HomeMy WebLinkAbout1963-02-05 Minutes141 MINUTES OF CITY PLANNING COMMISSION MEETING • The Fayetteville City Planning Commission met in a regular annaul meeting at 3:30 p.m., Tuesday, February 5, 1963, in the City Council Chambers. Members present: J. F. Palmer, Suzanne Lighton, George Caudle, Hugh Stubblefield, Clark McClinton and Bryan Walker. Members absent: Paul Young, Bill Dalton and Henry Shreve. After calling the public hearing to order, Chairman J. F. Palmer reported that•the purpose of the meeting was duo -fold: Toholda public hearing for two rezoning requests and to hold a business meeting. The Chairman said the rezoning of lots 4, 5 and 6 of Block 8 of Gunter Addition would be considered at this time, and all parties interested in this zoning change would now be heard. Donald Karnes said he was chosen as spokesman for the persons concerned with the proposed change in zoning. Mr. Karnes presented petitions which had been signed by persons objecting to the rezoning from R -1B to Gl of lots 4, 5 and 6 of Block 8 in the Gunder Addition, He said that they were not disturbed about the zoning change until they learned of distasteful business which were permitted in the G1 zone. Those living in the area were reluctant to open the area for all businesses. Mr. Karnes said if it could be done they would like for the street number (522 Gunter Street) and not the lot rezoned. He and the others wondered why the Board of Adjustment could not handle this problem. • For the benefit of the Planning Commission and the persons interested, Harold Lieberenz explained the procedure Doctor Harris had followed and the results. A lengthy discussion of the rezoning in which Mr. Ellis, Mr. Morrison and Doctor Harris, property owners, stated their opinions followed. The Planning Commission asked the objecting parties present if they would have any objections if the property in question were zoned to R -P Professional Office Residential District which would permit professional offices. The people involved stated they definitely had no.objections to Doctor Harris' office; the majority even felt that the R -P zone would be better than the C-1 zone. The Chairman thanked those who attended the hearing for their interest and time. He declared that the first portion of the hearing being over that the zoning change re- quested by the Presbyterian Church would be considered. The hearing was opened for discussion, and those present who wanted to be heard in regard to the petition were asked to speak. Reverend Charles Andrus, pastor of the Presbyterian Church on Knox Drive, and Reverend Coy Lee, Field Representative, were the only parties present. Reverend Andrus presented to the Planning Commission a petition with the signatures of property owners in the vicinity of the 9 acre tract of land located on the north side of Highway 16 West. These property owners had no objections to the zoning change for church use. The Chairman reported that the purpose of the public hearing having been accomplished, the public hearing was adjourned, and the annual regular business meeting would commence. 142 The minutes of January 39 1963 (regular meeting) and January 15, 1963 (special meeting) were approved as written and mailed to the Planning Commission members prior to this meeting. • A motion was made by Bryan Walker, seconded by Hugh Stubblefield and passed unanimously that the officials who had served the past year be reinstated; their positions being: J. F. Palmer, Chairman and Suzanne Lighton, Vice-chairman and Secretary. F-1 LJ The Subdivision Committee Chairman reported that the committee members had met with Ellis Burgin, Chairman of the Planning Committee of the City Council; Bass Trumbo,- City Attorney; and Harold Lieberenz, City Inspector, to discuss F. F. Nonnamaker's Subdivision. Suzanne Lighton moved that the Planning Commission retract action taken on requiring a street in F. F. Nonnamaker's Subdivision and that a subdivision plat not be required at this time. The motion was seconded by Clark McClinton. After discussion and before a vote was taken Suzanne Lighton with the consent of Clark McClinton withdrew the motion. George Caudle moved that the Planning Commission recommend that Mr. Nonnamaker file a subdivision plat of the entire area involved, particularly because of the problem of future development of his own property so that the Planning Commission can more intelli- gently consider the problem. The motion was seconded by Suzanne Lighton and upon roll call vote the following vote was recorded: Palmer, Lighton, Caudle, McClinton and Stubblefield "Aye" and Walker abstained from voting. There being five "Ayes" and one "Abstaining" vote, the Chairman declared the motion had passed. Clay Yoets lot division problem was explained to the Planning Commission by Harold Lieberenz. Mr. Lieberenz said that Mr. Yoe had an opportunity to sell a couple of lots in Block 4 of Broadview Subdivision. Block 4 at the time it was platted was not divided into lots; there is enough lot area in Block 4 to divide it into two large lots. Suzanne Lighton moved that the Planning Commission accept the lot division (as per sketch attached to the minutes) of Block 4 of Broadview Addition; that the Building Inspector be authorized to issue building permits when requested; and that this lot division of Block 4 be included on the next subdivision plat submitted by Clay Yoe. The motion was seconded by Hugh Stubblefield and passed unanimously. A motion was made by Suzanne Lighton, seconded by George Caudle and passed unanimously that the Planning Commission recommend to the City Council that Ira Hammond's final plat of the Replat of Part of Hammond's Addition be accepted. It was the opinion of the Planning Commission members that the request of the Board of Trustees, The Presbytery of North Arkansas, The Synod of Oklahoma -Arkansas, the United Presbyterian Church in the U. S. A. for the rezoning from R -1B to P-lA of a 9 acre tract of lard on'the north side of Highway 16 West would not convlict with surrounding land uses and would not be contrary to city.planning; therefore Suzanne Lighton moved that the Planning Commission recommend to the City Council that the property described below be rezoned from R -1B to P-lA. Part of the Southeast quarter of the Northeast quarter of Section eight (8) in Township sixteen (16) North, Range thirty (30) West, described as follows: Begin- ning at a point eight and fifty hundredths (8.50) chains North and three and forty eight hundredths (3.48) chains East of the South West corner of said forty acre tract, and running, thence East eleven and forty three hundredths (11.43) chains; • thence South eight and fifty six hundredths (8.56) chains to the North line of State Highway No. 16; thence in a Westerly direction bearing North with the North line of said Highway to a point where drain under the roadbed of said highway 143 enters into a certain ditch; thence North 5 1/2" West with line of ditch seven and sixty hundredths (7.60) chains to the point of beginning, containing nine and fifteen hundredths (9.15) acres, more or less. • The motion was seconded by Clark McClinton and passed unanimously. After discussion a motion was made by Suzanne Lighton, seconded by Hugh Stubblefield and passed unanimously that the Planning Commission recommend to the City Council that lots 4, 5 and 6 of Block B in Gunter's Addition be rezoned from R -1B to R -P. The Chairman declared that the action on closing an alley in Putman's Addition would have to be deferred because of the lack of time. The meeting was adjourned. RESOLUTION PC 2-63 4 / 21. .W . WHEREAS, on February 5, 1963, at the regular annual meeting of the Planning • Commission action was taken on F. F. Nonnamaker's Subdivision problem which was referred back to the Planning Commission; and WHEREAS, a resolution from the City Council requesting the Planning Commission's recommendation of the vacating of an alley in Block 1 of Putman's Addition was on the agenda of the above-mentioned meeting. NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That it be made known the Planning Commission recommended that Mr. Nonnamaker file a subdivision plat of the entire area involved, particularly be- cause of the problem of future development of his property, so that the Planning Commission can more intelligently consider the problem. Section 2. That due to the lack of time the Planning Commission did not make any recommendation on the vacating of an alley in Block 1 of Putman's Addition.
