HomeMy WebLinkAbout1963-11-18 Minutes• MINUTES OF A CITY PLANNING COMMISSION MEETING The Fayetteville City Planning Commission met in a special session on Monday, November 18, 1963, in the City Council Chambers in the City Administration Building. Members present: Suzanne Lighton, Bryan Walker, Hugh Stubblefield, Clark McClinton and George Caudle. Members absent: J. F. Palmer, Paul Young, Bill Dalton and Henry Shreve. Harold E. Lieberenz, City Building Inspector, was also absent. Vice chairman Suzanne Lighton called the special meeting to order. The purpose of the meeting was to hold a public hearing for consideration of amending Section 5 "Zoning of Annexed Territory" ARTICLE IV GENERAL PROVISIONS of Zoning Ordinance No. 1239, passed and approved June 13, 1960, to automatically permit newly annexed lands to be zoned O-1 Open Land District instead of R-lA Single Family Residential District. There was no public present to discuss with the Planning Commission the proposed amendment.of the ordinance. Suzanne Lighton questioned the urgency of the need for the amendment under consider- ation as the annexation bill had been defeated at the polls. It was the opinion of the Planning Commission members present that there was no longer an immediate need for such an amendment and with the possibility of professional help being employed, Hugh • Stubblefield moved that action upon the proposed amendment of Section 5 "Zoning of Annexed Territory" ARTICLE IV GENERAL PROVISIONS of Zoning Ordinance No. 1239 be deferred until further study is made and that at such time this study is made Bryan Walker's suggestion be incorporated therein, said suggestion being that petitioners requesting to come into the City of Fayetteville. Arkansas, also petition to be zoned R -IA or 0-1 and that both the petition for annexation and the petition for zoning would be effective at the same time. The motion was seconded by Clark McClinton and passed unanimously. The 45 day period was extended until such time as the Planning Commission works out the details of its study. This extension was done in accordance with Article IX, Section 1, "d" of Zoning Ordinance No. 1239. The vice chairman reported that as a quorum was no present at the public hearing of November 12, 1963, action could not be taken upon the rezoning petitions heard at said public hearing. A quorum being present, the Vice chairman suggested that, if there were no reasons not to act upon the two rezoning petitions, action be taken. Clark McClinton moved that the Planning Commission recommend to the city Council the granting of that rezoning petition of Pearl and Cliff Mills within which said petitioners requested the rezoning from -R-IA Single Family Residential District to C-2 Thoroughfare Commercial District of real estate east off Highway 71 North located between Horton's Service Station and Hudson's Service Station, said rezoning being requested for that portion of real estate not already zoned C-2 and described as follows: Part of the W j of the SW � of Section 3 in Township 16 North of Range 30 • West, described as: Beginning at the Southeast corner of the NW � of the SW � of Section 3 in Township 16 North of Range 30 West, and running thence North 200 feet; thence West 520 feet, more or less, to the east line of the right-ofwway of U. S. PAI Highway No. 71; thence in a southerly direction with the East line of the right-of- way to the South line of the NW � of the SW �; thence East 100 feet; thence South 130 feet; thence East to the East line of the SW � of the SW �; thence North 130 feet to the point of beginning, and also, part of the SW � of the SW � of Section 3 in Township 16 North of Range 30 West, described as follows: Beginning at the point of intersection of the North line of said forty acre tract, and the East line of the right-of�way of U. S. Highway No. 71, thence East 100 feet; thence South 130 feet; thence West to the East line of the said right-of-way; thence in a Northerly direction along the East line of said right-of-way to the point of beginning. The motion was seconded by Hugh Stubblefield and passed unanimously. RESOLUTION PC 21-63 WHEREAS, the City Planning Commission held a public hearing on November 12, 1963, to hear and consider the rezoning petition of Pearl and Cliff Mills within which said petitioners requested the rezoning from R -IA Single Family Residential District to C-2 Thoroughfare Commercial District of their property east off Highway 71 North located between Horton's Service Station and Hudson's Service Station. The rezoning is requested for that portion of the petitioners' property whish is not already zoned C-2. WHEREAS, at the public hearing a quorum was not present; therefore no action could be taken. At a special meeting held Monday, November 18, 1963, action was taken and a recommendation was made by the Planning Commission. • NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the City Council of the City of Fayetteville, Arkansas, take favorable action on the petition for rezoning of Pearl and Cliff Mills and rezone from Rr1A to C-2 that property, as petitioned, which is not already zoned C-2. George Caudle moved that the Planning Commission recommend to the City Council that favorable action be taken on the petition for rezoning of B. E. House, Anthony Latrecchia and Kenneth Cates for the rezoning of real estate east off Highway 71 North immediately south of Fisher Buick Company wherein a request was made for the rezoning of that real estate not already zoned C-2 Thoroughfare Commercial District, and said real estate being described as follows: Part of the Northwest fractional Quarter of Section 3, Township 16 North, Range 30 West, described as: Beginning . at a point 177.23 feet East of the Northwest corner of the East.half of the North- west fractional Quarter of said Section 3, thence East 109.55 feet; thence South 321.1 feet) thence West 340 feet, more or less, to the East line of U. S. Highway 50: 71, thence North 11 degrees East with the East line of said highway to a point • 222.1 feet South of the North line of said Northwest fractional Quarter, thence East 193.05 feet, thence North 0 degrees 25 minutes West 132.2 feet, thence East 18 feet, thence North 89.9 feet to the point of beginning, containing 1.5 Acres, more or less,.and also, part of the East half of the Northwest fractional Quarter of Section 3, Township 16 North, Range 30 West, described as: Beginning at a point 286.78 feet East of the Northwest corner of the East half of the Northwest fractional Quarter of Section 3, thence East 100 feet, thence South 321.1 feet, thence West 100 feet, thence North 321.1 feet to the point of beginning. The motion was seconded by Clark McClinton and passed unanimously. RESOLUTION PC 20-63 WHEREAS, a public hearing was held by the City Planning Commission on November 12, 1963, to hear and consider the rezoning petition of B. E. House, Anthony Latrecchia and Kenneth Cates for the rezoning of property east off Highway 71 North immediately south of Fisher Buick Company. Said petitioners requested that their property not already zoned C-2 Thoroughfare Commercial District. WHEREAS, a quorum was not present at the public hearing, so action could not be taken. At a special meeting on November 18, 1963, the City Planning Commission voted to take action on the petition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY • OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the City Council of the City of Fayetteville, Arkansas, take favorable action on the petition for rezoning of B. E. House, Anthony,- Latrecchia and Kenneth Cates and rezone from R -IA to C-2 that property, as petitioned, which is not already zoned C-2.
