HomeMy WebLinkAbout1963-06-18 MinutesMINUTES OF.A CITY PLANNING COMMISSION MEETING The City Planning Commission of Fayetteville, Arkansas, met in a special meeting on Tuesday, June 18, 1963, at 3:30 p.m., in the City Council Room in the City Administration Building. Present: George Caudle, Hugh Stubblefield, Bill Dalton, Clark McClinton, Bryan Walker and Paul Young. Absent: J. F. Palmer, Suzanne Lighton and Henry Shreve. Both the Chairman and the Vice-chairman were not present; therefore a motion was made by Bryan Walker, seconded by Clark McClinton, to appoint George Caudle to preside over the meeting. The motion passed unanimously. George Caudle, acting as chairman, called the meeting to order. The minutes of June 7, 1963, (regular meeting) were approved as written and mailed to the members. Chairman of the Zone Revision Committee, Bill Dalton, reported on trailer courts. The recommendation of the committee was that Zoning Ordinance No. 1239 be amended to permit mobile homes (trailers) on individual lots and trailer courts in all industrial zones located in the City of Fayetteville: I-lA Light Industrial District, I -1B Light In`- dustrial District and I-2 Heavy Industrial District, without going before the Board of Adjustment as long as the area and setback requirements are met; and that a public hear- ing be held at the earliest possible time. Clark McClinton moved that the recommendation • of the Zone Revision Committee be accepted. The motion was seconded by Bryan Walker and passed unanimously. Bill Dalton said another trailer court problem which needs immediate consideration was that of Roy Quinn. Mr. Dalton explained that Mr. Quinn wishes to enlarge his existing trailer court which is presently located in a R-2 Two Family Residential District. The Zone Revision Committee had discussed the problem. It was the committee's opinion that a resolution should be adopted making known to the City Council the Planning Commission's intention of permitting trailer courts in all industrial zones and the Planning Coni - mission's recommendation that Mr. Roy Quinn be permitted to proceed with his plans of enlarging the trailer court before and while in the process of following the procedure necessary to rezone his property to I-2 Heavy Industrial Zone. A petition with the signatures of property owners owning property abutting Roy Quinnts trailer court on Duncan Avenue was submitted for the Planning Commissionts inspection. The petitioners stated they did not object to the Planning Commission authorizing the use of real estate owned by Mr. and Mrs. Roy Quinn for increasing the side of the present trailer park. RESOLUTION PC 9-63 WHEREAS, the City Planning Commission on June 21, 1962, voted to accept the recommendation of its Zone Revision Committee regarding the location of mobile homes (trailers) on individual lots within the City of Fayetteville, Arkansas; and WHEREAS, no further action was taken at the above-mentioned June 1962 meeting nor was there any public hearing held to amend the ordinance as additional study was to be made of trailer courts; and WHEREAS, at a special Planning Commission meeting on June 18, 1963, the recommend- ation of the Zone Revision Committee regarding trailer courts was Trade and accepted by • the Planning Commission. NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That at the earliest possible time after the necessary notices have been published and the necessary signs erected, a public hearing be held for the purpose of recommending to the City Council that Zoning Ordinance No. 1239 be amended to permit mobile homes (trailers) on individual lots and to permit trailer courts in all industrial zones within the City of Fayetteville, Arkansas: I- IA Light Industrial District; I -1B Light Industrial District and I-2 Heavy Industrial District, PASSED AND APPROVED THIS /YeAday Paul Young arrived at the meeting at this time. After discussion, Bill Dalton moved that the Planning Commission adopt a resolution • recommending that the City Council permit Mr. Roy Quinn to proceed with enlarging his trailer court while in the process of rezoning his property. The motion was seconded by Bryan Walker and passed unanimously. RESOLUTION PC 10-63 WHEREAS, on June 18, 1963, the Planning Commission discussed the trailer court problem.of Roy Quinn who owns and operates a trailer park which he wishes to enlarge. The trailer park is located on Duncan Avenue in a R-2 Two Family Residential Zone within the City of Fayetteville, Arkansas; and WHEREAS, a petition was submitted by persons owning real estate abutting Roy Quinn's Trailer Park and said petitioners stated they had no objections to the increase in size of the trailer park; and WHEREAS, in due time Roy Quinn will petition the Planning Commission and the City Council to rezone his property to I-2 Heavy Industrial Zone; NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS: • WHEREAS, in view of the fact that action is being taken by the Planning Commission (see Resolution PC 9-63) as quickly as possible; and WHEREAS, in due time Roy Quinn will petition the Planning Commission and the City Council to rezone his property to I-2 Heavy Industrial Zone; NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS: • SECTION 1. That the City Council give special and favorable consideration to Roy Quinn's request to enlarge an existing trailer park and that the city building inspector be authorized to issue Mr. Quinn a permit to commence the enlargement of the trailer park. APPROVED:T) J. -F: Harold Lieberenz, City Building Inspector, gave the Subdivision Committee's report as the committee members he had previously met with, Suzanne Lighton and Henry Shreve, were not present. Leonard Gabbard's lot division problem was discussed. Mr. Lieberenz presented drawings of the area involved. The City Inspector briefly explained the history of the problem. Jug Wheeler has sold property south of Edna Street lying between Wheeler Avenue and Austin Drive to Winston S. Lindsay. Mr. Lindsay in turn sold a 150 x 150 foot lot to Leonard Gabbard. Mr. Harold Lieberenz said that he can, under the provisions of the Zoning Ordinance No. 1239, issue a permit when the first lot is sold off a tract of land if the lot faces an existing opened and improved street and if, in his opinion, there would be no interference with any future streets or subdivisions. In this case, Mr. Lieberenz said he was of the opinion that a street was needed. Mr. Leonard Gabbard has agreed to give a triangular piece of his lot for street purposes. Mr. Lieberenz pointed out to the Planning Commission that there would be a bottleneck in any future street as there is only 30 feet between Mr. Gabbard's lot and lot 9 to the south. It was the recommendation of the Subdivision Committee that Leonard Gabbard's street ease- ment be accepted and the street easement which Winston S. Lindsay would be willing to give off lot 4 be accepted; and before any additional lots are sold, Mr. Lindsay proceed with the subdivision requirements. After a lengthy discussion, Bryan Walker moved that Leonard Gabbard give a street easement so that a future street west of his lot could be 40 feet wide. Bill Dalton seconded the motion which passed unanimously. The City Building Inspector explained the subdivision problem of Virginia L. McPherson who owns real estate south of Zion Road. Mrs. McPherson had requested permission to build upon a lot which fronts a street that has not been dedicated to the City of Fayetteville, Arkansas. It was the recommendation of the Subdivision Committee that no permits be issued until Mrs. McPherson subdivide her property. The Planning Commission discussed the problem but no action was taken. The Planning Commission as well as the Subdivision Committee made no recommendation on Roy Hillian's lot division problem of real estate south of Skelton Street until further information was submitted. The sketch of W. G. Shipley's proposed subdivision was presented to the Planning Commises sion. Mr. Lieberenz reported that the Subdivision Committee recommended that Mr. Shipley proceed with his preliminary plat as the street layout was satisfactory. Hugh Stubble- field moved that the Planning Commission accept the recommendation of the Subdivision • Committee. The motion was seconded by Bill Dalton and passed unanimously. Clark McClinton moved that the Planning Commission recommend to the City Council that 19: Lynn L. Smith's final subdivision plat of Arrowhead Acres be accepted. Hugh Stubble- field seconded the motion which carried unanimously. Harold Lieberenz presented to the Planning Commission a petition of Thomas Comley and J. W. Eoff for the closing of a north -south 20 -foot street in Evin's Farm Addition. Mr. Lieberenz said that the REA had agreed to move their power lines and there are no other utility lines within the street. A motion was made by Clark McClinton, seconded by Hugh Stubblefield and passed unanimously that a resolution be adopted recommending to the City Council that the street be closed. RESOLUTION PC 11-63 WHEREAS, on June 18, 1963, at a special meeting of the Planning Commission the petition of Comley Finer Homes, Inc., and J. W. Eoff to vacate and abandon a north - south street in Evin's Farm was presented; and WHEREAS, on above-mentioned date the Planning Commission voted to make a recommendation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the City Council act favorably upon the petition of Comley Finer Homes, Inc., and J. W. Eoff which requested the vacating and closing of a north -south street in Evin's Farm. PASSED AND APPROVED THIS ZE��day c Hugh Stubblefield moved that the Planning Commission recommend to the City Council that V. H. Gragg's final subdivision plat of Gragg Addition be accepted. The motion was seconded by Bryan Walker and passed unanimously. The final subdivision plat of Cleon Caudle was presented. Mr. Lieberenz reported that Mr. Caudle had agreed to give 8 feet off his property inorder to widen Ash Street and had agreed to provide necessary 10 foot easements up the rear of his proposed lots; therefore the final plat was ready for approval. Bryan Walker moved that the Planning Commission recommend to the City Council that the final subdivision plat of Caudle's Addition be accepted. Bill Dalton seconded the motion which carried unanimously. There was discussion of Johnnie Bassett's South Sunny Acres Subdivision. It was the opinion of the members present that Mr. P. N. Flum and Mr. Johnnie Bassett should be • invited to meet with the Planning Commission before any action is taken.
