MINUTES OF CITY PLANNING COMMISSION MEETING
. The City Planning Commission of Fayetteville, Arkansas, met in a regular meeting on
Tuesday, December 4, 1962, in the Municipal Court Room in the City Administration
Building.
Members present: J. F. Palmer, Suzanne Lighton, George Caudle, Bryan Walker, Hugh
Stubblefield and Clark McClinton.
Members absent: Henry Shreve, Paul Young and Bill Dalton.
The meeting was called to order by Chairman J. F. Palmer. The minutes of November 6,
1962 (regular meeting) and November 20, 1962 (special meeting) were approved as written
and mailed to the members prior to this meeting.
The Chairman reported that a public hearing had been held on November 20, 1962, on the
rezoning proposals of Carl E, and Zola Millheisler, husband and wife, and of Wiggins
Memorial Methodist Church; however no action could be taken after the hearing as a
quorum was not present.
A motion was made by Suzanne Lighton and seconded by Bryan Walker that the Planning
Commission recommend to the City Council that property belonging to Carl E. and Zola
Millheisler, husband and wife, be rezoned from I-2 Heavy Industrial District to C-2
Thoroughfare Commercial District, and said property is described as follows: The west
part of the following described real estate which is not already zoned C-2 Thorough-
fare Commercial, to -wit: Part of the SW� of the SE4 of Section 21, Township 16 North,
Range 30 West at a point which is 110 feet east and 185 feet north of the southwest
• corner of the above described 40 -acre tract. Thence north 80 feet, thence south 83'45'
east 368.9 feet to the west line of the right-of-way of U. S. Highway 71, thence south
11°321 west with the west line of said right-of-way 100 feet and thence north 80°28'
west 351.6 feet to the place of beginning; and that property belonging to the Wiggins
Memorial Methodist Church be rezoned from R-2 Two Family Residential District to
P-lA Special Church District, and said property being described as follows: All of
Block 28 of Jenning's Addition to the City of Fayetteville, Arkansas; and lots 2 and
3 of Block 2 and the east 75 feet of lots 1 and 4 of Block 2 of Ferguson's Addition
to the City of Fayetteville, Arkansas. The motion carried unanimously.
The Chairman stated that after the public hearing of November 20, it was decided more
study and discussion should be given to the rezoning proposal initiated by the City
Planning Commission to consider the rezoning of lot 12 of Evelyn Hills Addition to the
City of Fayetteville, Arkansas, from C-2 Thoroughfare Commercial District to R-4 Multi-
family Residential and Dormitory District. The City Building Inspector introduced the
idea of rezoning the lot in question to R -P Professional Office and Residential Dis-
trict. Harold Lieberenz, City Building Inspector, pointed out that such a sone would
solve several problems which had arisen as a result of the error made at the time the
ordinance and zoning map were adopted by the City of Fayetteville, Arkansas, about two
years ago. After more discussion, Chairman J. F. Palmer asked Jim Hale, attorney
representing Carl Ferguson, to discuss with Mr. Carl Ferguson the possibility of
zoning the lot in question to R -P Professional Office Residential District. Planning
Commission action on the rezoning of lot 12 was deferred until a later date.
The City Building Inspector reported his findings on the kindergarten and nursery
• definition problem to the Planning Commission. The party he telephoned stated she
kept 15 children. The party who made known her complaint was also telephoned; she
complained about the noise and that number of children made. Suzanne Lighton moved

that the Planning Commission follow the procedure necessary and add to the zoning
ordinance the definition of kindergartens and nurseries as determined at an earlier
• Planning Commission meeting. The motion was seconded by Bryan Walker and passed
unanimously.
The Chairman asked the Subdivision Committee chairman if the committee was ready to
report. Suzanne Lighton, chairman of the Subdivision Committee reported:
Since the three lots Peggy Mason wishes to build upon will not interfere with
future development of surrounding property and all utilities are available, it is
the recommendation of the Subdivision Committee that the City Building Inspector
be authorized to issue building permits for all three lots on Viewpoint Drive.
Bryan Walker moved that the Planning Commission accept the report of the Sub-
division Committee on Peggy Mason's lot division problem The motion was seconded
by Hugh Stubblefield and passed unanimously.
Also, the Subdivision Committee recommended that Harry Jackson not be required to
follow the subdivision procedures in a lot division problem in which a strip of
land would be divided into six]ots; and further that the City Building Inspector
be authorized to issue permits on these six lots as there will be no interference
with future development and utilities will present no problem. However, it was
suggested that Mr. Harry Jackson file a plat and upon said plat be a note of
approval dated and signed by the secretary of.the Planning Commission. A motion
was made by Clark McClinton, seconded by Hugh Stubblefield, and passed unanimously
to approve the report of the Subdivision Committee.
V. H. Gragg's proposed subdivision was presented to the Planning Commission,
The Subdivision Committee recommended that V. B. Gragg proceed with the street
• plan he showed on a sketch presented to the Planning Commission and that the
street shown be located as far north as possible and that Mr. Gragg be instructed
to proceed with his preliminary plat.
Suzanne Lighton told the Planning Commission that her report requested by the City
Council was almost finished. She mentioned a couple of changes which should be made
in the subdivision ordinance as the errors made were topographical. These changes
were approved unanimously by the Planning Commission members present.

Mr. James Cypert, attorney, appeared before the Planning Commission on behalf of clients,
J. W. Eoff and Arcade Real Estate Corporation. Mr. J. W. Eoff and Mr. Tom Conley were
present. Mr. Cypert presented a petition for the rezoning of real estate on the east
side of North Garland Avenue, on the west side of North Leverett Avenue and north of
Davis Street. Petitioners, Arcade Real Estate and J. W. Eoff, petitinned for the re-
zoning of a tract of real estate from R -1B Single Family Residential District to R-2
Two Family Residential District and for the rezoning of another tract of real estate
from R -1B Single Family Residential District to R-4 Multi -family Residential and
Dormitory District, the latter tract being farther north but both tracts being adjacent.
Dir. Cypert stated that he wanted to find out if the Planning Commission felt that his
clients were keeping within the procedures of good planning and he wanted to familarize
the Planning Commission with the rezoning petition. The Planning Commission members
present had no objections as far as planning was concerned. Suzanne Lighton moved that
the Planning Commission hold a public hearing for the purpose of considering the re-
zoning of property belonging to Arcade Real Estate Corporation and J. W. Eoff, and the
motion was seconded by Hugh Stubblefield. The motion passed unanimously.
George Caudle moved that the Planning Commission hold a public hearing for the purpose
of considering the rezoning of real estate described as lots 1 and 2 of Block 1 of
Harrison's Addition to the City of Fayetteville, Arkansas, and petitioned for rezoning

field and passed unanimously.
The City Building Inspector presented to the Planning Commission the trailer court pro-
blems which had come before him. After discussion, Chairman Palmer appointed Suzanne
Lighton and Harold E. Lieberenz as a special committee to work with him on the trailer
court problem.
