MINUTES OF A CITY PLANNING COh21ISSI0N METING
A special meeting of the Fayetteville City Planning Commission was held at 4:00
p.m. on October.22, 1963, in the City Council Chambers in the City Administration
Building.
Present: Suzanne Lighton, George Caudle, Bill Dalton, Hugh Stubblefield and Clark
McClinton were the Planning Commission members present. Also present were David
Burleson, attorney for the petitioner; Harold E. Lieberenz, City Building Inspector;
Exie Hardy; Bertha and Frank Lewis; R. L. Jeske; and A. P. Eason, Jr.
Absent: Planning Commission members J. F. Palmer, Henry Shreve, Bryan Walker and
Paul Young.
The special meeting was called to order by Vice chairman Suzanne Lighton who presided
in the absence of the Chairman. Miss Lighton reported that the purpose of the public
hearing was to hear and consider the rezoning petition of the First National Bank
who petitioned for the rezoning of real estate on the southwest corner of West
Dickson Street and University Avenue from R-4 Multi -Family Residential and Dormitory
District to C-3 Central Commercial District.
The Vice chairman declared the public hearing open for discussion and that those
parties who favored the rezoning would first be given an opportunity to be heard.
David Burleson, attorney, presented the petition of the First National Bank.
• Mr. Burleson said that this 189 ft. by 101.25 ft. lot has been contracted to lease
from Exie Hardy by the First National Bank. This lease is conditional upon the re-
zoning of said real estate. The rezoning is -,requested so that the petitioner may
construct and operate a drive-in or branch bank on the property.
Mr. Burleson said that the proposed change in zoning would not conflict with sur-
rounding land uses. Across University Avenue to the east is the C-3 Zone and from
this point the C-3 Zone extends north across West Dickson Street. Kappa Sigma is
located immediately west. Mr. Burleson said he had heard.no objections from Kappa
Sigma. To the north in the northeast corner of Arkansas Way and West Dickson Street
is the Lutheran Church.
A letter from Herbert A. Lewis, Chairman of the Board of the First National Bank,
was read by Suzanne Lighton. Mr. Lewis stated in the letter that the building pro-
posed would be similar to that one recently completed at Evelyn Hills Shopping Center.
The entire lot would be paved and well marked on and off streets as well as both
drive-in lanes. Mr. Lewis said that Lutheran Church would be permitted to use the
lot for parking on Sunday.
Mr. R. L. Jeske, representative of the St. Johns Lutheran Church, was present to
make it known that the church had no objections and.heartily approved the extra
parking space.
Mr. Frank Lewis who lives at 115 South Church Avenue and owns the property at 717
West Dickson Street (west of Kappa Sigma) said he had no objections to the rezoning.
• The Vice chairman asked if there were any present to be heard.who opposed the rezoning.
There was no one present. There being no further discussion, Suzanne Lighton reported
that the purpose of the public hearing having been accomplished, the hearing was over.

Bill Dalton moved that the Planning Commission recommend to the City Council
• that the real estate known as 703 West Dickson Street and more particularly
described below be rezoned from R-4 Multi -Family Residential and Dormitory District
to C-3 Central Commercial District. The motion was seconded by Hugh Stubblefield
and passed unanimously. The real estate is described as: A part of the Southeast
Quarter (SE,) of the Northwest Quarter (NW4) of Section Sixteen (16), Township 16
North, Range 30 West described as follows: Beginning at a point which is 434 feet
West of the Northeast corner of said 40 acre tract, and running thence West 101.25
feet; thence South 189 feet; thence East 101.25 feet to the West line of University
Avenue; thence North with the West line of University Avenue 189 feet to the Place
of beginning; subject to the location of Dickson Street which encompasses approximately
42 -feet of the North end of said lot.

VIHEREAS, a public hearing was held by the City Planning Commission on October 22,
1963, to hear and consider the rezoning petition of the First National Bank of
Fayetteville, Arkansas, within which said petitioner requested the rezoning from
R-4 Multi -Fang Residential and Dormitory District to C-3 Central Commercial
District of real estate located at 703 West Dickson Street; and
I•1HEREAS, after the public hearing, the Planning Commission voted to take action
upon the petition.
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
SECTION 1. That the Planning Commission recommends to the City Council that
favorable consideration be given to the petition of the First National Bank of
Fayetteville, Arkansas, in which a request was made to rezone real estate located at
703 YTest Dickson Street from R-4 Zone to C-3 Zone.

Harold E. Lieberenz, City Building Inspector, explained to the Planning Commission the
suggestion of the Mayor and several aldermen which was that the zoning ordinance
(Ordinance No. 1239) be amended so that newly annexed areas would automatically be
zoned 6-1 Open Land rather than R-lA Single Family Residential District. The Building
Inspector reported that he understood that the City Attorney Bass Trumbo had checked
and found that there is nothing in the state law which requires that newly annexed
areas be zoned R -1A. The Planning Commission considered the suggestion but felt that
• more study should be given.
The problem of A. P. Eason, Jr., was introduced to the Planning Commission by Harold
E. Lieberenz, City Building Inspector. Mir. Eason was also present. Mr. Lieberenz
explained that Mr. Eason's builder, James A. Pennington, had come into the city
• inspector's office and requested a building permit to build a house on unplatted
real estate located at the end of Crest Drive south of Holland Addition to the City
of Fayetteville, Arkansas. Mr. Lieberenz continued by stating that according to
the Subdivision Ordinance No. 1245 V. ADP?INISTRATION A. Variances, paragraph 3
in his opinion the creation of a new lot could interfere with a future street;
therefore the problem is being brought before the Planning Commission.
Mr. Eason told the Planning Commission members that he did not object to dedicat-
ing a street, but he did not want to do so until he knew what was going to be done
to the property to the south. He said that he wanted to build a house on the east
end of the tract of land.
The Planning Commission discussed with Mr. Eason that if and when there was another
residence built upon the property that he would definitely, in its opinion, have
to dedicate a street but for the time being the street would not have to be
dedicated. Hugh Stubblefield, therefore, moved that the building inspector be
authorized to issue a building permit to Mr. A. P. Eason, Jr., to build a house on
the tract of land at the south end of Crest Drive. The motion was seconded by
Clark McClinton and passed unanimously.
There being no further business, the meeting was adjourned.
