HomeMy WebLinkAbout1966-08-02 MinutesMINUTES OF A CITY PLANNING COMMISSION MEETING • The City Planning Commission met in a regular meeting at 4:00 p.m., Tuesday, August 2, 1966, in the Directors Room in the City Administration Building. Members present: Clark McClinton, Ernest Jacks, Byron Boyd, Allan Gilbert and Henry Shreve. Members absent: James Mashburn, Wade Fincher, Bill Dalton and Bryan Walker. Others present: Planning Consultant J. A. Vizzier; City Manager Gerald Fox; and Mr. J. V. Wilson, petitioner. The meeting was called to order by Chairman Clark McClinton. The minutes of July 5. 1966, were approved as written and mailed to the members, I Chairman McClinton said the petition for rezoning filed by Mr. J. V. Wilson would be given further consideration. The Chairman asked Mr. Wilson if he had any information to justify the need to change the property from a residential zone to a commercial zone, if he were prepared to dedicate sufficient right of way for the extension of North Street west to Wedington Drive, and if he had any definite plans on the entrances and exits. • Mr. Wilson stated that he was not sure about the traffic flow into and out of the proposed building site. He said he would, however, work with the City of Fayetteville and the Arkansas State Highway Department to relieve the con- gestion. Allan Gilbert said this was what the Planning Commission wanted --assurance from the property owner that he would work with the Planning Commission. Mr. Wilson spoke about the survey needed to justify the commercial use in that area. Mr. Wilson said he planned a different exclusive shop. The concern would make its own survey. Planning Consultant J. A. Vizzier asked if the proposed use would conform to the requirements of the C-1 zone. Mr. Vizzier pointed out the limits of the C-1 zone. Also, Allan Gilbert read the uses permitted in the C-1 zone from a copy of the zoning ordinance. Mr. Wilson said in his opinion the proposed use would conform. He was satisfied with the commercial (0-1) zone requested in his petition. In regard to the right of way being dedicated, Mr. Wilson said he bought the property on 100% financing and had very little equity. He said he would observe all setback regulations to allow sufficient right of way for a future street. He said he would be willing to sell part of the property back to the City or State at the price he paid for it when North Street was to be extended west. • The Chairman asked if anyone had any more questions. There were no further questions. • It was moved by Allan Gilbert, seconded by Henry Shreve, that the Planning Commission recommend to the Board of Directors the rezoning from R -IB Single Family Residential District to C-1 Neighborhood Commercial District of property described as follows: A part of the SE� of the NE� and a part of the NE� of the SE4 of Section 8 in Township 16 North, Range 30 West of the 5th P.M. and being more particularly described as follows: Beginning at a point 150 feet south of the NE� and running thence North 717 feet along the section line, thence west 349 feet, thence south 10 10' east 567 feet, thence on a line in a southeast direction to the point of beginning, containing 5 acres, more or less, less and except that portion presently embraced in the rights of way of State Highways No. 16 and No. 112, and existing utilities' easements, Washington County, Arkansas. The Chairman requested the voting be done by ballot. Upon count of the votes cast by ballot, there were four AYES" and one "NAY." There being four "AYES" and one "NAY," the Chairman declared the motion carried. RESOLUTION PC 26-66 WHEREAS, a public hearing was held by the Planning Commission Tuesday, July 12, 1966, fifteen (15) days after a sign was erected on the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after further study and consideration, on August 2 the Planning Commission voted to make a recommendation to the Board of Directors on the • rezoning petition filed by J. Vernon Wilson. NOW, THEREFORE, BE IT RECOMENDED BY THE CITY PLANNING COMMISSION TO THE BOARD OF DIRECTORS OF. THE CITY OF.FAYETTEVILLE, ARKANSAS. SECTION 1. That an ordinance be enacted for the purpose of rezoning from R -IB Single Family Residential District to C-1 Neighborhood Commercial District property described as follows: A part of the SE4 of the NE� and a part of the NE� of the SE� of Section 8 in Township 16 North, Range 30 Westcf the 5th P.M. and being more particularly described as follows: Beginning at a point 150 feet south of the NE� and running thence north 717 feet along the section line, thence west 349 feet, thence south 10 10' east 567 feet; thence on a line in a southeast direction to the point of beginning, containing 5 acres, more or less, less and except that portion presently embraced in the rights of way of State Highways No. 16 and No. 112, and existing utilities easements, Washington. County, Arkansas. SECTION 2. That the above-described property be rezoned from RrlB to C-1 so that the petitioner may develop and use the property for commercial purposes. • PASSED AND APPROVED this day of , 1966. The representative of the Planning Office reported that the plat had not been checked to see if it complied with the subdivision regulations because the paper upon which the final plat was drawn was not the white cloth -backed 100% now rag, water resistant paper which was specified in the subdivision regulations. • . _ _ f l.. , .: _ - - 1:61031K021 �.Z, From Ernest Jacks moved to ajourn.
