The Fayetteville City Planning Commission met in a special called meeting at 4:00 p.m.
on Tuesday, April 23, 1963, in the City Council Chambers in the City Administration
Building.
Members present: J. F. Palmer, Henry Shreve, Bryan Walker, Hugh Stubblefield, Paul
Young and George Caudle.
Members absent: Suzanne Lighton, Clark McClinton and Bill Dalton.
The special meeting was called to order by Chairman J. F. Palmer. Mr. Palmer said that
this special meeting had been called to take action on a petition requesting the vac-
ation and abandonment of Edgewood Street and on several preliminary subdivision plats.
Harold Lieberenz, City Building Inspector, presented the preliminary plat of V. H.
Gragg. Mr. Cragg was also present to answer any questions. Mr. Lieberenz said there
were problems which needed the consideration of the Planning Commission. The City
Inspector said that Sang Avenue as it now exists is only 40 feet wide and the City
Council has requested 50 foot streets. Mr. Lieberenz pointed out that whoever platted
the Lewis Subdivision (property now owned by Mr. Gragg) which is east of Sang Avenue
dedicated the entire 40 feet for a street; said street being Sang Avenue. If any more
land were taken from Mr. Gragg's lots, the lots would be too small.
George Caudle arrived at the meeting.
• Lot 3, according to Mr. Lieberenz, has only a 50 foot street frontage; however enough
land can be taken off lot 2 to obtain sufficient lot frontage for lot 3 and still have
the necessary footage for lot 2 if the Planning Commission requested a 60 foot lot
frontage for lot 3. Air. Lieberenz told the Planning Commission members that the Plan-
ning Commission was given the right to waive this lot frontage requirement in the
subdivision regulations.
Another point which needed consideration was the zoning district. Mr. Lieberenz said
that the property was zoned R-2 Two Family Residential District, a district within
which duplexes are permitted; however Mr. Gragg wishes to build only single family
homes, the maximum size of the houses would be approximately 28 feet by 60 feet. The
subdivision ordinance requires only 7,000 square feet per lot in this district if one
family residences are build. Air. Gragg's lots have 7,700 square feet or more.
After the problems were fully explained, Henry Shreve, a member of the Subdivision
Committee, said it was the recommendation of the Subdivision Committee that Mr. Gragg
not be required to give 10 feet to make Sang Avenue 50 feet wide as giving this
additional land would penalize Air. Gragg by making his lots too narrow to meet the
requirements of the zoning and subdivision regulations; that the lot frontage require-
ment be waived on lot 3 of Block 2; and that if Mr. Gragg wishes to build only single
family dwellings on the small lots shown within his subdivision that he be permitted.
Paul Young moved that the Planning Commission accept the recommendation of the subdiv-
ision committee and approve the preliminary plat. The motion was seconded by George
Caudle and carried unanimously.
• Thomas Comley's preliminary plat had also been presented to the Subdivision Committee
for study and recomrendation. Harold Lieberenz said that the Subdivision Committee's
recommendation was that Mr. Comley be required to dedicate at least 5 feet off his
• east property line for Leverett Avenue; and that the street grades of Bel Air Drive
and Melvia Maria Drive is approved by the City Engineer so that the streets will have
the property drainage. George Caudle moved that the Planning Commission accept the
Subdivision Committee's report. The motion was seconded by Hugh Stubblefield and
passed unanimously.
Cleon Caudle's Subdivision was introduced for the first time. Harold Lieberenz ex-
plained the problems involved. Ash Street is 48 feet wide west of the proposed sub-
division; however according to the plat the Caudle property projects 8 feet past the
adjacent subdivision to the west. Another problem was that of the utility easements.
He said the east and west easements shown on the plat are only 5 feet wide. The sub-
division ordinance requires a 10 foot easement and the utility companies need the 10
feet to install the utilities. lir. Lieberenz said that if there were no easements,
then the utilities would have to go in the streeti Austin Avenue. Henry Shreve moved
that the Planning Commission approve the preliminary plat of Cleon Caudle provided that
Mr. Caudle give 8 feet off the south side of his property to make Ash Street 48 feet
wide and provided that Mrs Caudle either install the utilities within the street or
install the utilities in 10 foot easements on the east and west sides of the subdivision
(rear of lots). The motion was seconded by Bryan Walker and passed unanimously.
Chairman Palmer reported he had checked into and made inquiries regarding the petition
of F. F. Stice, Charlotte Stice and L6is M. Cunningham to vacate and abandon Edgewood
Street. Harold Lieberenz reported that the City Council had held a public hearing on
this petition Monday, April 22. There were no objections to the closing of Edgewood
Street. After hearing the reports of the Chairman and the Building Inspector, Henry
Shreve moved that by resolution the Planning Commission recommend to the City Council
that Edgewood Street be closed from Gregg Avenue to the junction of Frisco Avenue. The
motion was seconded by Bryan Walker and carried unanimously.
RESOLUTION PC 8-63
WHEREAS, on April 2, 1963, at the Planning Commission's regular meeting the
petition of F. F. Stice, Charlotte A. Stice and Lois M. Cunningham to vacate and
abandon Edgewood Street was submitted. Action on said petition was deferred until
additional information could be obtained; and
WHEREAS, at a special called meeting on April 23, 1963, the Planning Commission
voted to make a formal recommendation to the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF FAYETTEVILIE,
ARKANSAS:
Section 1. That the City Council act favorably upon the petition of F. F.
Stice, Charlotte A. Stice and L6is Me Cunningham within which was requested that
Edgewood Street be vacated and abandoned.

The Building Inspector brought Johnnie Bassett}s South Sunny Acres Subdivision before
• the Planning Commission on a question about the widening of Sang Avenue. The reason
the Building Inspector questioned the widening of Sang Avenue was due to the fact that
the subdivision regulations have been amended since Dir. Bassett started with his pre-
liminary subdivision plat. After discussion, although no formal action was taken, the
Planning Commission agreed to require no changes in Sang Avenue and that Mr. Bassett
should proceed according to action taken by the Planning Commission at the meeting of
September 5, 1961.
There was no further business; therefore the meeting was adjourned.
