HomeMy WebLinkAbout1965-03-23 MinutesMINUTES OF A CITY PLANNING COMMISSION MEETING • The Fayetteville Planning Commission met in the City Council Room in the City Administration Building at 4:00 p.m., Tuesday, March 23, 1965• Members present: J. F. Palmer, Bryan Walker, Bill Dalton, Allan Gilbert, Clark McClinton, Ernest Jacks and Wade Fincher. Members absent: Suzanne C. Lighton and Henry Shreve. Others present: J. A. Vizzier, Planning Consultant; Bill Bequette; Philip Bashor; E. R. Moore, his wife and his daughter. The meeting was called to order by Chairman Palmer. The Chairman reported that the purpose of the meeting was to hold a public hearing to hear and consider three petitions for rezoning. The first petition to be heard was that of Bill Bequette, Joe Wilson and Argil Bartholomew in which a request was made for the rezoning from R-2 Two Family Residential District to I-lB Light Industrial District of property located in Block 17 and Block 18 of Ferguson's Addition to the City of Fayetteville, Arkansas, and lots 1, 18 and 19 in Block 2 of Wilson -Dunn Addition to the City of Fayetteville, Arkansas. Chairman Palmer asked that those present in favor of the request for rezoning be heard. • Bill Bequette,petitioner, told the Planning Commission that he had petitioned for the rezoning of lots 18 and 19 so that he could build a warehouse -type building and rent offices to a plumbing or an electrical contractor. When he submitted his petition, it was suggested that the property owner to the north be contacted (Argil Bartholomew) and asked to join the petition. Since the petition before the Planning Commission had been filed, Bill Bequette said he had purchased lot 1 of Block 2 in Wilson -Dunn Addition from Joe Wilson. Mr. Bequette stated that the rezoning and the proposed building had nothing to do with any extension of the livestock yard. A change in zoning had been requested so as to protect the residential property to the south of the livestock yard. There were no persons present who wished to voice any objection to the request, nor were any petitions filed objecting to the change in zoning. Chairman Palmer reported that a portion of the public hearing had been acomplished and that the public hearing for the petition of Bill Bequette, Joe Wilson and Argil Bartholomew was over. The request for a change in zoning of a lot on the East side of Wood Avenue from R-2 Two Family Residential District to R-3 Multi -Family Residential District was considered next. The Chairman asked that those present at the hearing who wished to speak in favor of the petition do so. • Mrs. E. R. Moore stated that a change in zoning was requested so that the car port attached to their residence on Wood Avenue could be converted into a beauty shop. A petition with the signatures of the neighborhs of the Moore Family was filed with the Planning Com=issim. The petition stated that the property owners had no 132 objection to the conversion of the car port into a beauty shop. • There were no objections to the request of E. R. Moore made known at the public hearing. Chairman Palmer reported that the public hearing on the petition of E. R. Moore for a change in zoning was over. The last petition for which a public hearing was called was the petition of the Planning Commission for the rezoning of all of lot 11 in Park Village Addition except the west 15 feet. The request was for the rezoning from R-2 Two Family Residential District to C-2 Thoroughfare Commercial District of this portion of lot 11 for the purpose of keeping property owned by one person and operated for commercial use in a C-2 Thoroughfare Commercial District. Philip Bashor, 3 West Trenton Boulevard, said he had talked to his neighbors. Some of the neighbors felt that the change was not of any great important and others felt that it should be given a closer look. He and a majority of the persons on the south side of Trenton agreed in Principle'.that the change in zoning does appear to be a correction of the zoning and the changing of a non -conforming use to a conforming use. However, he felt there was no real need as the motel is operated effectively and if the operation is to exist and the present use is to continue there would be no need for a change in zoning. If there is more to the request than clearing up the zoning map and if the use is to be changed, then.there is an important material reason for not changing the zoning from R-2 to C-2. Commercial zone does permit all sorts of uses. The motel as stands does not conflict with the residential character but all other uses • permitted in the C-2 zone would seem to conflict with the residential uses. Mr. Bashor said that in his opinion the oddity in zoning as -it presently is helps to maintain the residential character of the neighborhood. Mr. Bashor filed a petition with the Planning Commission. The petition had signatures of property owners on the south side of Trenton Boulevard. The petition stated that the signers objected to the change in zoning as requested. There being no further discussion on the petition of the Planning Commission, Chairman Palmer declared that the purpose of the public hearing had been acommplished and was over. There was discussion of the petition by the Planning Commission for its request that consideration -be given to the rezoning of part of lot 11 in Park Village Addition. Bryan Walker moved that the Planning Commission by resolution recommend to the City Council that all of lot 11 in Park Village Addition to the City of Fayetteville, Arkansas, except the west 15 feet be rezoned from R-2 Two Family Residential District to C-2 Thoroughfare Commercial District and that said rezoning be for the purpose of including property owned by one person and operated for commercial use in the same zoning classification and thereby correcting an error made in the zoning district map. The motion was seconded by Clark McClinton and passed unanimously. RESOLUTION PC 3-65 • WHEREAS, a public hearing was held by the Planning Commission Tuesday, March 23, 1965, fifteen (15) days after a sign ivas erected upon the property Iia • and after a notice was published in the Northwest Arkansas Times, a newspaper' of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recommendation to the City Council on the rezoning petition of said Planning Commission. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING CONAIISSION TO THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That an ordinance be adopted for the purpose of rezoning from R-2 Two Family Residential District to C-2 Thoroughfare Commercial District all of lot 11 in Park Village Addition to the City of Fayetteville, Arkansas, except the west fifteen (15) feet; and SECTION 2. That said rezoning be for the purpose of including property owned by one person and operated for commercial use in the same commercial zoning classification and thereby correcting an error made in the zoning district map. PALTER, CHAIRMAN After considerable discussion of the request of Bill Bequette, Joe Wilson and Argil Bartholomew, the Planning Commission voted to make a recommendation to the City Council. Bill Dalton moved that the City Council adopt an ordinance for the purpose of rezoning that property presently in an R-2 Two Family Residential District from R-2 Two Family Residential District to I-113 Light Industrial District, said property being described as: Lots 1, 18 and 19 of Block 2 in Wilson -Dunn Addition to the City of Fayetteville, Arkansas; and, ' That portion of Block 17 in Ferguson's Addition to the City of Fayetteville, Arkansas,presently zoned R-2 Two Family Residential District; and That portion being described as beginning at the SE corner of lot 12 of Block 18 in Ferguson's Addition to the City of Fayetteville, Arkansas, thence West to the west line of the Dunn Avenue right of way; thence North along the west line of the Dunn Avenue right of way, 200 feet, more or less, to the zoning district boundary line between the I -1B zone and the R-2 zone; thence East along the zoning district boundary line to the east edge of the lots in Block 18 of Ferguson's Addition; thence South to the point of beginning. • The motion was seconded by Allan Gilbert and passed unanimously. 434 ic'xicicniricicir�rn 't'Yranri�iriri.-.c-mc�cxar.�cv� iFiHh F#'1h3HFin� iciiriri�icxic-iric-icici. iciF • RESOLUTION PC 4-65 WHEREAS, a public hearing was held by the Planning Commission Tuesday, March 23, 1965, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recommend- ation to the City Council on the rezoning petition of Bill Bequette, Joe Wilson and Argil Bartholomew, NOVI,.THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. Moore for the rezoning of his lot on Wood Avenue from R-2 Two Family Residential.District to R-3 Multi -Family Residential District Allan Gilbert moved that the Planning Commission recommend to the City Council that an ordinance be adopted for the purpose of rezoning the property of E. R. Moore from R-2 to R-3 as petitioned. The motion was seconded by Bill Dalton and upon roll Call the following vote was recorded: Dalton, Walker, McClinton, Fincher and Gilbert "AYE" and Jacks "ABSTAINED." There being five "AYES" and ABSTAINING vote the motion passed. RESOLUTION PC 5-65 WHEREAS, a public hearing was held by the Planning Commission Tuesday, March 23, 1965, fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times, a newspaper of general circulation; and WHEREAS, after the hearing the Planning Commission voted to make a recommendation to the City Council on the rezoning petition of E. R. Moore and Jessa Moore, husband and wife. NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That an•ordinance be adopted for the purpose of rezoning • from R-2 Two Family Residential District to R-3 Multi -Family Residential District property described as follows: Part of the NES of the NW4 of Section 22, Township 16 North, Range 30 West of the 5th P.M., being more particularly described as follows: Beginning at the Northwest corner of said 40 acre tract, thence running South 601 feet for the poing of beginning; thence .East 210 feet; thence South 110 feet; thence West 210 feet; thence North 110 feet to the point of beginning, less any part taken up by the Roadway on the west side. SECTION 2. That the above-described real estate be rezoned from R-2 to R-3 so that a beauty shop may be operated as a home occupation by the resident.
