 190 feet, thence S 040 East 225.75 feet, more or
less, to the center line of the Cemetery Road, thence S 840•West with the
center line of the Cemetery Road 190 feet, thence N 040 West 225.75 feet,
more or less, to the place of beginning. The motion was seconded by Byron
Boyd and passed unanimously. The Planning Commission felt that the land
which was originally zoned for residential purposes has not developed
enough to justify a C-1 Neighborhood Cammiercial zoning district.

WHEREAS, a public hearing was held by the Planning Commission Tuesday,
October 25, 1966, fifteen (15) days after a sign was erected upon the property
and after a notice was published in the Northwest Arkansas Times, a newspaper
of general circulation; and
WHEREAS, after the hearing the Planning Commission voted to make a
recommendation to the Board of Directors on the rezoning petition of
Dr.
NOW, THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE BOARD

OF DIRECTORS OF THE CITY.OF FAYETTEVILLE, ARKANSAS:.
SECTION 1. That the petition requesting the rezoning of property
described as follows from R=1B Single Family Residential District to C-1
• Neighborhood Commercial District be denied:
A part of the NE� of the SEW of Section 26, Township 17 North,
Range 30 West, being more particularly described as follows, to -wit:
Beginning at a point which is N 84° East 476 feet from a point in
the center line of U. S. Highway No. 71 which is 512.25 feet South
of the NW corner of said 40 Acre tract, and running thence N 841
East 190 feet, thence S 040 East 225.75 feet, more or less, to the
center line of the Cemetery Road, thence S-841 West with the center
line of the Cemetery Road 190 feet, thence N 040 West 225.75 feet,
more or less, to the place of beginning.
SECTION 2. The rezoning of the above-described real estate be denied
because the real estate was originally zoned for residential purposes and has
not been developed enough to justify a C-1 Neighborhood Commercial zoning
district.

The Subdivision Committee's report was given.
On motion by James Mashburn, seconded by Ernest Jacks, the Planni 9 Commission
unanimously voted to recommend the preliminary subdivision plat of Ramsey
Addition be.:referred back to the Subdivision Committee for study and recom-
mendation on the desirability of an east -west street within the development.
The informal plat of Hughes Addition located on the north side of North Street
between Shady Avenue and Woolsey Avenue was discussed. On motion by James
Mashburn, seconded by Allan Gilbert, the Planning Commission unanimously voted
to accept the informal plat of Hughes Addition and authorized the Secretary of
the Planning Commission to sign the plat for filing after the following corrections
were made: (1) Five feet be dedicated off the east side of the property for future
widening of Woolsey Avenue, and (2) Ten feet be dedicated off the south side of
the property for future widening of North Street.
The Planning Commission members requested that the question of dedication of
a street by deed be considered at the next meeting.
Wade Fincher moved to adjourn. The motion was seconded by Allan Gilbert and
passed unanimously. The Vice-chairman declared the meeting adjourned.
