HomeMy WebLinkAbout1965-11-09 MinutesMINUTES OF A CITY PLANNING COMMISSION MEETING • The City Planning Commission met in a special session at 4:00 p.m., Tuesday, November 9, 1965, in the City Council Room in the City Administration Building. Members present: J. F. Palmer, Bill Dalton, Allan Gilbert, Ernest Jacks, Wade Fincher, Clark McClinton and Henry Shreve. Members absent: Bryan Walker and Suzanne Lighton. Others present: J. A. Vizzier, planning consultant; Clyde McClintock; Herbert L. Storthz, petitioner; and Walter Niblock, attorney for petitioners. Chairman J. F. Palmer called the special meeting to order. Chairman Palmer reported that the purpose of the meeting was to hold a public hearing on the petition of A. T. Parker and Hazel E. Parker, husband and wife, and Herbert L. Storthz for the rezoning from R-lA Single Family Residential District to R-4 Multi -Family Residential and Dormitory District of property described as the south half of Lot 5 of Evin's Farm. Chairman Palmer declared the public hearing open for discussion and asked that those present who wished to speak in favor of the petition to be heard. Walter Niblock, attorney for petitioners, told the Planning Commission that the petitioners desired to rezone property from R -1A Single Family Residential,,District to R-4 Multi -Family Residential and Dormitory District so that multi -family units • could be built upon the property in question. Ernest Jacks asked why the R-4 zone was requested instead of the R-3 if property would not be used for dormitories. In reply to the question Mr. Stbrthz said the plans for the apartment units had not be finalized when he filed the petition; therefore he was unable to determine the number of family units. After comparing the uses permitted in the R-4 zone with those permitted in the R-3 zone, Mr. H. Storthz felt the R-3 zoning district more suitable and more desirable for the property in question and the adjacent properties. The petitioner said 1 1/2 off-street parking spaces were proposed per apartment unit and two bedrooms were planned for each unit. The Chairman asked those who were opposed to the petition for rezoning be heard. There was no one present to voice their objection to the petition. It was reported no correspondence or telephone inquiries had been received by the Planning Office. There being no further discussion, Chairman Palmer reported that the purpose of the public hearing on the petition of A. T. Parker and Hazel E. Parker, husband and wife, and Herbert L. Storthz, having been accomplished, the hearing was over. On motion by Allan Gilbert, seconded by Ernest Jacks, the Planning Commission unanimously voted to deny the petition of A. T. Parker and Hazel E. Parker, husband and wife, and Herbert L. Storthz for the rezoning from R-lA Single Family Residential District to R-4 Multi -Family Residential and Dormitory District of property described as: The South Half of Lot 5 in Evin's Farm as designated • upon the recorded palt of said subdivision on file with the Ex -Officio Recorder. and Clerk of Washington County Circuit Court, containing 5 acres, more or less; but voted to recommend to the City Council the rezoning of afore -described Residentialproperty from R-lA Single Family Residential District. 41 RESOLUTION PC 24-65 WHEREAS, a public hearing was held by the Planning Commission, Tuesday, November 9, 1965, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing as a quorum was present, the Planning Commission voted to make a recommendation to the City Council on the petition of A. T. Parker and Hazel E. Parker, husband and wife, and Herbert L. Storthz, for rezoning. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION 1. That the petition of A. T. Parker and Hazel E. Parker, husband and wife, and Herbert L. Storthz for the rezoning of property as described in Section 2 hereof from R-lA Single Family Residential District to R-4 Multi -Family Residential and Dormitory District be denied. SECTION 2. That favorable consideration be given to enacting an ordinance for the purpose of rezoning from R -1A Single Family Residential District to R-3 • Multi -Family Residential District property described as follows: The South Half of Lot Five (5) in Evin's Farm, as designated upon the recorded plat of said subdivision on file with the Ex -Officio Recorder and Clerk of Washington County Circuit Court, containing 5 acres, more or less. SECTION 3. That said R-3 multi -family zoning of the above-described property is more desirable for the use to which the property will be put. PASSED AND APPROVED this day of 1965. APPROVED: J. There were other items of business given consideration by the Planning Commission after the public hearing. The preliminary subdivision plat of WOODLAND PARK ADDITION as filed by Clyde McClintock was discussed. Mr. McClintock was present to discuss with the Planning Commission his subdivision plat. • On motion by Bill Dalton, seconded by Wade Fincher, the Planning Commission voted unanimously to approve the preliminary subdivision plat of WOODLAND PARK ADDITION 33 provided the following items are complied with: • 1. Date be shown on the preliminary plat; 2. Water main (16 inch) to the west be shown on the plat; 3. Additional easement requested by gas company and telephone company south of lots 5 and 6 and north of lot 7, all lots being in Block 2, be shown; 4. Streets are to be given names; 5. Easements are needed for location of proposed sewer and/or water mains across other properties; 6. Signatures of adjacent property owners are to be obtained on the plat and submitted as evidence that said property owners have had the opportunity to see the preliminary plat; 7. Error in legal description to be corrected; 8. North-South street to be relocated in northeasterly direction and to connect with Knerr Drive. A few lots will have to be redesigned. 9. Access to be assured to the west. Clark McClinton arrived at the meeting. Richard Walden's final subdivision plat of JOHN SMYTH ADDITION was given consideration by the Planning Commission. Mr. Walden had complied with almost - all the requirements of the Planning Commission upon approving the preliminary subdivision plat. Allan Gilbert moved that the Planning Commission approve the final subdivision plat of JOHN SMYTH ADDITION subject to the following: • 1. Street name (Lover's Lane) be shown on the final plat; 2. Dimensions of lots be shown; 3. 50 -foot right-of-way be dedicated to the City of Fayetteville by deed from William Carter for street purposes; and once the above requirements are met and upon entering into a contract for improvements, the final plat be submitted to the City Council with the recommend- ation the final plat of JOHN SMYTH ADDITION be accepted. The motion was seconded by Wade Fincher and passed unanimously. Henry Shreve arrived at the meeting. The site plat of proposed M. 0, Ramay Junior High School was submitted to the Planning Commission for review, recommendation and approval of the location. The new junior high school location was a 40 acre tract south of Stone Street and west of Sang Avenue. After discussion, during which it was pointed out the location of the junior high school had earlier been given consideration by the Planning Commission but without formal approval, Allan Gilbert moved that the Planning Commission approve the use of property described as the Southwest Quarter of the Southwest Quarter of Section Seventeen (17) in Township Sixteen (16) North, Range Thirty (30) West, containing Forty (40) Acres, more or less, for location of new junior high school building. The motion was seconded by Wade Fincher and passed unanimously. is RESOLUTION PC 25-65 WHEREAS, the building site plan for proposed M. 0. Ramay Junior High 34 School was submitted to the Planning Commission for review in accordance with Arkansas law on City Planning; and WHEREAS, the City Planning Commission at a special meeting Voted to make .mm. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the use of property described below for a new junior high school be approved: The Southwest Quarter of the Southwest Quarter of Section 17 in Township 16 North, Range 30 West, containing Forty (40) Acres, more or less. PASSEDi APPROVEDY day of/IL1965* • Chairman Palmer summarized the action taken by the Planning Commission and the City Council on the petition of Jerry Sweetser in which a request was made for the rezoning of property on the NW corner of Gregg Avenue and North Street from R -IB Single Family Residential District to C-2 Thoroughfare Commercial District, The Chairman felt the Planning Commission was well represented as 7 of the 9 members were present; therefore he suggested action be taken by the Planning Commission on Jerry Sweetser's petition for rezoning. Clark McClinton moved that the Planning Commission rescind action taken on the petition of Jerry Sweetser on October 12, 1965, and recommend to the City Council that an ordinance be enacted for the purpose of rezoning the east 150 feet of p property described hereinafter from R -1B Single Family Residential District to R-3 Multi -Family Residential District and the remaining property to the west be rezoned from R -1B Single Family Residential District to C-2 Thoroughfare Commercial District: A part of the SE4 of the NW} of Section 9, Township 16 North, Range 30 West, more particularly described as beginning at a stone at the SE corner of said 40 acre tract and running thence North 350 feet; thence West and parallel with South line of said 40 acre tract to the East line of right-of-way of St. Louis -San Francisco Railway thence Southwesterly along said East line of right of way to the South line of said 40 acre tract, or to a point due West of beginning; thence East to the point of beginning, containing 3 acres, more or less, except a 30 foot strip off the South end for public road, also except a 30 foot strip off the East side for public road. The motion was seconded by Allan Gilbert and upon roll call, the following vote was recorded: Fincher, Gilbert, Dalton and McClinton "AYE; Jacks "NAY"'and Shreve "ABSTAINED." There being four "AYES," one "NAY" and one • "ABSTAINING," the Chairman declared the motion had passed. 35 • RESOLUTION PC 26-65 WHEREAS, on Monday, October 25, 1965, the petition of Jerry Sweetser for rezoning and the recommendation makde by the Planning Commission October 12, 1965, (Resolution PC 23-65) on said petition was referred back to the Planning Commission by the City Council for further study; and WHEREAS, at a regular meeting on Tuesday, November 2, 1965, the Planning Commission further discussed with interested persons said petition for rezoning but made no recommendation; and WHEREAS, at a special meeting Tuesday, November 9, 1965, the Planning Commission voted to make a recommendation to the City Council on Jerry Sweetser's petition for rezoning. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE CITY COUNCIL OF THE CITY OF FAYETTEVILIE, ARKANSAS, SECTION 1. That former action taken by the Planning Commission as set out in Resolution PC 23-65 be rescinded; SECTION 2. That the petition of Jerry Sweetser for the rezoning from R -1B Single Family Residential District to C-2 Thoroughfare Commercial District of • property as described in Section 3 hereof be denied; SECTION 3• That favorable consideration be given to enacting an ordinance for the purpose of rezoning from R -1B Single Family Residential District to R-3 Multi -Family Residential District the east 150 feet of the property described hereafter and for the purpose of rezoning the remainder of said property from R -1B Single Family Residential District to C-2 Thoroughfare Commercial District. A part of the Southeast Quarter (SEk) of the Northwest Quarter (NWS ) of Section 9, Township 16 North, Range 30 West, more particularly described as begin- ning at a stone at the Southeast corner of said 40 acre tract and running thence North 350 feet; thence West and parallel with South line of said 40 acre tract to the East line of right-of-way of St. Louis - San Francisco Railway thence Southwesterly along said East line of right-of-way to the South line of said 40 acre tract, or to a point due West of beg nines; thence East to the point of beginning, containing 3 acres, more or less, except a 30 foot strip off the South end for public road, also except a 30 foot strip off the East aide of public road.
