HomeMy WebLinkAbout1963-08-06 Minutes• MINUTES OF A CITY PLANNING COMMISSION MEETING On August 6, 1963, at 3:30 p.m. in the City Council Room in the City Administration Building, the City Planning Commission of Fayetteville, Arkansas.' met in a special meeting. Present: J. F. Palmer, Suzanne Lighton, Bryan Walker, George Caudle, Henry Shreve and Clark McClinton. Several interested parties were also present. Absent: Bill Dalton, Paul Young and Hugh Stubblefield. J. F. Palmer, Chairman, called the meeting to order. The minutes of June 18, 1963 (special meeting), June 27, 1963 (special meeting) and July 5, 1963 (special meeting) were approved as written and mailed to the members. Roy Hillian's lot division problem of property south of Skelton Street was considered by the Planning Commission. Harold E. Lieberenz, City Building Inspector, explained to the Commission members the problem. Mr. Lieberenz said that Mr. Hillian had pur- chased a piece of land 430 feet by 132 feet off Lot 3 of Block 3 of J. W. Skeltonts Subdivision from Mr. Paul Middlebrook. The property does not have any street frontage on a dedicated street; therefore, as explained by the city inspector, a building permit could not be issued. Mr. Lieberenz told the Commission members that a 12 foot easement was presently being used as an access road to the property. Mr. Lee Scott of Kelley Brothers Lumber Company had requested a building permit to build on a lot 115 feet by 132 feet at the northern end of the land Mr. Hillian purchased. The plans, • according to Mr. Lieberenz, were to build on the north part of the property and then later build on the south part. The 12 foot easement would be used as a street. Mr. Lieberenz pointed out that portions of Lot 3 of Block 3 had been sold by Paul Middle Brook to James D. Hall (October 4, 1962 and October 5, 1962); Bessie M. Pinkerton (November 7, 1962); and Roy Hillian (May 21, 1963) and at the time of all sales the property was within the city limits of Fayetteville, Arkansas (annexed April 17, 1961). These sales were recorded in the court house. Paul Middlebrook, Bessie Pinkerton and Mr. Pinkerton, and Roy Hillian were at the meeting. Clark McClinton arrived at the meeting. Suzanne Lighton moved that the Planning Commission recommend to the City Council that the City Council give a preliminary opinion on the dedication of a 40 foot street which would run north and south through'.lot 3 of Block 3 of J. W. Skelton's Subdivision so that the property owner, Roy Hillian, would know whether or not to proceed with the subdivision regulations. The motion was seconded by George Caudle and passed unanimously. Thomas Comley appeared before the Planning Commission with a question concerning the interpretation of the restrictive covenants placed upon property in Bel -Air Acres Second Addition. Mr. Corley wanted an interpretation on the type of construction. The covenants require a brick or brick veneer building; however the front of the apartment buildings are of different materials which he considered as decorative trim. The Planning Commissionts interpretation concurred with that of Mr. Comley; . the different types of material used on the front of the apartment buildings are of a decorative nature. 26 The City Building Inspector submitted drawings on Loy Kinzer's proposed subdivision. • Because the proposed subdivision would be in an 0-1 Open Land District and would abutt railroad property, the City Inspector thought perhaps the Planning Commission would prefer the area be used for industrial purposes. The Planning Commission was in accord with the opinion that the area was much too small for industrial use; therefore the recommendation was made that Loy Kinzer be instructed to proceed with his subdivision. • 0 A lengthy discussion was had on Johnnie Bassett's final subdivision plat of South Sunny Acres. Suzanne Lighton moved that the Planning Commission make the following recommendation to the City Council: Johnnie Bassett's final subdivision plat of South Sunny Acres be approved subject to the dedication of Leland Avenue and Lonnie Avenue to the south line of Mr. Bassett's property which is outside the city limits and which is immediately south of his subdivision of South Sunny Acres. The motion being seconded by Bryan Walker passed unanimously. Harold Lieberenz, City Building Inspector, reported to the Planning Commission that an ordinance was needed on the mobile home amendment to the city zoning ordinance. Mr. Lieberenz said he did not have the time in which to write the ordi. nance. Chairman Palmer referred the wording of the ordinance to the Zone Revision Committee. The Chairman referred Roy Adamst sketch showing a street and lot layout in a proposed subdivision to be located between Vandeventer Avenue and Gregg Avenue south of Hawthorne Street to the Subdivision Committee for study and recommendation. There being no further business, the meeting was adjourned. Date: It is understood by and between the grantors and the grantees herein that the grantors retain for the use of Roy Hillian his heirs or assigns an easement of 12 feet along the East side of said property herein conveyed for the purpose of ingress and egress to land now owned by the said Roy Hillian his heirs or assigns.
