HomeMy WebLinkAbout1965-02-12 Minutes1_�3 MINUTES OF A CITY PLANNING COMMISSION MEETING • The City Planning Commission met in a special called meeting in the City Council Room in the City Administration Building at 4:00 p.m., Friday, February 12, 1965• Members present: J. F. Palmer, Suzanne Lighton, Bill Dalton, Ernest Jacks and Clark McClinton. Members absent: Bryan Walker, Allan Gilbert, Henry Shreve and Wade Fincher. Ch&irman J. F. Palmer called the special session to order. The Chairman reported that the purpose of the meeting was to consider and prepare a recommendation to the City Council on the petition of the Planning Commission for the rezoning from R -1B Single Family Residential District and 0-1 Open Land District to I-2 Heavy Industrial District of property on the south side of Cato Springs Road, Chairman Palmer presented a letter from the Fayetteville Industrial Foundation to the Planning Commission, Fayetteville Planning Commission City Hall Fayetteville, Arkansas Gentlemen: T.he Fayetteville Industrial Foundation hereby requests that its petition for rezoning, previously filed with the Planning Commission, requesting that property on the south side of Cato Springs Road be rezoned from R -IB Single Family Residential District and 0-1 Open Land District to I-2 Heavy Industrial District, be amended to exclude from the area to be rezoned the two lots directly south and across Lorena Lane from Lot 11 marked with an "X" on the attached plat. The Fayetteville Industrial Foundation covenants that no building will be constructed within 100 feet of the east boundary of the property to be rezoned. The Fayetteville Industrial Foundation also requests the Planning Commission to close the following streets lying between Cato Springs Road and Lorena Lane: (1) Price Avenue and (2) Michael Avenue, and to close Town Street which runs between Price Avenue and Michael Avenue, all of the said streets being within the property requested to be rezoned by the Fayetteville Industrial Foundation. These stipulations are made as consideration of the property owners owning homes facing on Laverne Avenue between Cato Springs Road and Lorena Lane consenting to the rezoning as requested. • very truly yours, FAYETTEVITTF INDUSTRIAL FOUNDATION By L. Sells ii >• ETF9 Commission City Hall Rayettevi.1le, Arkansas • Gentlemen: The Fayetteville Industrial Foundation, in addition to the agreements contained in the letter attached hereto, does hereby additionally agree to covenant that no road or street will be opened onto the property to be rezoned that will go over Lots 4, 5, 6 and 8 of Block 4, Meadowlark Addition. Baxter President After a short discussion, Bill Dalton moved that the Planning Commission recommend to the City Council the rezoning from R -1B Single Family Residential District and 0-1 Open Land District to I-2 Heavy Industrial District of the following described property: Part of the MI -14, of the NWw of Section 28, Township 16 North, Range 30 West of the Fifth Principal Meridian, described as follows, to -wit: • Beginning at the Northwest corner of said forty acre tract and running thence South to the Southwest corner of said forty acre tract; 125 • thence East 1,120 feet; thence North 195 feet to the South side of Lot 12 of Block 4 of Meadowlark Addition to the City of Fayetteville, Arkansas; thence East 30 feet to the Southwest corner of Lot 11 of Block 4 of said Meadowlark Addition; thence North 1,125 feet; thence West 1,150 feet to the point of beginning; said rezoning subject to the covenants and agreements as set out in the letter from the Fayetteville Industrial Foundation, signed by Mr. 1. L. Baxter, -its president, and by persons owning homes facing on Laverne Avenue between Caot Springs Road and Lorena Lane, and that the Planning Commission further recommend the vacating and closing of Price Avenue, Micheal Avenie, Town Street and that portion of Lorena Lane west of the east edge of the zoning district boundary line. The motion was seconded by Ernest Jacks and passed unanimously. RESOLUTION PC 2-65 WHEREAS, a public.hearing was held Tuesday, February 2, 1965, by the Planning Commission fifteen (15) days after a sign was erected upon the property and after a notice was published in the Northwest Arkansas Times; and WHEREAS, after a special meeting held Friday, February 12, 1965, the Planning Commission voted to amke a recommendation'to the City Council on the rezoning petition initiated by the Planning Commission. •NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY.PLANNING COMMISSION TO THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION 1. That an ordinance be adopted for the purpose of rezoning from R -1B Single Family Residential District and 0-1 Open Land District to I-2 Heavy Industrial District of the following described property: Part of the NW4 of the NW4 of Section 28, T -16-N, R -30 -W of the 5th P. M., described as follows, to -wit: Beginning at the NW corner of said 40 acre tract .and running thence South to the SW corner of said 40 acre tract; thence East 1,120 feet; thence North 195 feet to the South side of Lot 12 of Block 4 of Meadow- lark Addition to the City of Fayetteville, Arkansas; thence East 30 feet to the SW corner of Lot 11 of Block 4 of said Meadow- lark Addition; thence North 1,125 feet; thence West 1,150 feet to the point of beginning. SECTION 2. That said rezoning be subject to the covenants and agreements stated in the letter from the Fayetteville Industrial Foundation, a copy of which is attached to the petition for rezoning, and stated as follows: (a) Petition for rezoning be amended to exclude from the area to be rezoned the two lots directly south and • across Lorena Lane from Lot 11; (b) No building will be constructed within 100 feet of the • east boundary of the property to be rezoned; (c) No road or street will be opened into the property to be rezoned;that will go over lots 4, 5, 6 and 8 of Block 4, Meadowlark Addition, SECTION 3. That Price Avenue, Micheal Avenue, Town Street and that portion of Lorena Lane west of the east edge of the proposed zoning district boundary line, being streets located within the property requested to be rezoned, be vacated and closed.
