HomeMy WebLinkAbout1965-11-23 Minutes37 MINUTES OF A CITY PLANNING COMMISSION MEETING • The City Planning Commission met at 4:00 p.m., Tuesday, November 23, 1965, in the City Council Room of the City Administration Building. This was a special meeting. Members present: Bill Dalton, Ernest Jacks, Wade Fincher, Clark McClinton, Allan Gilbert and Bryan Walker. Members absent: J. F. Palmer, Suzanne Lighton and Henry Shreve. Others present: Ralph Goff, petitioner; Bill Murphy, attorney for Ralph Goff; Robert Battenfield of John E. Mahaffey & Associates; Ralph Brophy, petitioner; J. A. Vizzier, planning consultant; Mr. and Mrs. Gerald E. Place; Mrs. M. G. Blatt; and Mr. Glen T. Clayton. On motion by Clark McClinton, seconded by Allan Gilbert, the Planning Commission unAnimnusly voted to appoint Bill Dalton as Chairman pro tempore in the absence of Chairman J. F. Palmer and Vice Chairman Suzanne Lighton. Bill Dalton called the meeting to order. Mr. Dalton explained the purpose of the special meeting is to hold public hearings on two petitions for rezoning. The public hearing was declared open for discussion on the petition of Ralph Brophy for the rezoning from R-lA Single Family Residential District and C-2 • Thoroughfare Commercial District to R-4 Multi -Family Residential and Dormitory District of property on the north side of East Township Road and east of U. S. H hway 71 North. The property is more particularly described as: A part of the SEt of the SW� and the SW� of the SE� of Section 35, Township 17 North, Range 30 West of the 5th P. M., County of Washington, State of Arkansas, being more particularly described as follows: Beginning at the Southeast corner of the SW� of said Section 35, thence West 117.84 feet; thence N 10 24' East, 420.0 feet; thence West 41.7 feet; thence N 0' 12' West, 102.12 feet; thence West, 70.7 feet; thence N Q° 12' West, 259.6 feet; thence East, 86.4 feet; thence N 00 12' West, 528.8 feet; thence East, 157.79 feet; thence South, 77.33 feet; thence South 19° 57' East, 1311.66 feet; thence West, 468.63 feet to the point of beginning. Those persons in favor of the petition were asked to speak. RALPH BROPHY, petitioner, told the Planning Commission that Robert Battenfield of John E. Mahaffey & Associates would explain the proposal. ROBERT BATTENFIELD stated the rezoning had been requested to permit the construction of multi -family apartment buildings and duplexes and to protect the residential property further east presently zoned R-lA from the C-2 commercial zone west of the property requested to be rezoned. Bryan Walker arrived at the meeting. Some of the Planning Commission members questioned the petitioner's request for rezoning the C-2 portion of his property to $-4. The uses proposed by the • petitioner would be permitted in the C-2 zone. • There being no one present to voice any objections to the petition and there being no further discussion, Bill Dalton reported the purpose of the public hearing on the petition of Ralph Brophy having been accomplished, the hearing on said petition was over. The public hearing on the petition of Razorback Tire Mart, Inc., was next. Said petitioner had requested the rezoning from R-lA Single Family Residential District to R-2 Two Family Residential District of property west of Porter Road on Valley Drive. The property is more particularly described as: Lots 10, 11, 12, 30, 31 and 32 in S. T. Russell Subdivision of the City of Fayetteville, Arkansas. Bill Dalton declared the public hearing open for discussion. The proponents were asked to be heard. J. W. MURPHY, attorney, represented the petition of Razorback Tire Mart, Inc. Mr. Murphy pointed out to those present the area in question protrudes into the county; therefore the adjacent property to the north, west and south is not zoned. Mr. Murphy stated the plans of Razorback Tire Mart, Inc., were: -to build duplexes for student housing upon the six lots in question and to connect the duplexes onto sanitary sewer by means of a pump. The area is undesirable for septic tanks. Also, plans are being made to blacktop the rest of Valley Drive and to blacktop West End Avenue and to develop the property to the west before annexing the property to the City of Fayetteville. The opponents were asked to be heard. • GERALD A. PLACE - 2463 Valley Drive - spoke for the residents on Valley Drive. He felt the residents who live on the east end of Valley Drive had not been properly notified. Valley Drive is not open or passable on the west end where the sign had been erected; therefore persons living on the east end were not aware of the requested zoning change in time to protest. Mr. Place filed a petition with the Planning Commission to request the rezoning from R-lA to R-2 of lots in S. T. Russell Addition as petitioned by Razorback Tire Mart, Inc., be denied. GLEN T. CLAYTON - 244.8 Wedington Drive - said he owned lot 13 on Valley Drive but lives in the county on Wedington Drive. He stated the change in zoning would not affect him as much as it would the people on Valley Drive. He felt his neighbors (owners of lobs 7, 8 and 9) would have been present to object to the request for rezoning if they had seen the sign. MRS. GERALD A. PLACE -2463 Valley Drive - asked if multi -family units were proposed to the west. Mr. J. W. Murphy replied yes. GERALD A. PLACE -2463 Valley Drive - inquired if duplexes devaluated single family residential property as had been reported upon numerious occasions. J. A. VIZZIER, planning consultant, said not necessarily. He pointed out it is not what is done, but how it is done. MRS. M. A. BLATT - 2453 Valley Drive - and others were concerned about the appearances of the duplexes. • Both J. W. MURPHY and RALPH GOFF assured those present their intentions were to build and maintain desirable rental units. Mr. Murphy said Warren Segraves, a local architect and member of the corporation, would be responsible for designing the units. The landscaping and maintenance of buildings and yard would be done by the owners. • There was no further discussion. Bill Dalton reported the purpose of the public hearing having been accomplished, the hearing on the rezoning petition of Razorback Tire Mart, Inc., was over. RALPH BROPHY returned to the meeting to inform the Planning Commission he had no objections to the portion of his property zoned C-2 Thoroughfare Commercial remain- ing as presently zoned. On motion by Allan Gilbert, seconded by Ernest Jacks, the Planning Commission voted unanimously to recommend to the City Council that the petition of Ralph Brophy for the rezoning from R-lA Single Family Residential District and C-2 Thoroughfare Commercial District to R-4 Multi -Family Residential and Dormitory District of property hereinafter described be denied, but favorable consideration be given to enacting an ordinance to rezone that portion of aforementioned property zoned R-lA-Single Family Residential District from R-lA Single Family Residential District to R-4 Multi-Fami]y Residential and Dormitory District: A part of the SE� of the SW -,1, and the SW� of the SEy of Section 35, Township 17 North, Range 30 Sdest of the 5th P.M., County of Washington, State of Arkansas, being more particularly described as follows: Begin- ing at the SE corner of the SWC of said Section 35, thence West 2.17.84 feet; thence N 10 24' East, 420.0 feet; thence West 41.7 feet; thence N 01 12' West, 102.12 feet; thence West 70.7 feet; thence N 00 12' West, 259.6 feet; thence East, 86.4 feet; thence N 0' 12' West, 528.8 feet; thence East, 157.79 feet; thence South, 77.33 feet; thence South 190 57' East, 1311.66 feet; thence West, 468.63 feet to the point of beginning. RESOLUTION WHEREAS, a public hearing was held by the Planning Commission Tuesday, November 23, 1965, fifteen (15) days after a sign was erected on the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, a quorum of the Planning Commission being present after said public hearing, the Planning Commission voted to make a recommendation to the City Council on the petition of Ralph Brophy for rezoning. NOW, THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION 1. That the petition of Ralph Brophy for the rezoning of property as described in Section 2 hereof from R-lA Single Family Residential District and C-2 Thoroughfare Commercial District to R-4 Multi -Family Residential and Dormitory District be denied. SECTION 2. That favorable consideration be given to enacting an ordinance for the purpose of rezoning that portion of the following described property presently zoned R-lA from R-lA to R-4: • A part of the SE� of the SW� and the SW� of the SE! of Section 35, Township 17 North, Range 30 West of the 5th P. M., County of Washington, State of Arkansas, being MO. 1 more particularly described as follows: Beginning at the Southeast corner of the SW� of said Section 35, thence West 117.84 feet; thence N 10 24' East, 420.0 feet; thence West 41.7 feet; thence N 01 12' West, 102.12 feet; thence West, 70.7 feet; thence N 0° 12' West, 259.6 feet; thence East 86.4 feet; thence N 0° 12' West, 528.8 feet; thence East, 157.79 feet; thence South, 77.33 feet; thence South 19° 57' East, 1311.66 feet; thence West, 468.63 feet to the point of beginning. SECTION 3. That the portion of the property described in Section 2 hereof zoned C-2 Thoroughfare Commercial remain C-2 as zoned. SECTION 4. That said R-4 multi -family zoning of the above-described property is desirable between the commercial zone to the west and the single family residential zone to the east. PASSEDOV.: The petition of Razorback Tire Mart, Inc., was discussed. On motion by Allan Gilbert, seconded by Bryan Walker, the Planning Commission unanimously voted to recommend to the City Council the rezoning from R-lA Single Family Residential District to R-2 • Two Family Residential District property described as follows: Lots 10, 11, 12, 30, 31 and 32 in S. T. Russell Subdivision of the City of Fayetteville, Arkansas. The Planning Commission further recommended the petitioner connect the duplexes proposed onto sanitary sewer and that the streets—Valley Drive and West End Avenue -- be opened and blacktopped. That an ordinance be adopted for the purpose of rezoning from R-lA Single Family Residential District to R-2 Two Family Residential District as • petitioned property described as follows: 41 Lots 10, 11, 123 30, 31 and 32 in S. T. Russell Subdivision of the City of • Fayetteville, Arkansas, SECTION 2. That the petitioner do certain items which the petitioner alleged to do. These items are: a. Connect the proposed structures onto sanitary sewer; and b. Open and blacktop the streets Valley Drive and West End Avenue. PASSED AND APPROVED this .2&cday of i nAe, J , 1965. The Planning Consultant presented a map of the annexed territory along Highway 16 East. The Consultant reported a survey had been made on land use. The map was now ready for a meeting of the Zone Revision Committee of the Planning Commission and the Planning Committee of the City Council for discussion of proposed zoning of said area. The Planning Office's clerk reported Kay and Richard Coger had requested permission • to build upon property on the south side of Zion Road east of U. S. Highway 71 North, The property (14.6) acres) had been subdivided and the final plat had been approved by the Planner Commission; however the final plat had not been presented to the City Council for acceptance because Richard and Kay Coger had neither installed the improvements nor signed a subdivider's contract for said improvements. The subdividers are willing to sign the contract for the improvements provided permits may be issued to them to build upon lots 2 and 3 of Block 3 of proposed Sunnydale Addition to the City of Fayetteville. On motion by Allan Gilbert, seconded by Wade Fincher, the Planning Commission unanimously voted to authorize the issuance of building permits for construction of two residences on property on the south side of Zion Road described as: A parcel of land lying in the West # of the West J of the West J of the Southwest � of Section 24, Township 17 North, Range 30 West, being more particularly described as follows: Beginning at a point 1964.0 feet North and 75 feet East of the SW corner of the SW� of said Section 24, thence East 193.4 feet; thence S 210 04' West, 128.60 feet; thence West 147.2 feet; thence North 120.0 feet to the point of beginning; and to be referred to as proposed Lot 2 and Lot 3 of Block 3 of Sum�ydale Addition; and the issuance of the permits be conditioned upon Kay and Richard Coger signing the subdivider's contract. Wade Fincher discussed with the Planning Commission members a petition for rezoning property on the west side of U. S. Highway 71 North and north of Longview Drive for commercial purposes.
