• The Fayetteville City Planning Commission met in a regular session on Tuesday,
November 5, 1963, at 4:00 p.m. in the Municipal Police Court Room in the City
Administration Building.
Members present: J. F. Palmer, Henry Shreve, Hugh Stubblefield, George Caudle,
Bryan Walker and Paul Young. Also present was Walter Niblock, attorney; Harry Lewis;
Mr. and Mrs. Willard Williams and another interested party; and Harold E. Lieberenz,
City Building Inspector.
Members absent: Suzanne Lighton, Bill Dalton and Clark McClinton.
The meeting was called to order by Chairman J. F. Palmer. Mr. Palmer reported that
the matters to be considered by the Planning Commission would not be discussed in
the order shown on the agenda. Mr. Palmer said that the new business would be con-
sidered and Harry Lewist problem would be first.
Walter Niblock, attorney for Harry Lewis, explained Mr. Lewis' problem to the Plan-
ning Commission members. Mr. Niblock said that Mr. Lewis had purchased property
south of Bailey Drive which runs west off Highway 71 South from D. D. Bailey.
Mr. Lewis applied for a building permit which was denied to him by the City Building
Inspector Harold E. Lieberenz, Mr. Niblock requested that the Planning Commission
over rule the City Building Inspector's decision and let Mr. Lewis build his home.
It was pointed out by the attorney that Mr. Lewis had spent a considerable sum upon
the lot and building materials and that Mr. Lewis met all requirements with the
• exception of the required street frontage.
Mr. Niblock said that Mr. Bailey had refused to give an easement for street purposes
and had refused to plat his subdivision as requested by the Planning Commission and
as Mr. Bailey had consented to do.
Mr. Lewis told the Planning Commission that there was a street being used, but the
street was not dedicated. The street is about fifty (50) feet wide in front of his
house. This portion of the street is graded and graveled. The street has been there
for about 1 1/2 years.
Harold Lieberenz, City Building Inspector, said that Walter Niblock had fully ex-
plained the back ground of the problem. Mr. Lieberenz told the Planning Commission
that upon several occasions he had talked to D. D. Bailey but without results.
Paul --Young arrived at the meeting.
It was mentioned that the lot to the south of Mr. Lewis' lot had been sold.
After a short discussion was had, Hugh Stubblefield moved that the Planning Commission
recommend that this north -south street which runs south off Bailey Drive be dedicated
and preferably all the way south to terminate at the south property line, but at
least be dedicated to the south line of Mr. Harry Lewis' lot; after the street is
dedicated then the building inspector be authorized to issue_Mr. Harry Lewis a build-
ing permit. The motion was seconded by Henry Shreve and passed unanimously:
• Bryan Walker moved that the Planning Commission recommend to the City Attorney that
a letter be written to D. D. Bailey and a copy sent to Burl Ramey to caution said

parties about selling off smaller lots from large lots or tracts of land. Paul
Young seconded the motion which passed unanimously.
The lot and building problem of Mr. and Mrs. Willard Williams on McClinton Street
was heard by the Planning Commission. Harold Lieberenz said Marie Starr had come
to his office and applied for a building permit to build a new house behind an
existing house on a lot which had only 35 foot street frontage. According to Marie
Starr she was going to purchase this 35 ft. by approximately 160 ft. lot from
Willard Willams, who in turn had purchased 35 ft. off Lot 11 of Block 1 of McClinton
Addition to the City of Fayetteville from J. J. Curry. Mr. Curry deeded this 35 ft.
off Lot 11 in June, 1963.
After a lengthy discussion was had, Henry Shreve moved that the City Inspector be
authorized to issue a permit to Marie Starr to build a residence upon the 35 -foot
by approximately 160 -foot lot. Hugh Stubblefield seconded the motion which passed
unanimously.
The minutes of October 8, 1963, and October 22, 1963, were approved as mailed to
the Planning Commission members.
The Planning Commission asked Harold E. Lieberenz about the proposed trailer ordinance.
Mr. Lieberenz said he had not had time to work on the ordinance.
Chairman Palmer reported on the meeting of the Planning Committee of the City
Council; William Bonner, Planning Division of the University of Arkansas; Harold E.
Lieberenz, City Building Inspector; Guy E. Brown, Mayor of Fayetteville; and himself.
Arrangements were being made to employ a planner. The Planning Commission members
• felt it a must to speed this process along.
There being no further business, the meeting was adjourned.
