• MINUTES OF A CITY PLANNING COMMISSION MEETING
The Fayetteville City Planning Commission met in a regular and special session
at 4:00 p.m., Tuesday, June 14, 1966, in the Directors' Room in the City
Administration Building.
Members present: Bill Dalton, Allan Gilbert, Ernest Jacks, Wade Fincher and
Byron Boyd.
Members absent: Clark McClinton, Henry Shreve, James Mashburn and Bryan Walker.
Others present: J. A. Vizzier, Planning Consultant; City Manager Gerald Fox;
and seven persons interested in items to be discussed by the
Planning Commission.
The meeting was called to order by Vice Chairman Bill Dalton. The Vice Chairman
reported that the two public hearings would be held then the regular business
would be considered.
The first public hearing was on the petition of Wayne Bayley for the rezoning
from R -1B Single Family Residential District and R-2 Two Family Residential
District to 0-1 Open Land District of lots 1 through 10 in Block 9 of Parker's
Revised Plat of Valley View Addition. The Vice Chairman declared the hearing on
said petition open for discussion and asked that the proponents be heard first.
• WALTER NIBLOCK, attorney for Wayne Bayley, said the petitioner had requested the
rezoning from R -1B and R-2 to 0-1 so that he could use and develop the property
for a mobile home park. Mr. Niblock briefly told the Planning Commission of the
surrounding land uses and explained what Mr. Bayley proposed for lot area, streets,
lot widths, etc., for the mobile home park. Open spaces would be provided for
play areas, wash areas and similar conveniences for the tenants.
The Vice Chairman asked the opponents to speak. There were no persons present
who voiced any objection to the petitioner's request. The Planning Commission
members had a few comments. They discussed the City's regulations on mobile
home parks.
The Vice Chairman declared the purpose of the public hearing having been
accomplished the hearing on the petition of Wayne Bayley for rezoning was closed.
Next the petition of Wanda and Clay Yoe was given consideration. The Vice
Chairman declared the hearing open for discussion on the petition of Clay and
Wanda Yoe for rezoning from R -1A Single Family Residential District to 0-1 Open
Land District of property described as: The NW,i-, of the IRA14 of Section 12,
and the SW� of the 5-1 of Section 1, and all that part of the NWI of the Sfr7�
of Section 1, lying South of Highway No. 45 East, all in Township 16 North,
Range 30 West,
BASS TRUMBq attorney for petitioners, told the Planning Commission the property
being considered was annexed to the City of Fayetteville during July 1963 and
when annexed it was automatically zoned R -1A Single Family Residential District.
• The land presently is open and undeveloped. It is not the type of land generally
used for residential purposes.
Mr. Trumbo said Mr. Yoe had requested the change as he feels in the future it
• would be easier for example to change the zoning of property from 0-1 Open Land
to a commercial classification than from R-lA Single Family Residential to a
commercial classification. The southern portion may be used for residential
purposes but the northern portion might be more desirable for commercial use.
There is Highway 45 to the north and Highway 265 (Buckner -Braden Road) to the
west. Mr. Trumbo said it was the petitioner's opinion that if later the property
were to be developed for commercial use the present request for a zoning change
would be an intermediate step for future zoning and use.
The Vice Chairman asked the opponents to speak.
RICHARD WALDEN said he did not know that he actually was opposed to the petition.
He said he owned property to the south which is being developed for residential
purposes. Mr. Walden did point out he had no objection if property to the north
were used for commercial purposes, but he was concerned about the use of property
immediately north of his property.
Mr. Trumbo, attorney for petitioner, reported he had talked to Mr. Yoe before
the hearing. Mr. Yoe felt that the southern 40 acre tract could remain R-lA
Single Family Residential District as zoned.
Mr. Walden said if the southern 40 acre tract remained R-lA Single Family
Residential, he would have no objections.
There being no other persons to be heard, the Vice Chairman declared the purpose
• of the public hearing on the petition of Clay and Wanda Yoe for rezoning having
been accomplished, the hearing was closed.
The minutes of May 3, 1966, and June 1, 1966, were approved as written and
mailed to the Planning Commission members.
Discussion was had on the area and bulk regulations for cemeteries and mortuaries
in the 0-1 Open Land District and in the A-1 Annexed Territory District. The
planning consultant quickly summarized the action which had been taken on amend-
ing the zoning ordinance to permit cemeteries and mortuaries within certain zon-
ing districts.
After discussion of the suggested area and bulk regulations for mortuaries in
the 0-1 Open Land District and suggested minimum size of tracts for cemeteries,
the Planning Commission was prepared to make a recommendation. On motiori�by
Ernest Jacks, seconded by Allan Gilbert, the Planning Commission unanimously voted
to recommend there be no minimum lot size for cemeteries in the 0-1 Open Land
District and in the A-1 Annexed Territory District and that ih.the 0-1 zone. uses

following area and bulk regulations:
Minimum Lot Area 1 Acre
Minimum Front Yard 35 Feet
Minimum Rear Yard 50 Feet
Minimum Side Yards 50 Feet

RESOLUTION PC 21-66
• WHEREAS, a public hearing was held by the Planning Commission Wednesday,
June 1, 1966, fifteen (15) days after Resolution PC 18-66 detailing the proposed
amendment to the zoning ordinance was filed with the City Clerk and after a
notice was published in the Northwest Arkansas Times, a newspaper of general
circulation; and
WHEREAS, on June 14 additional consideration and study was given to the
proposed amendment and the Planning Commission voted to make a recommendation
to the Board of Directors.
NOW, THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE BOARD
OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That an ordinance be enacted for the purpose of amending
Article V. Provisions Governing Zoning Districts, Section 14. 0-1 Open Land
District of Ordinance No. 1239, passed and approved June 13, 1960, as amended
by Ordinance No. 1284, passed and approved January 22, 1962, to permit
mortuaries and memorial gardens (cemeteries) within the 0-1 Open Land District;
and
SECTION 2. That Article V. Provisions Governing Zoning Districts,.
Section 14, 0-1 Open Land District of Ordinance No. 1239, passed and approved
June 13, 1960, as amended by Ordinance No. 1284, passed and approved January 22,
1962, be further amended by adding another paragraph to the area and bulk
regulations to read as follows:

Uses involving public assembly and other non-residential
uses
Minimum Lot Area 1 Acre
Minimum Front Yard 35 Feet
Minimum Rear Yard 50 Feet
Minimum Side Yard 50 Feet
SECTION 3. That the ordinance also be for the purpose of amending
Article IV. General Provisions, Section 5. Zoning of Annexed Territory of
Ordinance No. 1239, passed and approved June 13, 1960, as amended by
Ordinance No. 1425, passed and approved November 23, 1964, to permit
mortuaries and memorial gardens (cemeteries) within the A-1 Annexed
Territory District.

• The petition of Earl R. Garrison and Norma L. Garrison for vacating two alleys
in Mountain View Addition was given consideration. A letter from the gas company
was attached to the petition and Mr. Gerald Fox, City Manager, said he had
• received a letter from the power company. Both companies stated they had no
objections to vacating the two alleys. The planning consultant reported
W. C. Smith, Water and Sewer Department Superintendent, was not in his office,
but the City Inspector had checked the maps showing the water and sewer mains.
No mains were shown in these alleys.
Ernest Jacks moved that the Planning Commission recommend to the Board of
Directors that the alleys in Mountain View Addition be vacated as petitioned
by Earl R. and Norma L. Garrison. The motion was seconded by Allan Gilbert
and passed unanimously.
RESOLUTION PC 22-66
WHEREAS, the petition of Earl R. and Norma L. Garrison, husband and wife,
to close alleys in Mountain View Addition to the City of Fayetteville, Arkansas,
was submitted to the Planning Commission for recommendation; and
WHEREAS, at a
meeting on
June 14 the
Planning Commission voted to make a
recommendation to
the Board of
Directors
on said petition.
NOW, THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE BOARD
OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the Board of Directors enact an ordinance for the
• purpose of closing the alleys in Mountain View Addition to the City of
Fayetteville, Arkansas, described as follows:
A 10 foot alley commencing at a point on Company Street between
lots 4 and 5 in Block 2 and running thence North terminating at
Trust Street, and another alley commencing at a point between
lots 7 and 8 in Block 2 and running thence East terminating at
North Sequoyah Drive.

Don Kemp, surveyor, asked for a few minutes in which to discuss the preliminary
subdivision plat of Red Arrow Second Addition. Ralph Goff, principal stockholder
of Red Arrow Land Development Company, Inc., arrived during the discussion.
Mr. Goff filed a copy of the plat with signatures of adjacent property owners.
On motion by Allan Gilbert, seconded by Ernest Jacks, the Planning Commission
• unanimously voted to approve the subdivision plat submitted as the preliminary
plat of Red Arrow Second Addition to the City of Fayetteville provided the
subdivider correct any items required by ordinance and hot shorn on the plat
• after the administrative assistant in the planning office checks the plat
submitted.
The petition of Wayne Bayley for rezoning from R -IB Single Family Residential
District and R-2 Two Family Residential District to 0-1 Open Land District of
Lots 1 through 10 in Block 9 of Parker's Revised Plat of Valley View Addition
was discussed. On motion by Byron Boyd, seconded by Wade Fincher, the Planning
Commission unanimously voted to defer action on Wayne Bayley's petition for
rezoning. The Planning Commission felt the mobile home park regulations
(Ordinance No. 1115) were not up to date and should be revised. The Planning
Commission felt the petitioner might not want to put in the mobile home park
after the ordinance regulating such parks was updated.
The petition of Clay and Wanda Yoe was discussed. On motion by Allan Gilbert
seconded by Byron Boyd, the Planning Commission voted to recommend to the
Board of Directors that the petition of Clay and Wanda Yoe for rezoning from
R-lA Single Family Residential District to 0-1 Open Land District of property
hereinafter described be denied: The NWI, of the NWI, of Section 12, and the
S[1I, of the SWI, of Section 1, and all that part of the NWI, of the SWI, of Section
1, lying South of Highway No. 45 East, all in Township 16 North of Range 30
West; but that consideration be given to rezoning from R-lA Single Family
Residential District to 0-1 Open Land District that portion of the afore-
mentioned propertyand said portion being more particularly described as:
The SWI, of the SWof Section 1, and all that part of the NWI, of the SWI, of
Section 1, lying South of Highway No. 45 East, all in Township 16 North,
Range 30 West; and that the property hereinafter described remain zoned R -1A
• Single Family Residential District: The Nell-, of the NWI, of Section 12 in
Township 16 North of Range 30 Hest. Upon roll call the following vote was
recorded: Boyd, Gilbert and Fincher "AYE" and Jacks "NAY." There being
three "AYES" and one "NAY," the Vice Chairman declared the motion carried.

WHEREAS, a public hearing was held by the Planning Commission Tuesday,
June 14, 1966, fifteen (15) days after a sign was erected upon the property
and after a notice was published in the Northwest Arkansas Times, a newspaper
of general circulation; and
WHEREAS, after the hearing the Planning Commission voted to make a
recommendation to the Board of Directors on the rezoning petition of Clay
and Wanda Yoe, husband and wife.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO
THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the petition of Clay and Wanda Yoe, husband and wife,
for the rezoning from R-lA Single Family Residential District to 0-1 Open
Land District of the following described real estate be denied:
The NWI, of the NWI, of Section 12, and the SWI, of the • SWI, of Section 1, and all that part of the NWI, of the SAI, of Section 1, lying
South of Highway No. 45 East, all in Township 16 North of Range 30 West.

SECTION 2. That favorable consideration be given to enacting an ordinance
for the purpose of rezoning from R-lA Single Family Residential District to 0-1
Open Land District the following described real estate:
The SW� of the SK� of Section 1, and all that part of the NW� of
the SW� of Section 1, lying South of Highway No. 45 East, all in Township
16 North of Range 30 West,
SECTION 3. That the NW� of the NWS of Section 12 in Township 16 North
of Range 30 West remain zoned R -1A Single Family Residential District as it
presently is adjoining property which has been subdivided and is being developed
for residential purposes.
