HomeMy WebLinkAbout1963-02-18 Minutes148 MINUTES OF A CITY PLANNING COMMISSION MEETING • The Fayetteville City Planning Commission met in a special meeting at 4:00 p.m., Monday, February 18, 19639 in the City Council Chambers in the City Administration Building. Members present: J. F. Palmer, Suzanne Lighton, Clark McClinton, Bryan Walker and Bill Dalton. Members absent: Paul Young, Hugh Stubblefield, Henry Shreve and George Caudle. The special meeting was called to order by Chairman J. F. Palmer. Mr. Palmer reported that the purpose of this meeting was to give further consideration and/or take action on the rezoning petition of Austin Parish and Ethel Parish, husband and wife, and to hear a report from the Subdivision Committee on the covenants and plat of Tom Comley and J. W. Eoff. Mr. Palmer said the rezoning petition of Austin Parish would be discussed first A petition with the signatures of several persons -protesting to the rezoning from R -IA to I-lA the property east of Garland Avenue and south of. the University of Arkansas Experimental Farm was submitted to the Planning Commission. After looking at the petit- ion in protest to the rezoning and as the members had had previous time to study the rezoning request, Bill Dalton moved that the Planning Commission in the form of a res- olution recommend to the City Council that the petition be denied as to the area south of the east -west platted public street (as per sketch plat attached hereto) which divides the petitioned area, so that this area will remain zoned R -IA; that the area north of said east -west platted public street (as per sketch attached hereto) be rezoned to I-lA conditioned on and not to be effective until covenants restricting the use to that of the • Ozarks Electric Cooperative only and providing for landscaping and maintenance of the area, with the covenants to provide that they are not subject to change without city approval, are recorded and are attached to and made a part of the zoning ordinance after being presented to and approved by the Planning Commission or its authorized agend:,�The motion was seconded by Clark McClinton and a lengthy discussion followed. Suzanne Lighton stated that she was of the opinion further study should be given to the possibility of a need for zoning a larger area in which the Ozarks Electric Cooperative and other similar uses would be permitted and even the possibility of creating a new zone. Clark McClinton said he agreed with Suzanne Lighton; however he felt that the land north of Davis Street, more or less, was not suitable for residential use. Some of the other members agreed with Mr. McClinton. Upon roll call, the following vote was recorded: McClinton, Dalton, Walker and Palmer "Aye" and Lighton "Nay." There being four ItAyes" and one "Nay," the chairman declared the motion had passed. Chairman Palmer instructed Suzanne Lighton to contact the petitioners for the purpose of drawing up the covenants and that she, with the consent of the members, was authorized to approve the restrictive covenants. (Although no formal action was taken, it was the unanimous consent of the Planning Commission members that Suzanne Lighton act in behalf of the Planning Commission in the approval of the above mentioned restrictive covenants.) RESOLUTION PC 4-63 WHEREAS, a public hearing was held on February 12, 1963, by the Planning Commission on the petition of Austin Parish and Ethel Parish, husband and wife, at 149. which time no forral action, was taken; and WHEREAS, at a special meeting on February 18, 1963, the Planning Commission • voted to make a formal recommendation to the City Council; and WHEREAS; the covenants requested in the Planning Commission's recommendation are•'.to be approved by Suzanne Lighton who was authorized by the Planning Commission to act in its behalf; NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS, THAT IT RECOMMENDS TO THE CITY COUNCIL OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the petition be denied as to the area south of the east -west platted public street (as per sketch plat attached hereto) which divides the petitioned area, so that this area will 'remain zoned R-lA; SECTION 2. That the area north of said east -west platted public street (as per sketch plat attached hereto) be rezoned to I-lA conditioned on and not to be effective until the attached covenants restricting the use to that of the Ozarks Electric Cooper- ative only and providing for landscaping and maintenance of the area, with the covenants to provide that they are not subject to change without city approval, are recorded and are attached to and made a part of the rezoning ordinance. PASSED AND APPROVED THIS _day of 121re�qiiw�ly 1963. APPZFOC • J. HAIRMAN The Chairman asked for the Subdivision Committee's report on the covenants of Tom Comley and J. W. Eoff. Suzanne Lighton, Chairman of the Subdivision Committee, quickly went over the covenants and a few minor changes were made by the Planning Commission. Suzanne Lighton moved that the covenants, as corrected, be approved; and that a resol- ution to the City Council making known the Planning Commission's recommendation on the rezoning petition of Tom Comley and J. W. Eoff be adopted. The motion was seconded by Clark McClinton and passed unanimously. RESOLUTION PC 3-63 WHEREAS, on January 3, 1963, a public hearing was held by the Planning Commission on the rezoning petition of Arcade Real Estate Corportion (Tom Comley) and J. W. Eoff at which time no formal rec6mmendation was made; and WHEREAS, at a regular meeting of the Planning Commission held January 15, 1963, after again hearing some of those concerned with the petition for rezoning, the Planning • Commission voted to make a recommendation to the City Council in which certain require- ments are to be met by the petitioners; and 150 WHEREAS, the covenants in which are contained restrictions requested by the Planning Commission were submitted and approved by the Planning Commission at its • meeting on February 18, 1963; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That in connection with the petition of Arcade Real Estate Corporation (Tom Comley) and J. W. Eoff for rezoning land between Garland Avenue and Leverett Avenue and north of Bel Air Acres Subdivision (as per sketch plat attached hereto) the Planning Commission recommends that the petition be denied as to the part of the area shown and labelled "Tract No. 1" on the sketch plat so that this area urill remain zoned R -1B; SECTION 2. That the part of the area shown and labelled "Tract No. 2" on the sketch plat not be rezoned to R-4 as petitioned, but be rezoned to Rr3 conditioned on and not to be effective until the attached covenants are recorded and are attached to and made a part of the rezoning ordinance.
