HomeMy WebLinkAbout1963-01-03 Minutes;w.132> MINUTES OF CITY PLANNING COMMISSION MEETING • The Fayetteville City Planning Commission met in a special meeting at 3:30 p.m. on Thursday, January 3, 1963, in the Municipal Court Room in the City Administration Building. Members present: J. F. Palmer, Suzanne Lighton, Henry Shreve, Bill Dalton, Hugh Stubblefield, George Caudle and Clark McClinton. Members absent: Paul Young and Bryan Walker The meeting was called to order by Chairman J. F. Palmer. The Chairman reported that the purpose of the meeting was to hold a public hearing to give consideration to three rezoning petitions filed with the Planning Commission. The first petition which was considered was the petition of John I. and Christine Foreman. Suzanne Lighton, secretary of the Planning Commission, read the petition in which petitioners requested the rezoning from R-2 Two Family Residential District to R-3 Multi -family Residential District lots 1 and 2 in Block 1 of Harrison's Addition to the City of Fayetteville, Arkansas, The Chairman declared the meeting open for discussion and those present who objected to the rezoning proposal would be heard at this time. Allen W. Dowell, 220 North Olive Avenue, said that spot zoning as requested would take away the protection afforded by the zoning ordinance. He was opposed to • the zoning change. Dr. R. E. Lesh, 356 North Washington Avenue, stated he did not think an exception should be made in zoning. He said he planned to build a home on Spring Street, but he would not want apartments in the same area. It was established that Doctor Lesh owns all of Block 2 and all but 3 lots of Block 1 of Harrison's Addition. J. C. Clay, 414 East Spring Street, said he lived directly across the street from the property in question. He opposed the zoning change. Mr. Clay also pointed out that there was a parking problem in the area. Mrs. Elo Michaels, 308 East Spring Street, told those present that Allen Dowell had expressed her opinion of the zoning change. Mrs. Elizabeth Ellis, 124 North Olive Avenue, said there were no multi -family housing units in the area. The Chairman of the Planning Commission pointed out that the neighboring area to the west was zoned for apartments whether there were any apartments in the area or not. J. W. Cane, 209 North Olive Avenue, called J. F. Palmer prior to the hearing date. Mr. Palmer, Planning Commission Chairman, reported that Mr. Cane voiced his objections to the rezoning. Mr. Cane felt that apartments in the area would be detrimental to the existing homes. Also, there would be a traffic hazare in the neighborhood. • There were no more objectors to be heard; therefore the Chairman declared that those present and in favor of the rezoning would be heard at this time. 133 Glen Wing, attorney representing John I. Foreman and Christine Foreman, spoke in.:behalf of his clients. Mr. Wing said that rezoning helped the growth of a • city. As pointed out by Mr. Wing, the zoning change requested by his clients would not be spot zoning, but merely extending an existing zone. Mr. Wing said that his clients wanted to put another apartment in an existing structure; there would be no extension of the roof line. The building has two kitchen units in it at the present. Mr. Wing assured those concerned that his clients would, before obtaining a permit, have ample parking area. This parking area which would be provided would benefit the people inconvienced by the narking problem. Allen Dowell asked Mr. Wing how long ago the property had been purchased and whether or not the zoning had been checked before the property was purchased. Mr. Wing replied that the Foremans had purchased the property last year and that they were familar with the zoning. Suzanne Lighton inquired if either Walnut Avenue or Carrol Avenue were open. She was informed that only Walnut Avenue is open. There was no further discussion; therefore the Chairman thanked those who attended the meeting for their interest. • The second petition before the Planning Commission was the petition of Arcade Real Estate Corporation and J. W. Eoff. The petition was read by the secretary of the Planning Commission. The petitioners requested the rezoning of two tracts of land: Tract 1 being described as part of the Southwest Quarter of the Southwest Quarter of Section 4, Township 16 North, Range 30 West, and more particularly described as follows: Beginning at a point 657 feet north of the southwest corner of the above described 40 -acre tract, and running thence north 330 feet; thence east 921.41 feet; thence south 37 feet; thence east 400 feet; thence south 293 feet; thence west 1,321.41 feet to the point of beginning, and Tract 2 being described as part of the Southwest Quarter of the Southwest Quarter of Section 4, Township 16 North, Range 30 West, and more particularly described as follows: Beginning at a point 987 feet north of the southwest corner of the above described 40 -acre tract, and running thence north 333 feet; thence east 1,321.41 feet; thence south 150 feet; thence west"400;fbet;-thence south 183 feet; thence west 921.41 feet of the point of beginning. Tract 1 was requested to be rezoned from R -1B Single Family Residential District to R-2 Two Family Residential District, Tract 2 was requested to be rezoned from R -1B Single Family Residential District to R-4 Multi -family Residential and Dormitory District, James D. Cypert, attorney representing petitioners, requested time to call attention to errors made in the petition. The Chairman granted Mr. Cypert the time. Correct- ions made were as follows: 7. (c) That the Lands to the north of said Tract 2 are inside the city limits of Fayetteville, Arkansas, and are being used for agricultural purposes, and 7. (d) That the lands to the east of said Tract 1 are zoned R -1B, and that Tract 2 is separated from said lands by Leverett Avenue. The Chairman declared the meeting open for discussion, and those present who objected to the zoning change would be heard at this time. William Putman, attorney, appeared before the Planning Commission in behalf of the residents in the area. Mr. Putman presented for the files of the Planning Commission a petition with the signature of 72 persons who objected to the zon- ing change. Mr. Putman pointed out that the land to the east, west and south • of the tracts in question is zoned R -1B Single Family Residential District. The 5 acres to the north is outside the city limits; however the property is in the process of being annexed to the city. The people who own this 5 acre tract, as 134 well as those people owning homes on Garland Avenue, Oakland Avenue and in Bel Air Acres Subdivision,objected to the rezoning. • Bir. Putman mentioned that rezoning is for the purpose of correcting or clearify- ing a realistic fact. The zoning change requested is not an extension of an existing zone or is it correcting a realistic fact, rather it is spot zoning. The Bel Air Acres Subdivision is already 90% or 95% developed and is strictly a single family residential area. There is no rental property in the neighborhood. All homes are the homes of permanent residents. The rezoning of the property to the north would depreciate the value of the property. lir. Emory Gose, Fayetteville realtor, commented on the depreciation of property. He said he had had a great deal of experience on appraising property. Mr. Gose pointed out that the influences outside can partially destroy property value. Anything with no future has no present value. The houses in the area are relat- ively new with a future life of 40 or 50 years if protected properly. The zoning ordinance and zones afford part of this protection. It was Mr. Gose's opinion that should the property in question be rezoned, the neighboring property value would be reduced 10% to 25%. David L. Isom, 850 Davis Street, protested to the zoning change. He remarked that he had searched several months to find property in and surrounded by a single family zone. Mrs. Z. L. Thomas, who owns 15 acres which is not in the city limits at the pres- ent, said she plans to develop her property for residential purposes. Melton L. Oden, ,917 Davis Street, stated that William Putman had expressed his • opinion. Jim F. Petty, 808 Davis Street, said he had spent 20 years in the navy and had moved a great deal. He knew what rent property looked like with people moving in and out often; therefore he strongly opposed the rezoning. George Basore, 847 Davis Street, remarked that he had just purchased property in Bel Air Acres and was now reluctant to move into the house. J. L. Bowers, 1907 Garland Avenue, protested to the change in zoning. C. A. Gordon, North Leverett Avenue, objected to apartments being erected in the area. Virginia Bowers, 1907 Garland Avenue, agreed with her neighbors. She said she was in the real estate business and that 90% of her customers wanted property in a single family residential area. Dorothy Covington, 1735 North Oakland Avenue, was not in favor of the rezoning. Mrs. A. T. Parker, who owns several acres outside the city limits, said her property had been petitioned to come into the city. She objected to the rezoning. Gordon Tupper, 819 Kelley Street, stated that he had lived in Fayetteville a year before purchasing his home. He bought the property because of the zone in • which it was located and because of the surrounding zone. Mr. Tupper felt that should the petition forxezoning be granted a severe traffic problem would result in their residential area. 135 Carroll Elkins, 1772 Oakland Avenue, said that his house faced west and is the northern most house on Oakland Avenue. Should the duplexes be constructed, he would face the backs of the duplexes. There were no more people to be heard in opposition to the petition; therefore the Chairman declared that those present in favor of the petition would now be heard. James D. Cypert, attorney for the petitioners, explained his clientst position. Mr. Cypert questioned Mr. Putman's definition of spot zoning. Mr. Cypert pointed out that the land in question consists of approximately 19 acres; henceforth it is not a small area. Tract 1 which has been petitioned to be rezoned from R -1B to R-2 would serve as a buffer zone between the R -1B zone and the R-4 zone. The proposed apartments which would be erected on Tract 2 would be 2 1/2 stories above the ground, brick buildings with landscaping and there would be 12 families per building. Mr. Cypert stated that Federal aid would not be sought by his clients as suggested. Mr. Tom Comley of Arcade Real Estate Corporation said that in his opinion the land was suited for apartments. The apartments he and Mr. Eoff planned to build would not be detrimental to the area. The apartments would be managed by a per- son who would live on the grounds; a swimming pool is also planned. Mr. Comley said he had owned this property for 4 or 5 years and that he had built several homes in Bel Air Acres First Addition. Mr. J. W. Eoff told those present that his land was not cleared and that it had been being used to pasture horses. He felt that the people living in the area would rather see the land in use with a building upon the property. He pointed • out that he did not earn his living building apartments. Mr. James Cypert and Mr. William Putman summed up their clients' requests before retiring. The Chairman thanked all those present at the hearing for their attendance and interest. The third and last petition brought before the Planning Commission at this hearing was that of Carl Tune of Tune Construction Company. Carl Tune petitioned the Planning Commission in behalf of another party. Suzanne Lighton, secretary, read the petition in which was requested the rezoning from R -1B Single Family Residential District to C-2 Thoroughfare Commercial District the west part of real estate which is not already zoned C-2 located on North College Avenue. The Chairman declared the meeting open for discussion, and declared those interested in the petition would be heard. There was no one present to be heard other than the petitioner. The Chairman reported that the purpose of the public hearing having been accomplished, the public hearing was adjourned. After the public hearing, the Planning Commission met to take the following action on the petitions: Clark McClinton moved that the Planning Commission recommend to the City Council that the following described real estate which is not already zoned C-2 Thoroughfare Commercial District be rezoned from R -1B Single Family Residential District to C-2: • Part of the WA of the NW Frl. Quarter of Section 3 in Township 16 North, Range 30 West, more particularly described as beginning at the Southeast corner of said west • • 0 136 half of the Northwest Quarter; thence West 336.2 feet to the west line of right-of- way of U. S. Highway 71 for a beginning corner; thence West 556.8 feet, thence North 385.44 feet; thence East 417.1 feet; thence South with the west line of the T. N. Wester tract, 231 feet; thence East 164.34 feet; to the west line of the right-of-way of U. S. Highway 71; thence Southwest with said West line of the U. S. Highway 71 to the place of beginning, containing 4.26 acres more or less. The motion was second- ed by Hugh Stubblefield and passed unanimously. The Planning Commission felt that the extension of the C-2 zone to include all the property owned by one party would not be contrary to city planning and/or future development. I. The petition of Arcade Real Estate Corporation and J. W. Eoff was given consideration by the Planning Commission. After a lengthy discussion, it was suggested that action be deferred until further study of the request could be made. Chairman J. F. Palmer requested that the members be prepared to act upon the petition at the next meeting. The Planning Commission discussed the petition of John I. and Christine Foreman. Bill Dalton moved that the Planning Commission deny the petition of John I. and Christine Foreman requesting the rezoning of lots 1 and 2 of Block 1 of Harrison's Addition to the City of Fayetteville, Arkansas, from R-2 Two Family Residential District to R-3 Multi -family Residential District. The motion was seconded by Henry Shreve and passed unanimously. The Planning Commission members were of the opinion that the rezoning of these two small lots would not be favorable because of the proximity of the R-2 zone which would surround the lots should said lots be rezoned, the smallness of the area involved and the objection of the neighbors. There being no further business, the meeting was adjourned.
